Spooner , Contracts AdministratorCOs+a DATE-. 19 County SUBJECT: Client Charges and Fee Collection System for Drug Programs Funded Under the County ' s Annual Drug Program Plan .and Budget SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I . RECOMMENDED ACTION : Authorize the Health Services Director or his designees (Assis- tant Health Services _. Director for Alcohol/Drug Abuse/Mental Health and the County Drug Abuse Program Chief ) to : 1 . Establish a sliding scale fee schedule to specify fee amounts to be charged to each client receiving services rendered under the County Drug Program Plan or to be charged to the estates or responsible relatives of such clients , based on abi- lity to pay and in accordance with the guidelines and criteria set forth in Health and Safety Code Section 11991 . 5; 2 . Establish and maintain policies and procedures for admi- nistering the fee collection system, for making determinations of client payment liability and for conducting fee collections , including maintenance of records and audit trails and methods under which contract service providers shall set and collect fees , in accordance with Health and Safety Code Section 11991 . 5; 3 . Collect the fee amounts charged in accordance with said fee schedule , beginning on or about July 1 , 1987 , or as soon as practicable thereafter ; 4 . Revise and update said fee schedule and policies and proce- dures periodically, as needed , to reflect changes in service delivery costs and the cost of living ; ` 5 . Ensure that all fees collected are retained and applied toward the provision of additional drug services under the County Drug Program Plan , in accordance with Health and Safety Code Section 11991 . 5; and 6 . Maintain a full and detailed description of said fee collec- tion system on file on behalf of the County. FINANCIAL - IMPACT: This fee collection system will generate new local revenue to fund _ additional drug services under the County Drug Program Plan , as required by Health and Safety Code Section 11991 . 5 . The amount of this revenue and the nature of the additional ser- vices will be specified in the County' s Annual Drug Program Plan . III . REASONS FOR RECOMMENDATIONS/BACKGROUND: Currently the County does not charge fees to clients receiving services in drug abuse programs for counseling and residential treatment services . Some clients contribute "donations " to the programs providing the service . Health and Safety Code Section 11991 . 5 states that "Charges shall be made for services rendered to each person under a county drug program plan. . . " In order to ensure compliance with this statute and to provide for increased drug program revenues and services , it is recommended that a fee collection system be established based on client ability to pay, as set forth above , for County-operated and Contractor-operated service programs under the County Drug Program Plan and Budget .
