Accept the attached report from the County Disaster
Council/Advisory Committee for distributing the third
allocation of AB 2536 funds and set Tuesday, August 4, 1987 as
the hearing date for the Board ' s distribution of funds
allocated by the bill .

STATUS REPORT ON THE IMPLEMENTATION OF
ASSEMBLY BILL 2536
RECOMMENDATION:
That the Board authorize the distribution of the third state
allocation of funds authorized by AB 2536 by distributing to the claimant
school districts 100% of the required local match of the districts and
distribute the remaining funds on an equal percentage of 96% to all other
claimants as shown in Attachment No. 4.
BACKGROUND:
On March 11, 1986, the Governor approved and filed with the Secretary, of
State Assembly Bill No. 2536 which authorized the allocation of funds from
the Disaster Response Emergency Operations account to local agencies. The
funds were allocated to cover the costs of providing victim assistance
resulting from the February, 1986 storm. A total of $115,000,000 was
allocated to this fund as follows:
o $10 million was allocated to the Department of Social Services to
provide additional grants to those eligible for assistance under
the Individual and Family Grant program. These supplemental
grants will provide up to $5,000 more in assistance over current
funding levels.
o $5 million was made available to the Office of Emergency Services
for allocation to reclamation and levee maintenance districts to
repair flood-related damage.
o Up to $80 million was allocated to counties for the losses
suffered and the costs incurred by local agencies as a result of
storms and floods.
o $20 million was made available to reimburse local agencies for
the 1985-86 property tax revenue reductions as a result of the
storms and floods.
The Office of Emergency Services was appointed by the Board of Supervisors
to administer the implementation of this bill in Contra Costa County. On
May 6th, the Board of Supervisors appointed the Disaster Council to serve
as the advisory body for recommending distribution procedures for the
allocated funds.
Status Report AB 2536 (Continued)
A total of thirteen (13) claims were. initially filed on or before the
April 30, 1986 deadline--one claim was filed after the deadline passed.
Of the thirteen claims filed on time, nine were determined to be eligible
applicants, four were school districts which are not eligible to share in
these funds unless they meet certain conditions as outlined in guidelines
provided by the state.
Additionally, the allocated funds were not to be used for anything that
was covered and claimed to the Federal Emergency Management Agency (FEMA) .
During the months of July and August, 1986, County OES distributed
$692,719 to the 10 claimants that reported damage within their
jurisdiction.
In August, 1986, the county received a second allocation of $679,357 to
provide further assistance to the affected jurisdictions. With this
allocation, a limited amount of instructions were received on how some of
the monies must be distributed. Those instructions were:
1 - The county must provide 85% of $51,593 to the Walnut Creek School
District for a claim deemed not eligible for federal funding.
2 - A distribution of 25% of the funds requested by schools and community
colleges must be made. The amount claimed by these jurisdictions was-
$325,236.
3 - The Reclamation Districts must be provided 85% of their $89,592 claim.
The remaining monies should be distributed to agencies other than schools
and community college districts. These include the county, cities, and
special districts.
After the second allocation, the state determined that sufficient funds
were available to make some jurisdictions almost 100% whole. Therefore,
each county was asked to resurvey each applicant and see if they had any
outstanding costs which were not included in their initial claim. A
Special Bulletin, shown as Attachment No. 1, was mailed to each previous
applicant.
The Office of Emergency Services received three adjusted claims. They
were:
Contra Costa County OES $ 12,069 from $ 10,069
City of. Orinda $ 318,726 from $ 100,000
City of Lafayette $ 1,726,479 from $ 3,479
On June 15, 1987, a third allocation of $2,299,999.00 was received
from the state, as shown in Attachment No. 2. A press release was
issued announcing the receipt of the third allocation of funds.

DISCUSSION:
As shown in Attachment No. 3, the Disaster Council/Advisory
Committee met on July 15, 1987, to consider recommendations for the
Board on the distribution of the $2,299,999.00. During the meeting,
three distribution strategies were discussed.
ALLOCATION STRAGEGY:
la. Distribute 100% of the requested local match claimed by School
Districts to the claimant district;
b. Set aside 10% of the funds received for future disaster
preparedness activities; and,
c. Distribute the remaining funds at an equal percentage of 91% to
all other claimants.
2a. Distribute 100% of the required local match claimed by School
Districts to the claimant districts;
b. Set aside 10% of the funds received for future disaster
preparedness activities; and,
c. Distribute the remaining funds at an equal percentage of 86% to
all other claimants.
3a. Distribute 100% of the required local match claimed by school
districts to the claimant districts; and,
b. Distribute the remaining funds at an equal precentage of 96% to
all other claimants.
By a majority vote, the Council decided upon strategy Number 3.
The Council further concluded that if any jurisdiction does not use
all of their allocated funds, the remaining funds shall be returned
and deposited in the Natural Disaster Preparedness Fund.
Additionally, the Council directed that the Office of Emergency
Services
o Obtain an updated damage assessment from all claimants and
file an amended claim with the state;
o The Amendment should include monies for the administration
of natural disaster programs in the future.
o Notify each claimant and council member when the Board
hearing is scheduled.
The attached list shows those persons . and agencies who were in
attendance at this specially called meeting.

The Contra Costa County Office of Emergency Services. has been informed that
more money may be available to, pay upwardly adjusted claims, for storm
damages your agency experienced during the February 1986 disaster period.
If you have more documented costs associated with the categories for
eligible expenses than you claimed to this office in April of 1986, you may
submit an additional claim before April 17, 1987 at 5:00 p.m. It is not
guaranteed that you will receive more than your original claim, but it may
be worth the effort if you have a major increase over your inital damage
estimate. If you have any questions, please contact Miriam Hawthorne,
Program Coordinator, at the above address.
