SUBJECT: Hearing on Appeals by Carmel and Frank Boyland and James S.
Blair Of Vesting Tentative Subdivision Map 7075 in the
Walnut Creek Area.
This being the time heretofore noticed for hearing by the Clerk
of the Board of Supervisors for hearing on the appeals by James S.
Blair and Carmel and Frank Boyland from the decision of the Contra
Costa County Planning Commission to approve with conditions the
application for a Tentative Subdivision Map (Subdivision 7075) , (Ross
Blackburn, applicant and Rod McPherson, owner) , to divide 8. 2 acres
into 14 lots with variances to minimum lot dimension requirements.
Mary Fleming, Community Development Department, described the
project site and the appeals being presented today. She indicated the
staff recommendation to the Board that the modified conditions of
approval presented to the Board be approved.
The public hearing was opened and the following people appeared
to speak:
Ken Fishback, 279 Front Street, Danville, representing James S.
Blair, appellant, expressed concerns including where the drainage
goes, especially 'the routing . He expressed support for the natural
routing of the drainage rather than going down Murwood Drive. He
requested the same conditions of adequacy be addressed and required in
routing down the natural waterway as in `Subdivision 6934 which was
approved previously by the Board of Supervisors.
James S. Blair, 1449 Murwood Drive, Walnut Creek, commented on
changes in a map that he had presented to the Board of Supervisors on
June 21, 1988 .
Carmel Boyland, 2042 Hermine Avenue, Walnut Creek, read her
written testimony and requested clarification on three points, the
adequacy of their piping system, who would pay for a larger pipe being
installed, which were the correct and latest conditions of approval,
and she suggested corrected language on page 4B of the conditions of
approval, Exhibit A.
Milt Kubicek, Flood Control, responded to Mrs. Boyland' s
questions.
Francis Boyland, 2042 Hermine Avenue, Walnut Creek, declined to
speak.
Richard Miller, 2150 Hillview Drive, Walnut Creek, President of
the Walnut Knolls Association, commented on their concern that the
drainage piping be of adequate size, and that the road between San
Miguel and Ward into the Knolls not be opened.
Armando G. Cuellar, Jr. , 2162 Norris Road, Walnut Creek,
appearing on behalf of residents of Norris Road and Mt. View
Boulevard, spoke in opposition to opening Blackwood Road to Mt. View.
W.R. Hardie, 2061 Strand Road, Walnut Creek, representing Walnut
Knolls Homeowners Association, spoke against opening of Blackwood to
Mt. View.
R.M. 'Graves, 2259 Blackwood Drive, Walnut Creek, representing
Mrs. Rowland owner of the property west of lots 12, 13 , and 14, as
well as himself and Mr. and Mrs. Herman Rowland, commented on issues
including the rolling terrain, requesting homes around the perimeter
of the development be single story homes, drainage, and commented that
Mrs. Rowland would not sign a release relieving the County of
responsibility for liability for any damage as a result of flooding
through the pasture.
Richard G. Todoroff, 2244 Blackwood. Drive, Walnut Creek, spoke
against the opening of Blackwood Drive, and presented some pictures of
the area in question.
Ross Blackburn, 1600 South Main Street, Suite 290, Walnut Creek,
applicant, spoke in rebuttal. He commented on issues including the
drainage routing, the concerns of the Boylands, the drainage issue
across the Rowland property, and the opening of Blackwood Drive.
Ken Fishback spoke in rebuttal.
The public hearing was closed.
Supervisor Schroder requested clarification on the easements
necessary for underground drainage ditch' in the natural course being
obtained.
Milt Kubicek, Flood Control, responded that the easements had not
been obtained. He also commented on the drainage and flooding in the
area.
Supervisor Schroder expressed concern for trees in the area if
the drainage is taken down the road.
Milt Kubicek responded to Supervisor Schroder' s concern. .
Mr. Fishback commented on the easements and the natural drainage
right of way.
Milt Kubicek addressed the issue of the easements commenting that
the easements would not be sufficient and rights of way would have to
be purchased.
Supervisor Schroder commented on issues he would like to take
into consideration during the next week .including the opening of
Blackwood Drive, tree preservation, the drainage concerns of Mrs.
Boyland and Mr. Blair, and the elevations; and he moved to defer the
decision.. of the appeal for one week on the determination calendar.
Therefore, IT IS BY THE BOARD ORDERED that the hearing on the
above matter is CLOSED, and decision is DEFERRED to the August 2, 1988
Determination Calendar.
