SUBJECT: BOARD REFERRAL OF 05-19-87 ON LOWER TOWING
FEES AND ABANDONED VEHICLE LEGISLATION
SPECIFIC REQUEST(S) OR RECOMMENDATION(_S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Accept this report on Board referral of 05-19-87 on the issue of lower fees
for towing services and status of legislation regarding abandoned vehicles.
FINANCIAL IMPACT: None.
BACKGROUND:
On May 19, the Board accepted a report on the Abandoned Vehicle Abatement
Program and approved contracts with two towing companies for removal of
abandoned vehicles identified by county staff. During the discussion on
the program, a question was raised concerning whether the $30 to be paid
for each abandoned vehicle removed was appropriate. The city of Brentwood
was identified as having a similar agreement for removal of abandoned
vehicles but paid less for the services. Upon investigation by staff, it
was determined that the contract that Brentwood had engaged in was not for
an on-going effort. Abandoned vehicles identified along the right-of-way
of the Southern Pacific railroad tracks were being towed. The tracks run
through Brentwood and abandoned vehicles had been identified as a hazard
along the railway. The city contracted with a local towing company for the
specific purpose of removing those vehicles that were identified as
possible hazards. There is no other on-going program supported by the
city.
During further discussion by the Board, a request was made to the County
Administrator for a status report on legislation regarding abandoned
vehicles. Following is a status report on the principal legislation for
abandoned vehicles that has significant impact on Contra Costa County.

BILL SYNOPSIS•
Sponsored by Senator McCorquodale. Under existing law, appropriation of
money in the Abandoned Vehicle Trust Fund is continuously given to the
Department of the California Highway Patrol for the administration and
operation of the abandoned vehicle program. A fee of $1. 00 was assessed
for all vehicles registered or reregistered, except as specified during the
1973 calendar year and the revenues deposited in the fund.

This bill repeals the aforementioned provisions and recreates the fund so
that counties can participate in the program.

BILL SYNOPSIS:
Sponsored by Senator Ayala, this bill would reinstate a $1 registration
surcharge fee for all vehicles registered during the 1988 and 1989 calendar
years for the purpose of funding state and local abandoned vehicle removal
programs. Approximately $20 million could be generated each year and would
be disbursed by the CHP to local agencies in proportion to the number of
abandoned vehicles in each jurisdiction.
BILL STATUS•
Bill has been put over for hearing in Senate Appropriations due to a
strongly worded letter of opposition from Department of Finance. A dispute
exists over whether the additional fee applied in this manner is a fee or a
tax.

BILL SYNOPSIS•
Sponsored by Assemblyman Agnos, this bill will impose an $11 vehicle
registration fee, transfer the funds to the Abandoned Vehicle Trust Fund
and authorize the Department of Motor Vehicles to distribute the funds to
counties which establish procedures for the abatement and removal as public
nuisances of any abandoned vehicle from public property. The funds would
be distributed to counties in proportion to the County' s share of all
registered vehicles in eligible counties.

set.

BILL SYNOPSIS•
Sponsored by Assemblyman Hauser, this bill will reinstate the Abandoned
Vehicle Trust Fund; authorize the CHP to disburse the funds to cities or
counties which establish specified abandoned vehicle programs. The bill
also authorizes the CHP to directly provide for the removal of abandoned
vehicles by franchise or contract, and transfer $15 million from the Motor
Vehicle Account in the State Transportation Fund to the Abandoned Vehicle
Trust Fund.

Hearing on this has been postponed and no future schedule has been estab-
lished.
