MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: AUGUST 4, 1987 SUBJECT: ENSURE COMPLIANCE WITH CONDITIONS OF APPROVAL AND COMPLIANCE WITH GRADING PERMIT FOR PARCEL C OF MS 75-68 IN THE WEST PITTSBURG AREA. Specific Requests or Recommendation(s) & Background Justification I. RECOMMENDED ACTION: Direct the Director of the Community Development Department and the Director of Building Inspection to place a hold on all development permits and building permits on Parcel C of MS 75-68, Assessor's Parcel Number 098- 180-027. Direct the Director of the Building Inspection Department to issue a Notice to Comply for the grading permit on Parcel C of MS 75-68, Assessor ' Parcel No. 098-180-027. II. FINANCIAL IMPACT: None. III. REASONS FOR RECOMMENDATION/BACKGROUND: On May 12, 1987 this Board referred to the Public Works Director a letter dated May 1, 1987 from Mr. and Mrs. S.F. Woitt expressing concerns relating to grading on the property next to them, Parcel C of MS 75-68, and the resultant drainage problems. Mr. and Mrs. Woitt also expressed concerns relating to the requirements of MS 75-68. Mr. and Mrs. Woitt own Parcels B and C of MS 64-68 (Assessor's Parcel Nos. 098-180-029 and 098-180-030) located off of Driftwood Drive in West Pittsburg and is downstream and immediately north of Parcel C of MS 75- 68 (Assessor's Parcel No. 098-180-027). Both minor subdivisions were approved by the Board of Adjustment with conditions on June 5, 1968. One of the conditions of approval for MS 75-68 required construction of one-half of a proposed 32' road along the north property line of Parcel C and dedication of the necessary right of way. Each subdivision would then build one-half of the road to serve both Parcel C of MS 64-68 and Parcel C of MS 75-68. To this date the right of way has not been dedicated nor has the road been built. Both Parcel C of MS 75-68 and Parcel C of MS 64-68 are large and could be further subdivided. At the June 5, 1968 Board of Adjustment meeting, both subdivisions were approved with the understanding that the common road between the two subdivisions would be built with the development of Parcel C of MS 64-68 and Parcel C of MS 75-68. The Woitts are concerned that Parcel C of MS 75-68 will be developed without provisions for the proposed road along the property line. It is our recommendation that a hold be placed on all building permits or development permits on Parcel C of MS 75-68 to ensure that the proposed roadway will be constructed and the right of way -dedicated to provide appropriate access for both Parcel C of MS 75-68 and Parcel C of MS 64-68. On January 17, 1986 the Building Inspection Department issued a grading permit to place fill on Parcel C of MS 75-68 and to channelize the drainage along the natural swale through the property. The Building Inspection Department has reviewed the grading in the field and determined that there are several items of work that are not in accordance with the grading permit or the approved grading plan. Flood Control has also reviewed the grading and determined that the grading does not block the flow of the natural drainage in the area. It is our recommendation, with concurrence from the Building Inspection Department, that a NOTICE TO COMPLY for the grading permit be issued to the applicant to ensure that the grading on Parcel C of MS 75-68 is done in accordance with the grading permit and the County Ordinance Code.
