The Board on September 11, 1979 having-fixed this time-'for
hearing on the appeal of Arnold & Doris Lund from Board of Appeals
conditional approval of Land Use Permit No. 2016-79 to establish a
rental (trailer) yard in a Retail Business District (R-B),
West Pittsburg area; and
Harvey Bragdon, Assistant Director of Planning, having
advised that Condition No. 4Dla requires construction of a 61 foot
concrete culvert under Willow Pass Road; and
Supervisor E. H. Hasseltine having inquired as to the
cost of same; and
Bill Gray, Assistant Public Works Director, having stated
that the cost of said construction would be approximately $3,000; and
Steven Neil Thomas, representing the appellant, having
stated that the Lunds would be willing to pay the $3,000 amount
provided the Public Works Department took responsibility for said
construction; and
Mr. Gray having concurred with same; and
Supervisor Hasseltine having recommended that the appeal
of Arnold & Doris Lund be granted in part by modifying Condition No.
4Dla to allow the applicant to pay the Public Works Department $3,000
for construction of the 61 foot concrete culvert under Willow Pass
Road and that Land Use Permit No. 2016-79 be approved subject to
conditions (Exhibit A attached hereto and by reference made a part
hereof);
IT IS BY THE BOARD ORDERED that the recommendation of'
Supervisor Hasseltine is APPROVED.

Conditions of Approval for Land Use Permit 2016-79: Page' I
This request is approved to establish a rental truck and trailer business in
a Retail Business Zoning District. Unless otherwise stated, all conditions
of. approval are to be complied with prior to occupancy of proposed building
and rental of any trailers or•trucks.
1. This permit is granted to Arnold and Doris Lund only,-and is not transferable,
for a period of three-years, at which time the, permit will have to be renewed.-
The permit however may be extended administratively for three additional years
with the review and approval fo the Zoning Administrator.
2. Development shall he as shoim on plans, submitted with the application, dated
by the Planning Department February 23, 1979, subject to final review and
approval by the County Zoning Administrator prior to the issuance. of a
permit to locate the trailer rental office building on the property and
subject to the conditions listed below:
A. Elevations and architectural design of buildings.and structures shall be
subject to final review and approval of the Zoning Administrator.
B. All signs shall be subject to review and approval by the Zoning
Administrator prior to installation.
C. Comply with landscape and irrigation requirements as-follows:
1. Within 30 days of the effective date of this permit, a landscape
and irrigation plan shall be submitted for review and approval by
the County Zoning Administrator. A cost estimate or copy of contract
for landscaping improvements shall be submitted with the plan. Land-
scaping and irrigation shall be installed prior to occupancy.
D. The entire yard area shall be enclosed by a decorative wood fence or
a -chain link fence with redwood slats and for landscaping. Such a
plan shall be submitted for the review and..approval of the Zoning
Administrator.
E. The entire yard area shall be surfaced to prevent the generation of
dust and ponding of water.
.F. Exterior lights shall be deflected so that the lamps con-tained
therein shine onto the applicant's property and not toward or onto
adjacent properties.
3. Comply with- the requirements of the Riverview Fire Protection District.
4. Comply with. the requirements of the Public Works Department follows:
A. This developrnent shall conform to the provisions of Division 1006,of the
Ordinance Code. This will include the following:
1. Convey'to the County, by Grant Deed, 12 feet of additional right of
way on Willow Pass Road as required for the planned future width of
84 feet as shown on Drawing PA5191-61, Sheet 3 of 5. 00Gir?1*._4

2. Construct curb, 10-foot sidewalk (%vidth measured from curb face),
necessary longitudinal drainage (including drainage inlets), and pave-
ment widening; on Willow Pass Road. The face of the curb shall be
located 10 feet from the widened right of way line. Said improve-
ments shall be constructed along the frontage of the property in
accordance with drawing E5181-67 on file with the Public Works
Department.
B. The above Grant Deed which must be executed by the owner/s before any
building; permit can be issued, will be. prepared by the Public Works
Department, Land Development Division.
C. This devviopment shall conform to the provisions of Title 8 and Division 914
of the Ordinance Code. Any exceptions therefrom must be specifically
listed in this conditional approval statement.
D. The following exceptions to Title 9 of the Contra Costa County Ordinance
Code are permitted for this subdivision:
1. Section 914-2.006 "Surface Water Flowing From Subdivisions" provided
the applicant deposits $3,000.00 with the Department of Public Works
for the:
a. Construction of 61+ feet of 15 foot concrete culvert under
Willow Pass Road as shown on Drawing E5181-67 and
b. Construction of 359+- feet of an adequate temporary ditch to
convey the waters to reach the natural waterway including an
adequate outfall structure.
E. Install all utility distribution services underground.
F. Submit improvernent plans to the Public Works Department, Land Develop-
merit Division for review; pay the inspection fee, plan review fee and
applicable_ fire hydrant fees. Overall curb grade plans are available at the .
Public Works Department for use by the applicant in the preparation of
specific improvement plans. The Improvement plans shall be submitted to
the .Public Works Department, Land Development Division prior to the
issuance of any Building Permit. The review of improvement plans and the
payment of all fees shall be completed prior to the clearance of any building
for Occupancy by tate Public Works Department. If occupancy is requested
prior to-construction of improvements, the applicant shall.execute a Road
Intprovenwnt Agreement with Contra Costa County and post the bonds
required by the Agreement to guarantee completion of the work.
G. Submit site grading, and drainage plans to the Public Works Department,
Land Development Division for review prior to the issuance of any building
permit or the construction of site improvements.
H. Prior to the issuance of any-fluilding Permit, furnish proof to Public Works.
Dc•partrnent, Land Development Division of the acquisition of all necessary
rights of entry, permits and/or easements for the eonstrubb 9fl-site,
temporary or permanent,drainage improvements. `
L An encroachment permit shall be obtained from the Public Works Depart-
ment, Land Development Division, for the driveway connection within the
rivht of wnv of kVill-l' Pass Road.

WHEREAS, on the 31st day of July, 1979 the Board of Appeals
approved with conditions the application of Arnold & Doris Lund
for Land Use Permit #2016-79 to establish a rental (trailer) yard
in an R-B Zoning District, with outside storage, West Pittsburg
area; and
WHEREAS within the time allowed by law, Arnold & Doris Lund
filed with this Board an appeal from certain conditions of said
conditions of approval;
NOW, THEREFORE, IT IS ORDERED that a hearing be held on

Arnold & Doris Lund, applicants /
WHEREAS, on February 23, 1979, the applicants ARNOLD & DORIS LUND,
filed an application to gain approval to establish a rental (trailer) yard in a Retail Business
District(R-B), with outside storage; and
WHEREAS, said application pertains to certain property described as fronting
103.28 feet on the south side of Willow Pass Road; 250 feet west of Manor Drive in the
West Pittsburg area (Parcel #97-061-001); and
WHEREAS, a Negative Declaration of Environmental Significance was posted
on this application on April 20, 1979; and
WHEREAS, after notice thereof having been lawfully given, a public hearing
was held by the County Zoning Administrator on May 7, 1979, whereat all persons
interested therein might appear and be heard; and
WHEREAS, The County Zoning Administrator APPROVED said application
with conditions on May 7, 1979; and
WHEREAS, on May 22, 1979, the applicant appealed Condition #4, D, 1.a, a
recommendation of Public Works Department, that the applicant construct 61+ feet of 15-
inch concrete culvert under Willow Pass Road; and
WHEREAS, the appeal was heard by the County Board of Appeals (full
Planning Commission), on Tuesday, June 12, 1979; and
WHEREAS, at the June 12, 1979, public hearing, the Board of Appeals
CLOSED the public hearing in order to view the site and surrounding area on field trip and
render a decision on Tuesday, July 31, 1979; and
WHEREAS, on July 20, 1979, the Board of Appeals viewed the subject site on
field trip; and
WHEREAS, on Tuesday, July 31, 1979, the Board of Appeals, at closed hearing,
DENIED the appeal of the applicant, upholding the decision of the County Zoning
Administrator requiring the installation of 61+ feet of 15-inch concrete pipe under Willow
Pass Road; and

NOW, THEREFORE, BE IT RESOLVED that the Board of Appeals recommends
to the Board of Supervisors that the appeal of ARNOLD & DORIS LUND #2016-79, be
DENIED in that approval would be detrimental to the health, safety and general welfare
of the county, the orderly development on land in the county, the preservation of
property values, the effect upon the neighborhood, the effect upon the County General
Plan and the special conditions applicable to the instant case; and
BE IT FURTHER RESOLVED that the following conditions are recommended
to your Board of imposition on this permit(see attached conditions).
The foregoing order was given by vote of the County Planning Commission on
Tuesday, July 31, 1979, in a regular meeting, as follows:

I. INTRODUCTION:
This is an appeal of Condition 4, D, l.a. of the Zoning Administrator
approval of a request to establish a rental trailer yard with outside
storage in a Retail Business District. The subject property is located
on the south side of Willow Pass Road approximately 250' west of Manor
Drive in the West Pittsburg area.
II. DISCUSSION:
The staff report prepared for the Zoning Administrator meeting and the
appeal letter are attached. Condition of approval 4, D, 1.a. is a condition
recommended by the Public Works Department. It states that the applicants
shall construct 61+ feet of 15-inch concrete culvert under Willow Pass Road.
III. RECOMMENDATION:
Deny the appeal of condition of approval 4, D, l.a. as per the recommendation
of the Public Works Department.

Ladies and Gen&lmen,
We take pen in h-ind this day in hopes of brirq*Lng a problem to rest.
We understand that "the Buck"stops here with you folks.
We are the Lunds, Arnold and Doris. When we first moved to the Concord
Area, it was hoped that we could live and work as a family unit. We
moved to the outskirts of town along a winding and narrow road called
Monument Blvd, near Four Corners. There sure wasn't much bwsiness
then, but, we felt we had a chance to make it. Just a gas station,
Drugstore, and an old- wooden-floored Market was what made up 4 Corners. .
Well, anyway, we did make it. We all worked together living in a junky
old house and renting out, utiliy trailers for less then the Big Boys
charged. As time went by our business got better and we bought our
own home on Garnet Lane.
The lady we rented the Trailer Yard from didn't want to sell so we
leased it again and again for more and more money. Even Prop 13
didn't help as she doubled the rent. So we again looked for a place
on the outskirts of civilization for a spot to set up business, only
this time we borrowed against our home and bought the land and applied
for a use permit. The land was already zoned commercial so it looked
. Like a good bet.
However, right off the bat we sta4 d to have trouble. It seem5a6=the
fellow we first talked to at the Manning Dept said we needed $700.00
to make an application. When we went back with the Certified Check
for $700.00 the gentleman we talked to said "oh No" you need only a
Certified Check for $500.00. So we went back to the bank and got
the Certified Check for $500.00. They must think we were the
Rockafellows or the B of A because every timed we make a move or
comment we had to come .up with more money. The last time it cost us
$100.00 just to be put on the caldnde'r and this time it's $75.00.
Must be a lot of work to get our name on the Callinder.
Someone in the Planning Department must think we will be a carwash
or something because they keep talking about water run off from our
103' frontage on Willow Pass Road.
Currently there is NO curb or gutters to provide the proper meeting
of the property to the roadway and what with all the remodeling of
the Ambrose School next door, the Big Trucks taking a shortcut across
the front of our propefzty have made a well worn path that serves to
collect water on a Dry Day: : When the man from the planning department
took pictures, he managed� o show a body of water in front of our lot
and no place else! Not a drop was in the stAet or along the curb.

None the less, wb were granted a use permit that had attached to it
-some stringent conditions. One of these conditions we appealed and
were denied. We are once again appealing it to yourselves/
We don't mind providing for drainage for ourselves and we do not mind
donating a portion of our land for the road wiling and we don't even
mind being good neighbors and helping others. But we are adamehtly
against taking on the whole task by ourselves.
We then respectfully take this opportunity to bring to your attentions
the following facts and existing conditions;
1 Bruno's Market is our imm4diate "upstream" neighbor. Their property
is many times the size of ours and provides NO solution to the
enormous amout of run-off from their Bard, asphalt surfaced parking
lot other than to allow the water to go to the street in front of
our property.
2. The Shell gas station and the Shell property across the street provide
NO solution to their run-off from their surfaced parking lot other
than to divert it into the street and in front of our property.
3. All of the properties on Manor Drive next to Bruho's Market afford
us the same courtecies.
4. The Ambrose Park. District is not being required to afford better
drainage despite the fact that when their project is conplet4d, they
too will have- hard surfaced parking larger than our propertyand
shall be diverting the runoff to the steeet.
We propose to accept all of our own ruri-off by providing the proper
grading. We will Not be surfacing all of our property with a Non-
pourous asphalt but will inst6ad be using gravel so as to accomplish
our own drainage. Accompany this with the reverse grading and proper
retention of our run-off water and we have solved the problem of run-
off except for the driveway and forward areas.
We further propose that we join with our neighbors at the proper time
so that we all share in the benefits and burdens providing a better
place to live and work in Contra Costa County.

Dear Sir:
This letter is I,o inform you that on Tuesday, July 31, 1979, the Board of
Appeals (full Planning Coam ission), reviewed at closed public hearing your
appeal of Condition /„ D, l.a., which states:
The applicant shall construct 61+ feet of 15-inch concrete culvert under
1'dillow Pass Road.
The Board of Appeals denied your appeal of that condition.
Ordinance Code Section 26-2.22,06 states that an aggrieved party may appeal
a decision of the County Board of Appeals to the Board of Supervisors for a
public hearing and determination by that body.
An appeal of the Board of Appeal's decision requires a vrritten notice stating
YOUR reasons for the appeal accompanied by an appeal fee of ?75.00.
An appeal and fee must be received by the Planning Department Office within
fifteen (15) calendar days from the date of the Board's action---in this in-
stance by 5:00 P.M., Wednesday, August.15, 1979.
If no appeal is received Yrithin that date and time, the action of the Board
of Appeals will become final and the conditions imposed by the County Zoning'
Administrator will be in effect.
