SUBJECT: Housing and Urban Development Department Litigation
Victor J. Westman, County Counsel, transmitted to the
Board the attached report, dated August 13 , 1987, relating to
litigation which seeks to prevent the Federal Housing and Urban
Development Department from selling housing covered by Federal low
income housing regulations.
IT IS BY THE BOARD ORDERED that receipt of the attached
report is ACKNOWLEDGED.

Re: Walker v. Pierce, USDC No . C-87-2628 RFP
This responds to the Board ' s July 21, 1987 , directing that
County Counsel report on the mentioned litigation which seeks to
prevent the Federal Housing and Urban Development Department
from selling housing covered by federal low income housing
regulations .
On July 16, 1987, the District Court granted a preliminary
injunction restraining the sales in question. The federal
government has 60 days within which to appeal the District Court' s
order . If the case is not appealed, it is expected that it will
be tried on cross-motions for summary judgment.
This office has contacted counsel for the plaintiffs and we
are awaiting their reply to our offer of help.
