July 2, 1987 (JO^ SUBJECT: Coordinating Hazardous Waste Applications SPECIFIC REQUEST(S) OR RECCMMIENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1 . Request the Hazardous Materials Commission to monitor and submit recommendations to the Board of Supervisors on the proposals for hazardous waste facilities at Stauffer Chemical, IT Corporation, and Dow Chemical. Request the County Administrator to establish a time schedule for completion of this assignment in conjunction with the Hazardous Materials Commission and report this time schedule back to the Board of Supervisors. 2 . Direct the Community Development Department to consider the items contained in Supervisor Fanden' s board orders of March 31, 1987 in the development of the Hazardous Waste Plan and in processing land use applications for the proposed hazardous waste facilities. 3 . Request the County Administrator to invite the Bay Area Air Quality Management District, Regional Water Quality Control Board and State Department of Health Services to attend meetings of the Hazardous Materials Commission. FINANCIAL IMPACT: None. REASONS FOR RECOMMENDATIONS/BACKGROUND: On March 31, 1987, . the Board approved a recommendation from Supervisor Nancy Fanden that the County Administrator report to the Board on methods of coordinating and evaluating current hazardous waste applications. Supervisor Fanden' s recommendation referenced the Stauffer Hazardous Waste Incinerator Proposal and the IT Corporation Modernization Project. The Stauffer plant is in the city ' of Martinez and the city is the lead agency for that project. The County is the lead agency for the IT Corporation project. Additionally, the County, in conjunction with the State, is processing an Environmental Impact . Report for the proposed Dow Incinerator in the East County. Materials Commission D BY ,!/� M382/7-83 — DEPUTY 7 i Page 2 As stated in Supervisor Fanden' s report, the County is currently preparing a Hazardous Waste Management Plan pursuant to AB 2948. The plan will not be approved until late 1988. The three projects mentioned above are currently undergoing local approval processes which may result in a decision prior to the completion of the Hazardous Waste Plan. There is a need to coordinate these efforts during the interim period until the Plan is completed. In Supervisor Fanden' s report the following items were discussed: 1. Methods, such as model conditions of approval, that would require the hazardous waste operator to facilitate on-site recycling, and on-site treatment, in addition to ensuring the most environmentally sound, state of the art disposal possible. 2. Discuss a renewable use permit to require that the project (or projects) will always be using current, state of the art technology. 3 . Review controlling the type of waste and quantity of waste to ensure that County needs are met and that Contra Costa does not become the hazardous waste dump for the rest of the State. 4. Both the city and county are permitting agencies. Recommend methods for coordinating permits, regulating, and collecting fees for service. 5. Determine the level of contamination in soils at both Stauffer and IT sites through the EIR process. Review the possibility of conditioning contamination free soils as an element of the approval process. 6. That transportation routes and safety of trucks carrying hazardous waste to these facilities be scrutinized fully, and that all controls available to ensure safe transit be enforced. The following are staff responses to Supervisor Fanden' s suggestion. 1. Model conditions of approval would be difficult because each facility will have different conditions of approval because they are very different projects. Existing. laws and regulations now require a high level of treatment before land disposal. Since these projects are in the early - stage of Environmental Impact Report development it is not possible to develop model conditions of approval at this time. The Community Development staff will consider model conditions of approval at a later date, such as what was done for sanitary landfill applications. 2. A renewable use permit is likely to be required of hazardous waste facilities. For sanitary landfill applications a condition has been placed on the project such that the land use permit is subject to initial review in three years and then every five years thereafter. A similar type of condition can be placed on hazardous waste facilities. 3 . This question concerns import and export of waste from the County. This will be addressed thoroughly during the development . of the Hazardous Waste Plan. Although the Plan may not be completed before action is required on the pending applications, . all importation of the waste into the County is proposed to be regulated by the Hazardous Waste Plan, including existing imports. The Department of Health Services has suggested , agreements between importing and exporting counties as part of the Hazardous Waste Plan. Regional (ABAG) and State plans will also deal with intercounty relationships. Page 3 4. County staff will work closely with the City of Martinez on the . Stauffer incinerator project to coordinate permits, regulations and fees for service. Both County Health Services and Community Development will be responsible for this coordination. 5. Since the Stauffer proposal is in the City of Martinez the County does not have direct input into the EIR process. For the IT proposal, the comments of Supervisor Fanden will be considered during the EIR and the land use permit process. 6. Transportation routes and safety of trucks will be discussed in the Environmental Impact Report for the projects as well as in a general sense in the Hazardous Waste Plan. It is appropriate for the Hazardous Materials Commission to thoroughly review the proposals for new hazardous waste facilities in the County especially during the interim period when the Hazardous Waste Plan has not been approved. The Commission should be requested to closely monitor the progress of these applications and state to the Board of the Supervisors, and the City of Martinez, at an appropriate time, their position on these projects.
