TIME AND PLACE OF OCCURRENCE: 10 Friday, May 8, 1987, at approximately 7: 00 p.m. As a result 11 of an automobile - motorcycle accident occurring on Pleasant Hill 12 i Road at the intersection of Mt. Diablo Boulevard, City o 13 Lafayette, County of Contra Costa, State of California. 14 , 4 . CIRCUMSTANCES OF OCCURRENCE: 15 The general facts and circumstances surrounding this fatal 16 accident are set out in California Highway Patrol Report Numbe 17 AIC L87-174 which is attached hereto and incorporated herein b 18 reference. As set out in that report, KENNETH CALVIN GEHRING, 19 driving a 1985 GMC vehicle, was making a left turn from th 20 southbound #1 lane of the Pleasant Hill Road towards th 21 eastbound highway 24 on-ramp. The turning movement wa 22 prohibited by two (2) posted signs, one on each side of th 23 intersection. 24 Driver GEHRING in the course of making his left tur 25 collided with decedent LIEF P. RICHARDSON, who was proceedin 26 2 1 northbound on Pleasant Hill Road. 2 Discovery in connection with this fatal accident i 3 proceeding. The exact conditions of public property which cause 4 or contributedto the accident have not been fully determined 5 Claimants are in the process of having the intersection evaluate 6 by consultants and believe that such investigation shows 7 dangerous and confusing condition of public property that create 8 a substantial risk of injury when such property or adjacent 9 property was used in a manner which was reasonably foreseeable 10 Claimants will ask leave to revise and amend their claim as soo 11 as these facts are determined if the same is necessary. 12 I 5. Bachand, negligently cut down trees which had fallen into the creek, and negligently and carelessly failed to remove the stumps of said trees which settled to the bottom of the creek, which caused ponding, blocking and diversion of the creek, resulting in more damage to the plaintiffs' property. Claimant , Karen R. Bachand, is informed and believes that a sewer line was installed by the Contra Costa County Flood Control District at the rear of several properties which abut Wilkie Creek. Said sewer line was later abandoned by the District. At the time of the incident , said sewer line was filled with water which leaked into the landfill , causing a build-up of hydrostatic pressure and the resulting landslide . Plaintiffs are informed and be upon their 5 information and belief allege that defendants MORRIS STEINBERG 6 I and KATHY STEINBERG have at some unknown time been the owners i 7 in fee simple title of the real property located at 2606 8 Sheldon Drive, Contra Costa County, California and have 9 contributed to the hereinafter causes of action and are both i 10 negligent of, and responsible in some manner for, the events 11 and happenings herein referred to and negligently and 12. intentionally caused damages proximately to plaintiffs as 13 hereinafter alleged. 14 7. The above described properties of plaintiffs and 15 defendants adjoin each other at plaintiffs ' north boundary line 16 between which flows Wilkie Creek, part of a natural-. runoff and 17 drainage system for seasonal rains in the area. 18 8. Said creek channel runs through and across defendants ' 19 property from the east boundary to the west boundry thereof. 20 Prior to February 26, 1986 , rain waters flowed through such 21 channel while it was in its natural condition in a general 22 westerly direction. So long as the channel was in its natural �3 condition, such rain waters did not enter on plaintiffs ' 24 property or land lying to the south thereof except as it flowed 25 down said creek; the south side of which creek is on 26 plaintiffs ' property, and caused no damage to plaintiffs ' C^IIIIV M M-LLn 'AUCM �On 0.4.rOw1...•w.wOS Ii• -3- ,I I I property; including the bank which slopes down to the bed of 2 said creek. 3 9. That on or about February 25, 1986, and sometime prior thereto, a portion of said defendants ' property including 5 earth, rock, debris, trees , roots, stumps, retaining walls, 6 lumber and other portions that were located thereon slid and 7 fell into Wilkie Creek, blocking its natural course and causing 8 �1 it to pond and back up from said damming to a height of 9 approximately fourteen feet, causing the creek to be diverted 10 to and towards plaintiffs ' property, and when the creek receded 11 causing much of plaintiffs ' bank to be swept away and 12 plaintiffs ' retaining walls to be lost. 13 10. Defendants, in maintaining their property, have caused 14 the natural water course in said creek to become obstructed and 15 diverted from its natural watercourse onto plaintiffs ' land and 16 property. Defendants have failed and neglected and still fail 17 and neglect to remove dirt and debris, et al. , which has slid 18 and moved from their property to, toward and into said creek 19 and which is causing the he described damage to 20 plaintiffs ' said property. 21 11. That the above described properties of defendants 22 MORRIS STEINBERG, KATHY STEINBERG, SHARON CARLSEN, LORAN 23 CARLSEN and KATHY BACHAND adjoin each other and are 24 improved with dwelling houses and other improvements as well. 25 26 -4- `„'•...FSM Mi IL..VAUCry 1 . 12. Despite their 11-nowledge of the dangerous condition of 2 the aforementioned property, said defendants, and each of them, 3 have wrongfully refused to correct or repair the condition of 4 their property after said slide occurred and, have refused to 5 design or construct drainage systems or other water control for G said property or engage in a program that will effectively 7 restore flowing of the creek channel to its natural course and 8 to prevent future damage to plaintiffs ' property by said 9 diverted stream and its ponding against plaintiffs ' property. ]0 13 . Further, the current condition of defendants ' property 11 poses the continuing threat of future flooding by said diverted 12 stream and mudslides off of plaintiffs' properties to and 13 toward said creek. 14 FIRST CAUSE OF ACTION 15 Against defendants SHARON CARLSEN, LOREN CARLSEN, KATHY 16 STEINBERG, MORRIS STEINBERG and KAREN BACHAND, and DOES 1 to 17 10. 18 NEGLIGENCE 19 14 . As a direct and proximate result of the negligence, 3 carelessness and recklessness of defendants , and each of them, 4 a portion of said defendants property including earth, rock, 5 debris , trees , roots , stumps , retaining walls, lumber and other 6 , portions that were located thereon slid and fell into said I 7 IJ creek blocking its natural course and causing it to pond and 8 back up from said danuning; to divert the stream to and toward 9 1 1 plaintiffs ' property; and to suck and scour out plaintiffs ' 10 bank and grounds whenever the creek receded. 11 17. Following said sliding and damming of said creek said 12 defendants negligently and carelessly failed to take full steps 13 in the maintanence, management, and control of their properties 14 to remove said debris, et al. , from said creek and to restore 15 said creek to its normal and natural course and to prevent said 16 ponding or any ponding from occurring. 17 18 . During the period from February 25, 1986, to the 18 filing of this complaint, said defendants allowed and caused 19 the accumulation and impounding of waters on their premises 20 and in said creek adjoining the premises of plaintiffs ' in such 21 a careless and negligent manner as to cause said waters to 22 undermine the premises of said plaintiffs and at different 23 times when said creek receded large portions of plaintiffs' I 24 property including retaining walls adjacent to said ponded 25 � waters slid downward and into the creek; such encroachments 26 � � described above have caused damage to plaintiffs ' property as I previously set forth. 1 19. On. or about the 25th day of June, 1986 the said 2 defendants , their agents , employees and servants cut some of 3 their large trees down, which had fallen into the creek, but 4 have negligently and carelessly failed ,to remove the stumps of S said trees which said stumps have moved downward and have G settled to the bottom of the creek and have caused further 7 ponding and blocking of the creek and have caused more damage 8 to plaintiffs ' property. 9 20. That as a direct and proximate result of the 10 negligence and carelessness of said defendants and each of 11 them, plaintiffs ' property was damaged as previously set forth 12 and has resulted in the following losses to them: 13 (a) Damage to real property, including but not limited to 14 diminution in value; loss of use, income, rents; repair 15 expenses, additional living, moving and storage expense; 16 (b) Damage to personal property, including but not limited 17 to the use, income and repair expenses; 18 . (c) Expenses to prevent further damage from future 19 flooding, debris removal, repair of banks, et al. , and other 20 expenses not yet ascertained; 21 (d) Compensation for loss of time from employment and/or 22 loss of earning capacity; 23 (e) Emotional distress from the loss of personal and real 24 property and from the fear of further damage in the event of 25 future flooding or water damage from the creek. 26 V•11L LV N NILL&NAUGM 1 21 . As a further direct and proximate result of the 2 above-mentioned damage to plaintiffs ' property, plaintiffs have 3 been deprived and continue to be deprived of the complete use 4 and benefit thereof, all to the plaintiffs damage as 5 I . hereinabove alleged. 6f II SECOND CAUSE OF ACTION 7 Against defendants SHARON CARLSEN,LORAN CARLSON, KATHY 8 STEINBERG, MORRIS STEINBERG, KAREN BACHAND and DOES 1 to 10. 9 NUISANCE - EQUITABLE RELIEF 10 22. Plaintiffs refer to the allegations set forth in it Paragraphs 1 through 13 , inclusive, and Paragraphs 15 through 12 19, inclusive, and incorporate the same herein by reference as 13 though fully set forth. 14 23 . The aforementioned occupation, use, and maintenance of 15 the property of defendants constitutes a nuisance within the 16 meaning of Section 3479 of the Civil Code, in that it obstructs 17 and continues to obstruct plaintiffs ' comfortable enjoyment of 18 their real property and home and interferes with their use of 19 said property. 20 24 . As a proximate result of the nuisance created by the 21 defendants , and each of them, plaintiff has been, and will be, 22 ! damaged as set forth in Paragraphs 20 and 21 above. 23 25. Defendants , and each of them, have threatened to and 24 will, unless restrained by this court, continue to maintain 25 this nuisance and continue the acts complained of, and each and 26 'j every act has been, and will be, without the consent, against .HILLIP M MI.LSt•A J:.H �' -..o .. .1 .._ the will , and in violation of the rights of plaintiff. 1 26. On many occasions and prior to the filing of this 2 complaint, plaintiffs notified defendants of the waters being 3 ' directed on plaintiffs ' land from defendants ' property and the 4 resulting damage caused thereby, and demanded that defendant 5 remove the obstructions from the natural watercourse and 6 restore the same to its natural condition. Defendants have 7 I refused and still refuse to comply with such demands. i 8 27. Defendants ' obstructions of the watercourse 9 constitutes a nuisance and plaintiffs are thereby entitled to i 10 an injunction pursuant to Section 731 of the Code of Civil 11 Procedure to compel defendants to remove such obstructions and 12 to restore the creek to its natural course. 13 28. The maintenance by defendants of the aforedescribed 14 obstructions to the natural watercourse have obstructed 15 plaintiffs ' free use of their land and property so as to 16 interfere with their comfortable enjoyment of life- and property 17 and thus constitutes a nuisance. And as more particularly set 18 forth above in maintaining the nuisance, defendants , and each 19 of them, are acting with full knowledge of the consequences and 20 damage being caused to plaintiff, and their conduct is willful , 21 oppressive and malicious; accordingly, plaintiffs are entitled 22 to punitive damages against defendants , and each of them, in 23 the sum of $1, 000, 000. 00. 24 29. Plaintiffs refer to the allegations set forth in 7 Paragraphs 1 through 13 , inclusive, and Paragraphs 15 through 8 19, inclusive, and Paragraph 26 and incorporate the same herein 9 by reference as though fully set forth. 10 31 . Such movement of earth, rock, debris, trees, roots, I 11 stumps, retaining walls, lumber and other portions of 12 defendants real property and improvements thereon and on to i3 said creek and plaintiffs ' property, and the diversion of said ]4 waterway and its impoundment behind a dam or obstruction in 15 said creek, created and caused by the reckless and negligent 16 acts of defendants , and each of them, constitutes a trespass 17 upon plaintiffs' property. 18 32. As a proximate result of the trespass, plaintiffs 19 property has been damaged as set forth in Paragraphs 20 and 21 20 above. . Unless the trespass is abated, plaintiffs ' property 21 will - be progressively further diminished in value, further 22 damaged, and plaintiffs will suffer further losses. 23 33 . In maintaining the trespass , defendants, and each of 24 them, are acting with full knowledge of the consequences and 25 damage being caused to plaintiffs , and their conduct is 26 willful, oppressive and malicious; accordingly, plaintiffs are -10- 1 entitled to punitive damages against defendants, and each of 2 them, in the sum of $1 ,000,000.00. 3 FOURTH CAUSE OF ACTION 4 Against defendants FAP21ERS INSURANCE COMPANY, FARMERS 5 INSURANCE EXCHANGE, THE FARMERS INSURANCE GROUP OF COMPANIES, 6 DOE 1 and DOE2 dba TREE CARE. 7 NEGLIGENCE 8 34 . Plaintiffs refer to the allegations set forth in 9 Paragraphs 1 through 13, inclusive, and Paragraphs 15 through 10 19, inclusive, and incorporate the same herein by reference as 11 though fully set forth. 12 11 35. On or about the 25th day of June, 1986, said i3 . defendants, their agents , employees and servants, cut some 14 trees down which had fallen into the creek but have negligently 15 and carelessly failed to remove the stumps of said trees which 16 have moved downward and have settled to the bottom of the creek 17 and have caused further ponding, blocking and diversion of the 18 creek and is causing more damage to plaintiffs ' property as set 19 forth above. 20 36. On many occasions prior to the filing of this 21 complaint, plaintiffs notified said defendant insurance company 22 of the waters being diverted onto plaintiffs ' land from 23 defendants ' property and the resulting damage caused thereby, 24 and demanded that defendants remove the obstruction from the 25 natural watercourse and restore the same to its natural 26 condition. Said defendants have refused and still refuse to comply with such demands. II -21- 1 1 37 .
