Bragdon Cwt a Director of Community Development Costa ' DATE: June 25, 1987 COU* SUBJECT: Report on Appointment of a Local Assessment Committee for these proposed Erickson Enterprises Hazardous Waste Transfer Station SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION 1. Accept the report that AB 2948 requires the Board of Supervisors to appoint a seven member Local Assessment Committee whenever a hazardous waste facility project is proposed. 2. Authorize Supervisor Powers to make recommendations to the Board of Supervisors for the Local Assessment Committee. 3 . Acknowledge that the Board of Supervisors may make appointments to the Local Assessment Committee on July 14, 1987 . FINANCIAL IMPACT The cost of notification for the public meeting will be paid by a fee charged to the applicant. The applicant will also pay a fee to the Office of Permit Assistance, which will make technical grants to local committees to cover the cost of hiring an independent consultant to assist in reviewing the project and negotiating terms and conditions with the applicant. The cost of staff resources to assist the Assessment Committee will be paid by application fees for Land Use Entitlements. REASONS FOR RECOMMENDATION/BACKGROUND AB 2948 (Chapter 1504, September, 1986) requires the Board of Supervisors appoint an assessment Committee for each hazardous waste facility proposal. Under this law, the Committee will: A. Negotiate with the applicant on the terms, provisions and conditions for project approval which would protect health, safety and welfare, and the environment of the County and would promote the fiscal welfare of the County through special benefits and compensation. In negotiation with the project applicant, generally represent the interests of County residents and adjacent communities. C. Receive and expend technical assistant grants made by the Office of Permit Assistance. D. Advise the Board of Supervisors of the terms, provisions and conditions for project approval which have been agreed upon by the Committee and the applicant. The Board of Supervisors may use these recommendations for its independent consideration of the project. AB 2948 requires that the membership of the Committee reflect the makeup of the community and include three representatives of the community at large, two representatives of environmental or public interest groups and two representatives from affected businesses and industries. To coordinate the Assessment Committee with other related programs, one appointee should be a member of the Hazardous Materials Commission and at least three appointees should be members of the Redevelopment' s Project Area Development Committee. Since the proposed project is located in North Richmond, applicants should be sent to, and recommendations made from Supervisor Powers. AB 2948 requires that the Board of Supervisors appoint a Local Assessment Committee by August 12, 1987. Supervisor Powers may be making recommendations for these appointments on July 14, 1987 .
