Adopted this Order on September 15, 1987 by the following vote:
AYES: Supervisors Powers, Fanden, Torlakson and Schroder
NOES: None
ABSENT: Supervisor McPeak
ABSTAIN: None
SUBJECT: Appeal of the City of Martinez from Approval with
Conditions of the Application for the Hidden Pond Project
Consisting of Final Development Plan 3008-87 and Tentative
Subdivision Map 6769, in the Martinez Area.
The Board of Supervisors on August 25, 1987, continued to this
date the hearing of the appeal by the City of Martinez (appellant)
from County Planning Commission approval with conditions of the
applications by Sycamore Construction Company (applicant) and Walter &
Huer (owners) for the Hidden Pond Project consisting of Final
Development Plan 3008-87 and Tentative Subdivision Map 6769 in the
Martinez area; and
Supervisor Fanden recommended a continuance of the hearing
because many of the issues and concerns discussed have not been
completely resolved and a delay would allow the developer to return
with revised plans and because of Mrs. McPeak' s absence today with a
great many concerns coming from the Pebble Beach area in her district.
David Gold, 1855 Olympic Boulevard, McCutcheon, Doyle, Brown and
Enerson, Walnut Creek, representing Sycamore Construction, commented
that in their opinion the Board has no jurisdiction to hear these
matters at this time and formally objected to the continuance.
After considering other items on the agenda, the Board again
returned to consideration of a continuance on the matter.
Karl Wandry, Community Development Department commented that
after discussing the matter with the applicant, the applicant felt
that he had made a somewhat strong statement about the continuance and
could accept the Board' s continuance without necessarily agreeing to
it.
David Gold commented that under Government Code Section 66452,
they felt the project has been deemed approved.
Victor Westman, County Counsel, commented that the County does
not entirely agree with that opinion .and view.
Supervisor Fanden commented that good communication with the
community and the City of Martinez was necessary during the discussion
of any revisions and suggestions.
On recommendation of Supervisor Fanden, IT IS BY THE BOARD
ORDERED that the hearing on the above matter is CONTINUED to October
6, 1987 at 3 : 00 p.m.
