SUBJECT: Approve Agreement with Santa Fe Railroad to Replace the
Fire Damaged Trestle .

I . RECOMMENDATION
Approve the agreement with Santa Fe Railroad to replace the
existing fire damaged wood trestle with a new reinforced concrete
bridge , No . 2- 1183 . 6 , over the access road to the MonTaraBay
Community Center in the Tara Hills area , and authorize the Chair
of Board of Supervisors to execute the agreement .
II . FINANCIAL IMPACT
There is no financial impact to the County General Fund . The
$70, 000 local share comes from a Federal Community Development
Block Grant .
III. REASONS FOR RECOMMENDATION/BACKGROUND
On April 19, 1987 , the existing wood railroad trestle , over the
access road serving the MonTaraBay Community Center , caught fire
and was severly damaged to the extent that all train traffic had
to be rerouted or train speeds had to be severely reduced .

The Railroad has taken the position that , under current Public
Utility Commission ( PUC ) guidelines , the County could be
responsible for 90 percent of the construction costs to replace
the trestle,. Through negotiations , the County' s share has been
reduced to 30 percent , which is $70 , 000 . As part of the
settlement , Santa Fe will :
1 . grant a permanent road easement under the trestle to County
at no cost . Discussions on this easement date back to 1975 ;
2. will fund all future bridge repair , maintenance ,
reconstruction and expansion required for railroad purposes ,
regardless of PUC guidelines or polices ;
3 . design and construct the new bridge to allow for the current
access road , future public road access , and current and
future drainage line ; and
4. agree to mutual liability and indemnity language . Usually
the local agency or applicant fully indemnifies the
railroad .
The Community Center currently has classes in progress from 10 :00
AM until 9 : 00 PM , Monday through Thursday , and closure of the
access road is of special concern to the center . Since the
Railroad has to close the road during construction , the County ,
Community Center , School District and Railroad have agreed to
detour the traffic during working hours around the project site .
The Community Center users would park near Seaview Elementary
School and take the school foot- bridge over the creek . The
center would then bus the 10 to 12 people to their classes .
Public Works is providing the road detour and information signs .
Santa Fe will be constructing the bridge with its own forces and
expects the construction to take one month . In order for Santa
Fe to be able to allow traffic under the bridge by October 21 ,
the date the center starts its fund raiser, construction on the
bridge will start immediately.
In order to assure that the center will have access by October
21 , since 4000 to 6000 people are expected from October 21 thru
31 , the Public Works Department is starting the environmental
studies and Fish and Game permits to place a temporary culvert in
Garrity Creek to allow traffic access to the center , if for some
reason the bridge project is delayed .
