Bragdon Gontra Director of Community Development Cosa DATE: August 12, 1987 WLM SUBJECT: Setting of Date to Accept Public Testimony on Proposed Ordinance -to Increase in Lieu Fees for Park Dedication in East County SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Accept request/report from the Community Development Department and set a hearing date of September 15, 1987 to receive any public comments on the proposed ordinance to increase in lieu fees to $885 per dwelling unit for East Contra Costa County as delineated by the East County Regional Planning Commission. FISCAL IMPACT Increased fees will enable the County to address park acquisition and development in a more timely manner. BACKGROUND/REASONS FOR RECOMMENDATIONS In September 1986, the Board authorized the use of park dedication fees in the amount of $18, 000 to hire a consultant to prepare a Parks Master Plan for the Oakley area. The plan was to include an implementation plan. In February 1987, the consultant recommended to the Oakley Municipal Advisory Council that the Park Dedication Fee be increased. The consultant recommended that the cost of development be included along with the cost of land in determining the fee. The Oakley Municipal Advisory Council (GMAC) asked Supervisor Torlakson to support efforts to raise the fee. The Community Development Department has reviewed the matter and with input from Counsel is recommending that the Park Dedication Ordinance be amended to increase the in-lieu fee from $400 to $855. This figure is determined by Census data. The standard required by State law is 3 acres per 1, 000 population or . 003 . If existing park land within the jurisdiction exceeds 3 acres a higher standard can be used. Value of Park Land -- This is a local determination and therefore is the key discretionary item in the formula. The value of one acre of developed park (minimum development) is $100,000 in East Contra Costa County. This is the sum of $50, 000 per acre land cost and $50, 000 per acre minimum development costs. The resulting calculations using the aforementioned formula are shown below: 2. 85 x . 003 = . 00855 acres of park per dwelling unit . 00855 x $100, 000 = $855 as the in-lieu fee. Park Dedication fees in the County vary substantially by jurisdiction. The range, depending on the type of development, is from $288 to $2, 500. In the East Contra Costa area the comparisons are as shown below. Antioch - $288 per single family dwelling, $682 per condominium unit, and $877 per apartment. The average is approximately $550. Brentwood - present in-lieu fee is $557 and an increase is planned. Pittsburg - the fair market value of each individual project is utilized. A property valued at $50, 000 per acre would pay a fee of $650 per unit and a property valued at $100, 000 would pay $1,300 per unit. In light of the above information, staff feels that an increase in the in-lieu fee is warranted.
