Receive public comments on the Notice of Intention to Assign Purchase Option. 2. Make findings that the RheM Estate is not required for County use. 3 . Assign the County Purchase Option for the Rheem Estate to the Town of Moraga. ° 4. Declare that the Assignment is categorically exempt from the require- ments of the California Environmental Quality Act and is in compliance with the General Plan of the Town of Moraga. BACKGROUND: The Board, on September 9, 1986), adopted an Order declaring the intent to assign the County purchase option for the Rheem Estate to the Town of Moraga. The option is contained in the June 1, 1974 Lease Agreement between the County and the Contra Costa County Employee' s Retirement Association. September 23 , 1986 was set as the time for public comment on the assignment and to finalize the assignment. Publication of the Notice of Intention was accomplished in accordance with California Government Code Section 25365 and 6061. All lease payments have been maLde by the Town of Moraga. The facility has been and continues to be a city operated recreational facility. THE BOARD OF "SUPERVISORS "OF CONTRA COSTA COUNTY, CALIFORNIA T-3 i Adopted this Order on September 23, 1986 , by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES: None, ABSENT: None ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Hearing on recommendation of the Contra Costa County Planning Commission. with respect to the rezoning applica- tion 2682-RZ filed by Donald & Genevieve Chan, et al (applicants and owners) to rezone land in the Pacheco area. This being the time for hearing on the recommendation of the County Planning Commission with respect to rezoning application 2682-RZ filed by Donald & Genevieve Chan, et al (applicants and owners) to rezone .35 acres from Multiple Family Residential District (M-17) to Multiple Family Residential District (M-29) in the Pacheco area; and Karl Wandry, Assistant Director of Community Development, described the property and advised that a Negative Declaration of Environmental Significance was posted for this project. The Chairman opened the public hearing. The following people appeared to speak: A representative (name not submitted) of the applicants, Donald and Genevieve Chan, commented on the number of units requested versus the number of units recommended by the Planning Commission; Dorothy Elsenius, 351 Via Peralta, Pacheco, Pacheco Town Council, commented that the Council has no objection to the project and the rezoning is consistent and compatible with the authorized use in the area. The Chairman closed the public hearing. The Board considered the matter. On recommendation of Supervisor McPeak, IT IS BY THE BOARD ORDERED that rezoning applica- tion 2682-RZ is APPROVED as recommended by the County Planning Commission and the Board hereby adopts the Planning Commission' s reasons as set forth in its REsolution No. 44-1986 as its deter- minations for this decision. IT IS FURTHER ORDERED that Ordinance No. 86-88 giving effect to the aforesaid rezoning is INTRODUCED, reading waived and October 7 , 1986 is set for adoption of same.
