NOES: None ABSENT : None ABSTAIN: Supervisor Fanden SUBJECT: Hearing on Proposed Ordinance Requiring Land Use Permits for Development Projects involving Hazardous Materials or Wastes The Board on September 9, 1986 deferred decision on the proposed ordinance requiring land use permits for development projects involving hazardous materials or wastes to this date. Supervisor Fanden announced that she would not be voting on this matter inasmuch as she had reason to believe that to do so might constitute a conflict of interest. She also announced that she would not take part in the discussion. County Counsel announced that the Board had two drafts before it for consideration which included the Board's concerns from the previous week. The drafts were reviewed and discussed. Leslie Stewart, representing the League of Women Voters , advised that she wished to clarify the remarks made last week by members of the ad hoc committee with respect to which draft they supported. She stated that they did not want the entire discussions deadlocked and wind up with no ordinance, and therefore supported draft 1 , but that she was sure that no one from that group would oppose draft 2.. Supervisor Powers commented that he would be voting for the strongest ordinance possible and suggested that since there appears that there would be a tie vote on the matter, that decision be deferred for one week and that the Supervisors take that week to review the revised drafts they received today. Supervisor McPeak suggested that County Counsel work with Community Development in identifying the effects each of the two draft ordinances would have on projects that had been completed in the recent past or those pending at this time so that the Board would have an idea of the impact of each of these drafts. IT IS BY THE BOARD ORDERED that decision on the proposed ordinance is DEFERRED to September 23, 1986 on the determination agenda. IT IS FURTHER ORDERED that County Counsel is REQUESTED to identify the effects of each of the two draft ordinances on previously completed and pending projects. t hereby certify that this Is a truo and correct copy of an action taken and entored on the minutes of the Board of SuparvW* on he date showh.
