SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position of opposition to SB 2753 by Senator Royce, which
amends provisions dealing with Grand Juries, unless the bill is
amended to restore the 90-day time period within which responses
to Grand Jury reports must be made.
BACKGROUND:
Under current law, the Board of Supervisors has 90 days to
respond to the Grand Jury' s final, report. SB 2753 makes a number
of changes in the law pertaining to the Grand Jury. One of these
shortens the time for the Board of Supervisors and all other
agencies to respond to the Grand Jury' s final report to 60 days.
While it may be possible for an individual elected official to
respond to a Grand Jury report in 60 days, our experience is that
it is not realistic for the Board of Supervisors to respond to .
the report in 60 days. There are frequently 100 or more
recommendations dealing with multiple county departments. This
office normally circulates portions of the Grand Jury report to
each affected department for comment. As comments are received,
they must frequently be edited and then consolidated into a
single set of consistent responses.
In Contra Costa County, it has been the practice for the Internal
Operations Committee of the Board of Supervisors to meet with the
Grand Jury and review all of the suggested responses. The
Internal Operations Committee then reports their recommendations
back to the Board. This process, which allows maximum interface
between the Grand Jury, the Board of Supervisors, and staff takes
time. Reducing the response time to 60 days will not allow
sufficient time to thoroughly comment on the Grand Jury' s
recommendations and for the Internal Operations Committee and the
Board to discuss the proposed response with the Grand Jury.
We, therefore, recommend that the Board oppose this provision of
SB 2753 and request the author to restore the 90-day time period,
at least for the Board' s review and comment on the Grand Jury' s
final report. SB 2753 has passed the Senate and is scheduled to
be heard before the Assembly Judiciary Committee on August 3 ,
1988 .
