Sec . 1245 . 230 ) -------------------------------- 6 7 The Board of Supervisors of Contra Costa County , California, 8 by vote of two-thirds or more of its members , RESOLVES that : 9 Pursuant to Government Code Section 25350 . 5 , and Streets and 10 Highway Code Section 943 , Contra Costa County intends to construct 11 a public improvement , namely , a road , and , in connection 12 therewith , to acquire interests in certain real property. 13 The property to be acquired consists of two ( 2 ) parcels and is 14 generally located in the Richmond area south of Parr Blvd. and 15 east of Garden Tract Road. The said property is more particularly 16 described in Appendix "A" , attached hereto and incorporated herein 17 by reference . 18 On July 7 , 1987 , this Board passed a Resolution of Intention 19 to adopt a Resolution of Necessity for the acquisition by eminent 20 domain of the property described in Appendix "A" (Resolution No. 21 87/408 ) and fixing August 4 , 1987 , at 10 : 30 a.m. in its Chambers 22 in the Administration Building , 651 Pine Street , Martinez , 23 California, as the time and place for the hearing thereon . 24 The hearing was held at that time and place , and all 25 interested parties were given an opportunity to be heard and based 26 upon the evidence presented to it , this Board finds , determines 27 and hereby declares the following: 28 1 . The public interest and necessity require the proposed RESOLUTION NO. 87/485 1 project ; and 2 2 . The proposed project is planned and located in the manner 3 which will be most compatible with the greatest public good and 4 the least private injury ; and 5 3 . The property described herein is necessary for the pro- 6 posed project ; and 7 4 . The offer required by Section 7267 . 2 of the Government 8 Code was made to the owner or owners of record. 9 The County Counsel of this County and any special counsel 10 associated by him is hereby AUTHORIZED and EMPOWERED: 11 To acquire in the County' s name , by condemnation , the titles , 12 easements and rights of way hereinafter described in Appendix A, 13 in and to said real property or interests therein , in accordance 14 with the provisions for eminent domain in the Code of Civil 15 Procedure and the Constitution of California: parcels One and Two 16 are to be acquired in fee title; 17 To prepare and prosecute in the County ' s name such proceedings 18 in the proper court as are necessary for such acquisition; and 19 To deposit the probable amount of compensation , based on an 20 appraisal , and to apply to said court for an order permitting the 21 County to take immediate possession and use said real property 22 for said public uses and purposes . 23 PASSED and ADOPTED on August 4, 1987 , by the following vote : 24 AYES : Supervisors Powers , Fanden, Schroder, Torlakson $ McPeak 25 NOES : None 26 ABSENT: None 27 ABSTAIN: None 28 -2- d 1 I HEREBY CERTIFY that the foregoing resolution was duly and 2 regularly introduced , passed and adopted by the vote of two-thirds 3 or more of the Board of Supervisors of Contra Costa County, 4 California , at a meeting of said Board on the date indicated. 5 Dated : August 4 , 1987 Phil Batchelor , Clerk of the 6 Board of Supervisors and County Administrator 7 8 By: -- ------------ Deputy 9 cc: Public Works Department , 10 Real Property Division Auditor-Controller 11 County Counsel (Certified Copy) County Administrator 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 -3- North Ridmnrd Bypass Road No. 0572E Right of Way � }�/ Caron Property AAPPF1 IX "A" A portion of that parcel of lard described in the deed to the Joseph and Betty Caxcne Family Trust recorded July 3, 1984 in Book 11866 at page 314 of Official Records of Contra Costa County, lying within Int 201, as shown on the map of the San Pablo Rancho, filed March 1, 1894, Records of Contra Costa County, California, described as follows: PARCEL ONE: Commencing at the Contra Costa Canty standard street mon nrnsit at the intersection of Parr Boulevard and North Richmond Bypass,. as said moraaaent is shown on the map entitled, "A Precise Section of the Streets and Highways Plan, Conga Costa County, North Ri.dumnd Bypass" recorded November 5, 1969 in Book 5998 at page 209 of Official Records of Contra Costa Canty, said monanent bears north lO 18' 47" east 784.78 feet from another standard street monument in North Richmond Bypass as shown on said map (5998 O.R. 209) ; thence furan said point of coawxjc nt south 10 18' 47" west 236.51 feet; thence leaving said monument line south 880 41' 13" east 55.31 feet to a point on the easterly riot of way line of said North Ridmmnd Bypass as shown on said map (5998 O.R. 209) , said point being the point of beginning; thence from said point of beginning leaving said easterly right of way line south 790 55' 39" east 25.00 feet to a point from which a radial line of a non-tangent curve concave to the southeast having a radius of 280.00 feet bears south 740 37' 33" east; thence northeasterly along said curve, through a central angle of 540 28' 2311, an arc distance of 266.21 feet to a point of cusp, on the southerly right of way line of Parr Boulevard as shown on said map (5998 O.R. 209) , which point shall hereinafter be referred to as Point "B" from which a radial line of a non-tangent curve concave to the southeast having a radius of 200.00 feet bears south 00 21' 30" east; thence southwesterly along said curve and southeasterly line of the said North Richmond Bypass (5998 O.R. 209) through a central angle of 850 07' 3511, an arc distance of 297.15 fest to the point of beginning. Containing an area of 7,122 square feet of land, more or less. PARCEL TWO Beginning at Point "X" as said point is described in Parcel One above, thence frtinn said point of beginning north 00 21' 30" west 43.90 feet to the southerly line of Parr Boulevard (30.00 feet in right of way width) ; thence along said lin south 880 56' 50" east 243.00 feet; thence leaving said line south 820 18' 27" west 185.36 feet; thence westerly along a tangent curve eve to the south having a radius of 280.00 feet, through a central angle of 120 27' 37", an arc distance of 60.89 feet to the point of beginning.
