THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on August 11 , 1987 by the following vote:
AYES: Supervisors Fanden, Schroder, McPeak
NOES: None
ABSENT: Supervisors Powers and Torlakson
ABSTAIN: None
SUBJECT: Rezoning application 2707-RZ, Development Plan 3006-87 and
Subdivision 6881, Tara Hills/Pinole area
This being the time noticed for hearing on the
recommendation of the County Planning Commission with respect to
rezoning application 2707-RZ filed by Davidson, Kavanagh, and Brezzo
Development Company/Bridge Housing Corporation (applicants) and
Richmond Unified School District (owners) , Development Plan 3006-87
and Subdivision 6881, in the Tara Hills/Pinole area; and
Supervisor Sunne McPeak, as Chair, announced that Supervisor
Tom Powers would not be participating in the consideration of this
matter because of a conflict of interest.
Supervisor McPeak further advised that she wished to make
public the fact that she is a member of the Board of Directors of
Bridge Housing Corporation; but that on advice of County Counsel that
because she is a non-salaried member of the Board of Directors of
Bridge Housing Corporation which is a non-profit corporation with tax
exempt status and there is no provision of compensation for directors,
and the corporation has no stock or stockholders and there is no
opportunity to benefit financially, that her participation in this
matter would not violate the provisions of the Government Code nor the
Fair Political Practices act, and she would therefore proceed with the
hearing and be a party to taking testimony.
Mary Flemming of the Community Development Department
described the property site and reviewed the project and the Planning
Commission and staff recommendations. Ms. Flemming advised that the
County Planning Commission found that the Negative Declaration of
Environmental Significance, Notice of preparation and Response to
Comments constitute an adequate environmental review and that it was
completed in compliance with the California Environmental Quality Act,
with State Guidelines and County Processing Procedures.
Jim Kennedy of the Community Development Department staff
explained the provisions for the density bonus program and how it was
applied to this application.
Supervisor Fanden expressed her concern that the Planning
Commission conditions do not contain provision for child care and TSM
and do not provide for the proposed increased park dedication fee.
She also asked for information on the possibility of extending
provision for recycling to include the single family homes as well as
the condominium units.
Supervisor Fanden noted that the City of Pinole has
requested a delay in the Board' s hearing on this matter. She
requested that before any continued hearing, that staff provide the
Board members with a report on the concerns she had enumerated above
and that said report be made available to the general public upon
request.

Supervisor Fanden further requested that Condition 33 be
modified to provide reporting to the Board of Supervisors as well as
to the Zoning Administrator.
The Chair declared the public hearing open and the following
persons appeared:
John Brezzo, the applicant, reviewed the proposed project
and responded to questions from Board members.
Don Turner, Bridge Housing Corporation, discussed the
density bonus percentages and the contract provisions for enforcement.
Reverend Lee Gregory, Tara Hills Alliance Church, 2448 Mahan
Way, San Pablo.
Leona Hermansader, 2459 Shamrock Drive, San Pablo, a member
of the County Service Area M-17 Citizens Advisory Committee.
Richard Knoblauch, 2636 Rim Road, San Pablo.
James Ryan, 2447 O'Hatch Drive, San Pablo, requested that no
two-story building be allowed to shade his solar heating system, and
expressed concern that there may be a gas pipeline running through the
proposed project.
Dave Doswell, City Planner, of the City of Pinole submitted
a letter outlining the Cities concerns and requesting the hearing be
continued and extended an invitation to the County Staff and developer
to met to try to resolve those concerns.
Tom Cook, Bay Area Council, 847 Sansome Street, San
Francisco urged approval.
Good cause appearing therefore, IT IS BY THE BOARD ORDERED
THAT this hearing is continued to August 18, 1987 at 3 : 00 p.m. , and
staff is DIRECTED to provide responses to the concerns raised by
Supervisor Fanden prior to that time.
