SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position of support for SB 1623 by Senator David Roberti
which would increase to a felony a conviction of any of a number
of crimes involving using dogs for fighting purposes.
BACKGROUND:
On June 2, 1987, at the request of Supervisor Fanden, the Board
of Supervisors referred to the County Administrator SB 1623 .
Under current law, a person who does any of the following is
punishable by imprisonment in the county jail for not to exceed
one year, or by a fine not to exceed $50, 000, or by both a fine
and imprisonment:
1. . Owns or trains a dog with the intent that the dog
will be engaged in an exhibition of fighting with
another dog;
2 . Causes any dog to fight with another dog for amusement
or gain;
3 . Allows any of the acts identified above to be done on
his or her premises or aids or abets such an act.
SB 1623 elevates each of these acts to a felony and prescribes
that they shall be punished by imprisonment in State prison for
16 months, 2 or 3 years, or by a fine not to exceed $50,000, or
by both a fine and imprisonment.
To the extent that such an increased penalty, including the fact
of a conviction of a felony, .discourages persons from committing
such crimes, SB' 1623 is consistent with the position being taken
by the Board to impose more severe penalties on irresponsible dog
owners and it, therefore, deserves the support of the Board.
Both the District Attorney and the Animal Services Director have
indicated their 'support for SB. 1623 . //
