Zaharis from the San Ramon Valley Area Planning Commission Approval with Revised Conditions of the Application Filed by Peter and Ann Whitehead for Land Use Permit No. 2071-86 to Expand a Day Care Facility in the San Ramon area. The Board on September 9 , 1986 continued to this time its hearing on the appeal of Raymond F. Zaharis from the San Ramon Valley Area Planning Commission approval with revised conditions of the application filed by Peter and Ann Whitehead for Land Use Permit No. 2071-86 to expand a day care facility in the San Ramon area; and Karl Wandry, Assistant Director of Community Development, described the property site and advised that the Planning Commission had approved expansion to 121) children as opposed to the 180 origi- nally requested by the Whiteheads. Peter Whitehead, 3402 Goyak Drive, Lafayette, applicant and owner, commented on the matter including the need to increase the number of students from 90 to make the school financially viable, , the traffic study that had been done, and the need for a speedy resolution on this appeal for both emotional and financial reasons; Doris Dorris, 352 Harper Lane, Danville, spoke in favor of the project; Raymond F. Zaharis, 18869 Bollinger Canyon Road, San Ramon, appellant, commented on the matter including that he did not object to the school, that his concern was the planning on the pro- ject, traffic, changing the character in a single family home neigh- borhood and the conditions of approval of the Land Use Permit being met, and the septic tank system and screening of the parking area; Ann Whitehead, 3402 Goyak Drive, Lafayette, applicant, spoke in rebuttal, commenting on the new septic system which had been put in, the rural character of the area, the traffic study done by JHK Associates and deferred road improvement.- The Chairman closed the public hearing. The Chair noted that on September 16 , 1986, several interested persons had appeared by mistake to testify in favor of the permit for the Day Care Facility. They were advised that the matter was not before the Board that day, but they were permitted to express their interest in the matter. Supervisor Schroder commented that since Mr. Zaharis stated that he is not opposed to the school, the only area of concern seems to be the change in traffic patterns and traffic safety. He inquired about the provisions of the deferred improve- ment agreement and the monitoring of traffic in the area. Board members discussed the matter including imposing additional conditions requiring appropriate landscaping and screening of the parking area.. Supervisor Schroder recommended that the appeal be denied and the Board uphold the San Ramon Valley Area Planning Commission' s granting of the Land Use Permit for 125 children. Therefore, IT IS BY THE BOARD ORDERED that the appeal of Raymond F. Zaharis from the Stan Ramon Valley Area Planning Commission approval, with revised conditions, of the application of Peter and Ann Whitehead for Land Use Permit No. 2071-86 to expand a day care facility in the San :Ramon area is DENIED and the Land Use Permit is GRANTED with conditions, as revised by the Board of Supervisors and the San Ramon Valley Area Planning Commission, attached hereto as Exhibit A, and that the decision and findings of the San Ramon Valley Area Planning Commission are upheld. thereby certify that this Is a true and correct copy of an action taken and entered on the minutes of the Board of Supe isors on the ate showrn. pp�� ATTESTED: �o3e PHIL BATCHELOR, Clerk of the Board of Supervisors and County Administrator b By , Deputy Orig. Zaharis CONDITIONS OF APPROVAL FOR LAND USE PERMIT 2071-86: 1. Development shall be as shown on 'the revised plans submitted to the Plann- ing Department dated May 14, 1986. 2. The permit is issued to the applicant, owner, Peter and Ann Whitehead only, and shall not be transferred. 3. The maximum attendance of the Child Day School at any one time shall be limited to 125 children. 4. The hours of operation of the school shall be from 7:00 a.m. to 6:00 p.m. , Monday through Friday. 5. No loudspeaker or amplified music shall be permitted outside the enclosed building. 6. All signs are subject to review and approval of the Zoning Administrator. 7. Comply with the drainage, road improvements, traffic and utility require- ments as follows: A. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drain- age) of the Subdivision Ordinance, unless exceptions are specifically granted. B. Install all new utility distribution services underground. C. Furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or perma- nent, road and drainage improvements. D. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Engineering Services Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signage and striping plans for review by the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Engineering Services Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Department. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement.with Contra Costa County and post bonds required by the agreement to guarantee completion of the work. 2. B.
