SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AAD JUSTIFICATION
RECOMMENDATION•
Adopt a position of support for AB 100 by Assemblyman Elder which
provides grants to provide training programs in the enforcement
of the hazardous materials laws for peace officers, local public
health officers, and public prosecutors, and to enhance local
hazardous materials enforcement efforts.
BACKGROUND:
Assemblyman Elder has introduced AB 100 in order to provide
funding to improve the training of local officials who must
prosecute violations of hazardous materials law. As District
Attorney Gary 'Yancey has noted: "There are few areas of the law
as complex as toxics enforcement. Statutes are ever changing and
new laws are being passed with an astonishing frequency" .
AB 100 provides for several types of training:
1 . Instruction of local and State peace officers in the
detection of violations and in the apprehension of
suspected violators of State and local hazardous
materials laws.
2 . Instruction of district attorneys, city attorneys, and
the Attorney General in the enforcement of State and
local hazardous materials laws.
3 . Instruction of local public health officers in the
enforcement of the hazardous materials laws.
In addition, AB 100 provides funds for at least three one-year
projects which would each fund one attorney and one special
hazardous materials investigator who would be responsible for
improving methods to prevent violations of hazardous materials
laws and improve the prosecution of those violations that occur.

AB 100 is entirely consistent with the emphasis placed by the
Board of Supervisors on preventing violations of hazardous
materials laws and on swiftly prosecuting those violations that
occur. It is, therefore, recommended that the Board of
Supervisors go on record in support of AB 100. Both District
Attorney Yancey and Environmental Health Director Dan Bergman
recommend that the Board support AB 100.
