SUBJECT: PARKING CITATION CONTRACTS - WEST CONTRA COSTA COUNTY
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Approve, and. authorize the County Administrator or his designee to execute on behalf
of the County, contracts with the cities of El Cerrito, Pinole, Hercules, Richmond,
San Pablo, Contra Costa County Community College and the Bay Area Rapid Transit
District for the purpose of adjusting . division of fines and forfeitures for parking
citations to allow the county to recover operational costs.
FINANCIAL IMPACT:
These contracts represent the extension of the parking citation funding plan
developed for all four municipal courts in this county to the Bay judicial district.
(The funding plan was previously implemented in the other three judicial districts
and also incorporates bail increases adopted by the judges on delinquent parking
citations. ) The contracts with the cities and districts provide that the courts may
spinoff from gross parking revenue receipts, the sum of 50 cents for each parking
citation which advances to a delinquent stage and deposit such monies in the county
general fund for reimbursement of operating costs. The county also receives its
proportionate share of the new revenue generated by the bail increases on delinquent
citations. The new revenue to the county resulting from the inclusion of the Bay
judicial district in the funding plan is estimated at approximately $5,500 annually.
Despite the 50 cents spinoff to the county, the cities and districts will also
realize additional income as the delinquency bail increases will generate revenues
significantly greater than the amount required to fund the 50 cents spinoff. The
contracts continue indefinitely except for the city of El Cerrito which terminates in
three years.,
REASONS FOR RECOMMENDATION/BACKGROUND:
The municipal courts have original jurisdiction over parking citations and such
citations are presently being processed by the courts in four judicial districts,
Walnut Creek-Danville, Mt. Diablo, Delta and Bay. The county share of revenue
generated from bails and fines on parking citations is prescribed by Section 1463 of
the Penal , Code. Those percentages are fairly low and in many instances are
insufficient to cover the court's operating costs. The Chiefs of Police, Presiding
Judges and Clerk-Administrators in those four judicial districts have, in concert,
developed a funding plan which allows the county to recover its operating costs on
parking citations. The agreements stem from an expressed desire on the part of the
Chiefs of Police and the Presiding Judges to retain parking citation processing in
the courts. To assist the county with operating costs, an equitable plan which

recognized the differences in 1463 PC revenue splits in this county was needed. As a
result, several cities and districts were exempted from the cost spinoff, two cities
(E1 Cerrito and Concord) were designated for a three year participation and finally
those cities and districts from which the county derives less than 167 of the parking
citation revenues would authorize the cost spinoff on a permanent basis.
CONSEQUENCES OF NEGATIVE ACTION:
The failure to execute these contracts would result in the county not receiving the
new revenues .which would be generated by the parking citation funding plan agreed
upon by the courts, cities and districts.
