Approve Rezoning Application #2697-RZ as recommended by the East County Regional Planning Commission; 2. Approve Development Plan 3051-86 with conditions as recommended by the East County Regional Planning Commission; 3. Approve Tentative Subdivision Map 6854 with conditions as recommended by the East County Regional Planning Commission; 4. Adopt the East county Regional Planning Commission findings as set forth in Resolution No. 32-1987 as the determinations for these actions; 5. Introduce ordinance giving effect the aforesaid stoning, waive reading and set date for the adoption of same. The Chair opened the public hearing and no one appearing to speak, the public hearing was closed. Supervisor Torlakson recommended approval of the project with the addition of two conditions, one relative to the park dedication fee and the second relative to the special tax area for police services. Supervisor Schroder advised that he did not agree with the condition on the special tax area for police services. Prior to the issuance of building permits, a landscape plan shall be submitted for the review and approval of the Zoning Administrator' ' The landscape plan shall include: A. The size, species and location of all open space, common, and patio areas. B. Installation of 39 15-gallon size street trees' C. The landscape plan shall be prepared in conformance with Contra Costa County Water Conservation policies' D. Details of the size and location of any fences' A six foot high solid wood fence shall be erected along the 102' elevation line' E. A means of ensuring the continued maintenance and care of all common areas within the subdivision. 3' A color board shall be prepared for review and approval of the Zoning Administrator indicating the proposed finishes, trims and paints to be used on the exterior of the buildings' 4' A sign plan shall be submitted to indicate entry signs and individual street numbers' 5' At least 30 days prior to filing of the final map the applicant shall submit three possible street names and numbers for review and approval by the Community Development Graphics Division. 6' An improvement plan indicating size, design, and location of street lights shall be submitted for review and approval of the Zoning Administrator' 7. Comply with road and drainage considerations: See Subdivision 6854 for comments' - - EMU � " ' CONDITIONS OF APPROVAL FOR SUBDIVISION 6854 AS AMENDED 1. This subdivision Tentative Map is approved as shown on the revised Tentative Map dated as received by the Community Development Department on December 29, 1986. 2. This subdivision is approved contingent upon approval of the rezoning request from R-6 to P-1. 3. Prior to recording the final map or issuance of Building Inspection Department permits, submit a preliminary geotechnical report for review and approval of the Community Development Department. Allow 45 days for review. 4. The applicant shall submit landscape plans as required in Development Plan 3051-86 for the review and approval of the Zoning Administrator. These plans shall conform to Contra Costa County Water Conservation policies. 5. The applicant shall pay the amount of the newly established park dedication fee. In addition, the applicant shall submit a revised site plan indicating a play area for use by small children. These plans and the play area proposal shall be subject to the review and approval of the Zoning Administrator. 6. All utilities shall be placed underground. 7. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section ,92-2.006 of the County Ordinance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Any exceptions therefrom must be specifically listed in this conditional approval statement. B. Construct curb, 6-foot 6-inch sidewalk (width measured from curb face) , necessary longitudinal and transverse drainage, and necessary pavement. widening on the Anchor Drive extension. The faces of curbs shall be located 20 feet from the road center line. C. Install street lights on the Anchor Drive extension. The final number and location of the lights shall be determined by the County Traffic Engineer. D. Convey to the County, by Offer of Dedication, 60 feet of right of way along the Anchor Drive extension as required for the planned future width of 60 feet. The Offer of Dedication shall include 20-foot radii right of way returns at Camino Andres. E. The applicant shall construct and emergency vehicle barricade at the end of Anchor Drive on the south property line. RED N A 2. F. Convey to the County, by Offer of Dedication, 8 feet of additional right of way on Camino Andres east of Anchor Drive as required for the planned future width of 56 feet. G. Convey to the County, by Offer of Dedication, 10 feet of additional right of way on Camino Andres west of Anchor Drive as required for the planned future width of 60 feet: H. Relinquish abutter's rights of access along all curb returns within the subdivision. I. Construct the on-site driveway system to current County private road standards. J. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance for West Pittsburg Area of Benefit as adopted by the Board of Supervisors. K. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance for East/Central County Travel Corridor Area of Benefit as adopted by the Board of Supervisors. L. Complete the cul-de-sac at the end of Camino Andres by constructing the following improvements: 1. Necessary pavement widening and reconstruction. 2. Curb, 6-foot 6-inch sidewalk, and conform paving. 3. Necessary longitudinal and transverse drainage. 4. A 10-foot wide bicycle/pedestrian path located close to the northerly line of the existing road with a curved alignment near Port Chicago Highway to discourage direct high-speed bicycle/pedestrian access to Port Chicago Highway. 5. Curb and sidewalk along the existing Camino Andres entrance to Port Chicago Highway. The sidewalk width shall conform to the width to the north and south. 6. A 20-foot driveway access to the EBMUD right of way at the closest point of contact to the Camino Andres cul-de-sac. M. The existing Camino Andres pavement shall be obliterated between the cul-de-sac and Port Chicago Highway, except for the 10-foot wide bicycle/pedestrian path. N. Submit a detailed conceptual plan to the Public Works Department, Road Engineering Division, prior to beginning work on the improvement plans, for their review and approval . Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalks and driveways' P. Furnish proof to the Public Arks Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. Q. Comply with the drainage fee requirements for Drainage Area 408 as adopted by the Board of Supervisors. R. Convey to the County of Contra Costa, by Grant Deed, the future "development rights» over the natural watercourses traversing the property. The area for which the "development rights" are to be deeded shall be determined by using the criteria outlined in Chapter 814-I0, "Easements", of the Subdivision Ordinance. S. Comply with the requirements of the Federal Emergency Management Agency (FEMA) Flood Insurance Program as if this property were presently located within a flood hazard area. T. The applicant shall apply to the Federal Emergency Management Agency to amend, revise, or appeal their requirements to avoid the need for flood insurance for the proposed dwelling units. The applicant shall submit the necessary information and pay all fees required' U. The siting of unit number 39 and any other unit which may encroach into the creek structure setback area shall he subject to Zoning Administrator review and approval of additional substantiating information from a registered soils engineer, including: l. Adequacy of building foundations' 2' Creek bank stability and compliance with Section 94-4.420 of the Ordinance Code' 3' Adequate erosion protection' V. Prior to issuance of building permits, file the Final Map for Subdivision 6854' 8' On the provision of police service, the applicant agrees to Vote their property into a special tau area for police service at an initial level of $lUO per parcel annually. This amount shall be adjusted yearly according to the Bay Area CPI .
