Kerr, Deputy County Counsel Costa DATE: August 10, 1987 1 @ CO^ SUBJECT: Appeal of Lloyd Wilson from Social Service Department Evidentiary Hearing Decision SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Deny the appeal of Lloyd Wilson to the Board of Supervisors from the administrative decision of the Appeals and Complaints Division of the Social Service Department. BACKGROUND: Lloyd Wilson was notified on October 3, 1986 that his General Assistance would be discontinued and he would have a one month period of ineligibility because he failed to keep a Work Programs appointment. On December 23, 1986, an evidentiary hearing was conducted. On March 12, 1987, the evidentiary hearing decision was issued, concluding that General Assistance had been correctly discontinued, but that the period of ineligibility was incorrectly imposed because Mr . Wilson' s failure to meet employment regulations was not willful. Mr. Wilson appealed the evidentiary hearing decision. On May 5 , 1987, the Board of Supervisors referred the matter to County Counsel for a review and report. Mr . Wilson did not appear at the appeals hearing before the Board on May 5, 1987 . The County Counsel has advised that the discontinuance of General Assistance to Mr. Wilson was lawful.
