SUBJECT: LEGISLATION SB745 (ROYCE)
SPECIFIC REQUEST(S) OR RECOMMENDATION(-S) & BACKGROUND Alm JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for SB745 by Senator Royce which would
reimburse the County for 950 of the non-federal cost of determining the
paternity of a child born out of wedlock for the purposes of obtaining a
child support order.
BACKGROUND:
Under current law the County receives approximately 70% reimbursement for
the cost of the family support division in the District Attorney' s Office.
This reimbursement will soon drop to 680. There is no additional
reimbursement available for the costs of establishing the paternity of a
child born out of wedlock in order to obtain a child support order.
Because many of the fathers of children born out of wedlock do not have any
ability to pay child support the County fails to recover any incentive
payment for the collection of child support on these children. The
District Attorney currently has three full-time Senior Collections Officers
whose work is exclusively devoted to adjudicating paternity cases. Because
the District Attorney's Family Support Division is rewarded based on the
level of child support collections it makes they have little incentive to
go to the expense of establishing paternity, although in Contra . Costa
County the District Attorney has continued to give paternity cases the same
priority as other cases.
Senator Royce has introduced SB745 which would reimburse the County for 95%
of the non-federal cost of establishing paternity. This would
appropriately reward the District Attorney for the cost of establishing
paternity in these cases. At 70% federal reimbursement the county share of
the cost of establishing paternity would thus be reduced to 1. 5% from the
current 300. The District Attorney recommends that the Board of
Supervisors support SB745 and this office joins in that recommendation.
SB745 is currently being held under submission .in the Senate Appropriations
Committee and thus may not be considered until January, 1988.
