THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on July 28 , 1987 by the following vote:
AYES: Supervisors Powers, Fanden, Schroder, Torlakson, McPeak
NOES: None
ABSENT: None
ABSTAIN: None

SUBJECT: MS 61-86 Request for Modification
of Conditions of Approval .
The Board received a letter dated June 2, 1987 from
Trembath, McCabe, Schwartz, Evans and Levy on behalf of the
developer, Dorothy Plummer, requesting a modification to the
conditions of approval for MS 61-86 , in order to defer collect and
convey requirements until the time when building permits are
issued.
In a report dated July 21, 1987, the Public Works
Director recommended denial of the request because the Ordinance
Code does not provide for deferment of the collect and convey
requirements.
The Board deferred decision on the request to July 28,
1987 and requested the Public Works Director to contact the
developer to explain the recommended action.
Dorothy Plummer appeared this date and advised that the
property in question was a half-acre lot given to her daughter as a
gift from her mother-in-law. She noted that construction of a home
on the property would not begin until sometime in the future. Mrs.
Plummer stated that she had no objection to complying with the
collect and convey requirements, but requested that they be
deferred until such time as the building permits are issued.
After discussion by Board members, IT IS ORDERED that
the Public Works Director and County Counsel are REQUESTED to
prepare a Deferred Improvement Agreement to allow the collect and
convey requirements for MS 61-86 to be deferred until building
permits are issued.
