PLEASE DESTROY PREVIOUS ISSUE T. 2 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on September 22, 1987 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson, McPeak NOES: None ABSENT: None ABSTAIN: None SUBJECT: Request for General Plan Amendment, an amendment to the County Solid Waste Management Plan, and an application for LUP 2111-86 of S. and J. Investments (applicant and owner) to establish a sanitary landfill (East Contra Costa Sanitary Landfill Project) approximately 1/2 mile south of the City of Antioch. The Board on September 8, 1987 continued its hearing on the above matter to this date and time. The Chair announced that this time was set for concluding remarks and the rebuttal statements of the applicant. Carol Hehmeyer, attorney for the applicant, referred to the previous oral and written presentations submitted to the Board, and advised that the applicant had filed another set of reports which she will be referring to as the speakers appear. She noted that with each written presentation she had filed a full resume of the expert making the statements, noting that some of statements made by detractors have been made by people who have no qualifications to make the statements they've made. The following persons were introduced by Ms. Hehmeyer and each made a presentation in the area of their expertise: Silvio Garaventa, Jr. , applicant, addressed questions relating to the buffer zone, the site' s geology, hydrology, transportation and other environmental considerations. Dale Adams, attorney, 1738 Grant Street, Concord, addressed the allegations and remarks attributed to him relating to whether East Bay Regional Park District had ever endorsed the site. George Vujnovich, President, Better Homes Realty, Concord, addressed the resale value of homes in the vicinity, particularly Gentrytown and Mira Vista Hills, and suggested that neither the value nor the appreciation of these two subdivisions have been affected by their proximity to the existing landfill site. William J. Whalen, the former Director of the National Parks System, discussed the preservation versus use issue in relation to the park, and the compatibility and coexistence of parks and landfills. William Gray, President of Smith, Gray & Company, Walnut Creek, addressed the questions relating to traffic, odor and noise, specifically overall traffic impacts, compatibility with existing traffic, the type and distribution of vehicles accessing the site, the feasibility of alternate access, and the structural adequacy of the access roads to accommodate the heavier truck traffic. C. Michael Hogan, Ph.D. , President of Earth Metrics, Incorporated, Burlingame, addressed questions raised by Supervisor Torlakson during the hearing which relate to meteorology, acoustics, 1 v odor, air quality, traffic, seagulls, aircraft safety, vibration, and wind. Richard T. Mandeville, Mandeville & Associates, City of Industry, California, discussed landfill gas generation (methane) , what it is, how it moves and how best to control it. He showed slides to illustrate the schematics of his presentation. Jeff Dunn, Senior Engineer at Kleinfelder & Associates, Walnut Creek, a professor with the University of Colorado in geotechnical engineering, and a specialist in clay liners and associated leachate collection systems, discussed the compacted clay liner proposed for the the East Contra Costa site. Ms. Hehmeyer referred to the written report filed by Carl Fricke, Levine-Fricke, Consulting Engineers and Hydrogeologists, Oakland, on the flow of the ground water in the area of the site. James Pezzaglia, appeared on behalf of Acme Fill, and advised that he had offered to make this presentation in rebuttal to the applicant and they graciously allowed him to do so. He advised that Acme Fill' s landfill permit expires in the Spring of 1989 and then the Central County will be out of landfill capacity for the approximately 500,000 tons of waste that are generated by the Central County. He suggested that the landfill applications before the Board at this time could probably be placed in operation by October 1989. He summarized the efforts of the private sector in attempting to locate and permit a private landfill site and the money at risk relating to each application and the Acme Fill Waste Transfer Station, as well as the time factor involved in the permitting. Ms. Hehmeyer presented a video tape which she advised was made by Maurice Grieves to rebut some of the claims that were made by detractors at the last meeting with respect to mining issues. Ms. Hehmeyer advised that this concluded the rebuttal, that the project before the Board is a proposed landfill which is on bedrock and a dry aquifier, clay soil, permanent buffers, visual isolation, an enormous capacity, good access, it has not mines under it or within any kind of proximity to it that could affect it, it won' t affect the Contra Loma Reservoir in any way, according to the Water District experts, the applicant' s experts and the staff, and the applicant urges approval of the site. She advised that the applicant' s experts were present and available to answer any questions the Board may have. Board members discussed with members of staff and the applicant and his experts their various concerns, including the cost of disposal at Altamont, hydrogeology of the area of the proposed landfill, potential for contamination of Contra Loma Reservoir and the San Joaquin River, the number of borings done south of the northerly toe of the site to determine the depth of the coal vein, access to the site and impact to the neighborhood. IT IS BY THE BOARD ORDERED that this hearing is CLOSED. Board members discussed the various steps necessary to conclude these proceedings. Charles Zahn, Community Development Department, discussed the report responding to the Board' s questions from prior hearings specifically addressing the summation of information in the EIR, particularly with respect to air quality and air movement and the kind of studies that were done, as well as noise, traffic and transfer stations. IT IS BY THE BOARD FURTHER ORDERED THAT deliberation and decision is DEFERRED to October 13 , 1987 at 4: 00 p.m. . The Chair requested that the Board' s questions raised today be addressed and be before the Board members before the October 13th 2 4: OO p.m. meeting scheduled for deliberation and decision in this matter. IT IS FURTHER ORDERED THAT receipt of the September 18, 1987 letter from Berliner, Cohen & Biagini, representing the City of Antioch, The East Bay Regional Park District, and the Contra Costa Water District, requesting redrafting and recirculating of the Environmental Impact Report for this project is ACKNOWLEDGED, and said request is REFERRED to the Director of Community Development for response. i hereby certify that this Is a true and correct copy of. an action taken and entered on the minutes of the Board of Superviscr on the date shown.
