The Contra Costa County Board of Supervisors ordains as follows:
SECTION I. Page M-14,15 N-14,15 of the County's 1978 Zoning Map (Ord. No. 78-
93)is amended by re-zoning the land in the above area shown on the map(s)attached
hereto and incorporated herein (see also County Planning Department File No.
7293-RZ )
FROM: Land Use District A-2 ( GENERAL AGRICULTURE DISTRICT )
TO: Land Use District R-40 ( SINGLE FANIILY RESIDENTIAL DISTRICT )
and the Planning Director shall change the Zoning Map accordingly, pursuant to
Ordinance Code Sec. 84-2.003.

RESOLUTION OF THE PLANNING COMMISSION OF THE COUNTY OF CONTRA COSTA, STATE OF CALIF-
ORNIA, INCORPORATING FINDINGS AND RECOMMENDATIONS ON THE REQUESTED CHANGE IN ZONING
BY F. P. BELLECCI (APPLICANT), PHILLIP L. LUCKING (OWNER), (2283-RZ), IN THE ORDINANCE
CODE SECTION PERTAINING TO THE PRECISE ZONING FOR THE WALNUT CREEK AREA OF SAID COUNTY.

WHEREAS, a request by F. P. BELLECCI (Applicant), PHILLIP L. LUCKING (Owner),
(2283-RZ), to rezone land in the Walnut Creek area from General Agricultural District
(A-2) to Single Family Residential District (R-40), was received by the Planning
Department Office on June 30, 1978; and
WHEREAS, a Negative Declaration of Environmental Significance was posted on
this application on October 24, 1978; and
WHEREAS, after notice thereof having been lawfully given, a public hearing
was held by the County Planning Commission on Tuesday, December 19, 1978, whereat
all persons interested therein might appear and be heard; and
WHEREAS, the Planning Commission having fully reviewed, considered and evaluated
all the testimony and evidence submitted in this matter; and
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends to the
Board of Supervisors of the County of Contra Costa, that the rezoning request of F. P.
BELLECCI (Applicant), PHILLIP L. LUCKING (Owner), (2283-RZ), be APPROVED as to the
change from General Agricultural District (A-2) to Single Family Residential District
(R-40) and that this zoning change be made as is indicated on the findings map entitled:
A PORTION OF CONCORD DIVISION, SECTOR 6 AND THE DISTRICTS MAP FOR THE SOUTH YGNACIO
VALLEY AREA, INSERT MAP NO. 39, CONTRA COSTA COUNTY, CALIFORNIA, which is attached
hereto and made a part hereof; and
BE IT FURTHER RESOLVED that the reason for this recommendation is as follows:
(1) The requested change in Zoning from A-2 to R-40, conforms with the General Plan
for this area.
BE IT FURTHER RESOLVED that the Chairman and Secretary of this Planning
Commission shall sign and attest the certified copy of this resolution and deliver
the same to the Board of Supervisors all in accordance with the Government Code of
the State of California.
The instruction by the Planning Commission to prepare this resolution was
given by motion of the Planning Commission on Tuesday, December 19, 1978, by the

#2283-RZ: The applicant requests to rezone 6.27 acres from General Agricul-
tural District (A-2) to Single Family Residential District (R-40). Subject
property is located on the west side of La Casa Via, approximately 3,000 feet
south of Ygnacio Valley Road, opposite Arbol Via, in the Walnut Creek area.

The project will not have a significant effect on the environment. The project
has no substantial adverse environmental impacts. Any environmental concerns
can be considered with the rezoning and subdivision review process. Proposed
subdivision conforms with the General Plan.
It is determined from initial study by Byron Turner of the
®Planning Department that this project does not have a significant
effect on the environment.

I. INTRODUCTION

A request to rezone 6.27 acres from Gcncral Agriculture District (A-2) to
Single Family Residential District (R-40) and to subdivide into 6 lots with a
variance to have 2 lots less than 40,000 square feet. Ilia property is located
on the west side of La Casa Via, approximately 3,000 feet south of. Ygttacio
Valley Road, in the Walnut Creek area. (CT 3430) (Parcel #140- 220-006, 007)
II. GENERAL INFOMITION AND BACKGROUND
A. EXISTING ZONING: General Agriculture A-2
B. PROPOSED ZONING: Single Family Residential R-40
C. GENERAL PLAN DESIGNATION: Country !:state and Open Space.
D. PRESENT LAND USE: Vacant - some trees at road frontage.
E. PROPOSED LAND USE: Six Single Family Residential per proposed Subdivision 5408
F. EIR STATUS: Negative Declarations of Environmental Significance were posted
for these applications.
The Rezoning and Subdivision applications were filed June 30, 1973. A revised
tentative map to conform with the general plan was submitted September 18. 1978,
together with a modified rezoning application for R-40 .ittste-ad of 14-20 originally
requested.
III. SITE DL•SCRIPTION AND DEVELOMIENT
Ilse property is a low sloping site of about 6 percent gradient on the front 500
feet, and rising more steeply on the rear or westerly 300 feet with a slope of
approximatoly 30 percent. There are existing pine trees along La Casa Via and a
shallow drainage swalc across tate front of tite property.
Six residential lots are proposed with two lots at the steeper western portion
in excess of 54,000 sq. ft. and two lots at the more level portion having less
than the required area, providing for :n average int s.iae for the project of
42,625 sq. ft. •fh.is is conl'orming to the l:it.y of 14alnut Creek Plan for the
area allowing den§ity transfer. 'rite residential structures are proposed to be
designed to the conditions of the individual lots. No lot grading is proposed
with the tentative map.
La Casa Via is a 50-Foot wide private, non-County-artint;,invJ roallway. The
planned future width of a 40-foot paved section in a t+U-t, , t 1-11j,t of way

Park and Recreation Service Area 3 has pro11osed a hike hath along; La Casa
Via, A portion of the paved area can be utilized for this purpose when the
bike path is established through the area.

of discharge downstream.
IV. PLANNING
The South Ygnacio Valley - Walnut Creek Area General Plan Amendment shows the
area of the site for single family residential very low density with the
steeper portion of the site for open space. On April 20, 1077, the Board of
Supervisors adopted a specific plan in the vicinity of the property identified
as Specific Plan No. 3, La Casa Via which corresponds to a specific 111,111 adopted
by the City of Walnut (.reek, The purpose of the Plan is to preserve the scenic
Mid natural features of Shell Ridge to about the 300 foot. contour. A sm;ill
portion of Shell Ridge extends through the site. No structures such as homes,
barns, swimming pools, orgaragt-' are to be constructed within the preserve arca,
and substantial grading; is to be avoided.
A portion of a riding and hiking trail across the northwest corner of the site,
which extends along the Shell Ridge Open Space area should he dedicated to the
Gast Bay Regional Park District.
The two lots of the project are partially within a proposed scenic preserve
and have additional lot area which provide for residences on these lots to be
constructed outside the preserve area. A scenic easement .if applied, would
restrict any construction at the ridge area. The rezoning Of rbc property
to single family residential It-40 and the tentative map for six lots, is coll-
sistent'with the general plan.
V. RGCOPIAIGNDATION ;
Adopt a resolution reconunending to the [bard of Supervisors that the land .in
2283-IZZ be rezoned from General Agriculture District (A-2) to Singly Family
Residential District (R-40) .
Staff recommends that the tentative map for Subdivision 5.108 be approved with
conditions.

9. A scenic casement on Lots 3 and 4 shall be dodicated to the County with the
Final Subdivision (,lap extending between the westerly boundaiT, easterly to approx.
imately 300 foot elevation. 'Frees shall be planted along the easterly boundary
of the scenic easement subject to approval by the Planning Department prior to
issuance of building permits on Lots 3 and 4.
