June 23, 1987 SUBJECT: APPROVING AND RECOMMENDING EXECUTION OF THE FIRST AMENDMENT TO THE ARCHITECTURAL SERVICES AGREEMENT FOR SHERIFF PATROL AND INVESTIGATION BUILDING (0119-4214; 0928-WH214D) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDATION APPROVE the First Amendment to the Architectural Services Agreement, dated May 20, 1986, between the Contra Costa County Public Facilities Corporation and Interactive Resources, Inc. , Point Richmond, for the Sheriff Patrol and Investigation Building, formerly known as the Sheriff Patrol, Investigation, and Communications Administration Building, and RECOMMEND that the corporation sign the Amendment. The First Amendment changes the Agreement as follows: A. Raises the Fixed Limit of Initial Construction Contract Cost by $480, 000 to reflect increases in the scope of the work. B. Changes the location of the project site. C. Provides for payment to the Architect for services performed with the building on the original site. D. Changes the name of the building from "Sheriff Patrol, Investigation, and Communications Administration Building" to- "Sheriff Patrol and Investigation Building" , to reflect the deletion of the Communications Administration function from the project. II. FINANCIAL IMPACT: A. Amending the Fixed Limit of Initial 'Construction Contract Cost from $1,900,000 to $2,380,000 will increase the Architect' s fee from $145, 540 to $182,308, for a $36,768 increase. B. Before the project site was relocated, the Architect completed services through 500 of the Design Development Phase. Consequently, he had earned $39,196. 22 for services on an abandoned design for the original site. CONTINUED ON ATTACHMENT:. The construction fund established under the Trust Agreement with the Contra Costa County Public Facilities Corporation, dated August 1, 1986, providing for the delivery of the 1986 Certificates of Participation for Equipment Acquisitions Program and . Capital Project VI (Sheriff ' s Building) , is sufficient to cover this Amendment, together with any other anticipated amendments or changes. III. REASONS FOR RECOM4ENDATIONS/BACKGROUND: A. Changes made in the scope of the project after the Architectural Services Agreement was signed were requested by the County to satisfy the needs of the Sheriff. Consequently, the Fixed Limit of Initial Construction Contract Cost should be increased to reflect those changes. The Architect' s fee is based on a percentage of the Fixed Limit of Initial Construction Contract Cost, consequently the fee is also increased. B. The original project location was a site near 50 Glacier Drive, Martinez. The Architect began his services to design a building for this specific site. After the Architect had completed services through 500 of the Design Development Phase, the County Administrator decided to change the location of the building to a different site, near 255 Glacier Drive, Martinez. This decision was made to reserve the maximum practical space near 50 Glacier Drive for expansion of adjacent childrens ' facilities. The need for such expansion was not known when the Sheriff Patrol, Investigation, and Communications Administration Building project was established. The change in site requires the Architect to abandon his design and start over again, as the constraints imposed on the building by the new, sloping site are completely different. Therefore it is necessary to pay the Architect for the services completed on the original building design, in addition to the services he will perform for the new design on the new site. C. The Sheriff ' s Department requested that the Communications Administration function be removed from this project and housed in an addition to the new Communications Building being built adjacent to 50 Glacier Drive. Before the project site was changed, Communications Administration functions were located in that part of the Sheriff ' s Patrol and Investigation building closest to the new Communications Building. 25022B06. 24B GC:RDH:pg Page 2 of 2
