WINTER ISLAND FARMS (Applicant & Owner) County File 11975-RZ: Applicant requests to rezone land from Unrestricted District (U) to General Agricul- tural District (A-2) or any other appropriate district. Subject land is described as follows: A 566.07 + acre leveed delta island bounded by Middle Slough on the west, the San Joaquin River on the cast, the Sacramento River on the north and New York Slough on the south. II. GENERAL INFORMATION: A. Present Zoning: Unrestricted District (U) B. Requested Zoning: General Agricultural District A-2 or other appropriate district C. General Plan Designation: Major Open Space D. Present Land Use: Recreation E. Surrounding Land Use: Open Space F. E.I.R. Status: Negative Declaration III. DISCUSSION: A. General Plan: The General Plan designates the project site for open space land use. The current zoning is not in strict compliance with the General Plan since land within the Unrestricted District may be used for any lawful use. General Agricultural District A-2 zoning would be in compliance with the General Plan. B. Existing Land Use: Winter Island is flooded. The levees which surrounded the island have been breached. In the past, the island had been used for grazing cattle and raising pigs but these activities became impractical due to recurrent flooding. As a result the island is now used for recreational purposes, fishing and duck hunting. C. Previous Action: The original application, which was filed September 16, 1975,was to establish an agricultural preserve on the property. The request was approved by the Planning Commission on December 16, 1975. Due to ques- tions which subsequently arose regarding the extent of commercial agri- cultural production on the island and also whether property not used primarily for such purpose could qualify as an agriculturai preserve, the Board of Supervisors referred the application back to the Planning Commission on February 10, 1976 for reevaluation. I Winter Island farms -2- 1975--RZ 'nic application had not been pursued since referral from the Board of Supervisors because the owners of the property were able to obtain an adequate tax reduction in 1976 based on the fact that all but a small portion of the property was under water. Duc to the passage of AB 881 it is necessary to complete processing of this rezoning application this year. D. Conclusion- The property is not appropriate for agricultural preserve status and the Unrestricted District zoning does not comply with the General Plan. Since the General Plan designates the property for open space hind use it is recommended that the property be rezoned A-2, General Agricultural District. IV. RECOMENDATION: Adopt a resolution recommending that the Board of.Supervisors rezone the property in 1975-RZ from Unrestricted District (U) to General Agricultural District (A-2).
