PRESENT ZONING: Single Family Residential R-40 B. PROPOSED ZONING: Single Family Residential R-20 C. GENERAL PLAN DESIGNATION: 1977 San Ramon Valley Area General Plan designation of Single Family Residential - Country Estate D. PRESENT LAND USE: Vacant large lot Single Family Residential E. PROPOSED LAND USE: Three building sites for large lot Single Family Residential F. SURROUNDING LAND USE: Large lot Single Family Residential - the area to the east and north is currently zoned R-20, and has similar topography to lots A and B of the proposed subdivision. G. EIR STATUS: Negative Declaration of Environmental Significance posted November 7, 1978. III . DISCUSSION A. Nature of the Request This application is a request to rezone a 1 .84 acre parcel from R-20 to R-40. The subject parcel is located within an area designated as Country Estate by the 1977 San Ramon Valley Area Gencral Plan. A staff report requesting to anmend the County General Plan lead to a determination by the San Ramon Valley Area Planning Commission that a General Plan Amendment was not necessary to allow the continued processing at this rezoning request and Minor Subdivision 318-77. (See attached Staff Report) B. The subject property is the southern limit of land along Castle Hill Ranch Road that is developable at the half acre standards. E. Conclusion The decision on this rezoning request and the pending minor sub- division request will not provide a precedent for subsequent application. The area north of the subject property has been developed or committed to be developed, to virtually the extent of its capabilities for the foresee future. The area to the west of the subject property has its character of development establish by topographic limitations, access limitations, and previous development decisions. California Boulevard, Walnut Creek, CA, representing the owners, stated in light of staff's recommendations, he had no comment. There were no objectors present. It was found that the requested rezoning is consistent with adjacent property and would not have an adverse impact on the surrounding area. The proposed R-20 zoning is consistent with the size of other parcels in the area. Although allowable minimum parcel size under the current General Plan is 40,000 square feet the proposed rezoning appears to comply based on 1) Policy 5 found in "Interpretive Policies on General Plan Development Compliance" which was adopted by the County Planning Commission in January 1974, and 2) the physical characteristics of the subject property and the nature of surrounding development. Policy 5 states that zoning is a means to implement the General Plan and is subordinate to the General Plan except in specific instances where reasonableness or circumstances dictate otherwise. The topography of the project site is well suited for the proposed intensity of use compared to other similarly developed properties in the area. A segment of the creek would be. placed underground in pipe to provide access to the uppermost parcel, but the creek is culverted at several other locations and has no natural vegetation of significance along; its banks.
