Amending Housing Rehabilitation
Services Agreement with the Cities
of Antioch, Brentwood and Martinez
WHEREAS, the County has entered into Housing Rehabilitation
Program Services Agreements with the Cities of Antioch, Brentwood and
Martinez; and
WHEREAS, these Cities and the County desire to utilize
complementary program funds from the California Housing Finance Agency (CHFA)
Home Ownership Home Improvement (HOHI) Program, and the State Deferred
Payment Rehabilitation Loan Program; and
WHEREAS, these programs require the provision of housing
rehabilitation technical services; and
THEREFORE IT IS BY THE BOARD ORDERED that the Chairwoman is
authorized to execute an Amendment to the Housing Rehabilitation Program
Services Agreement with the Cities of Antioch, Brentwood and Martinez.

Agreement with the California Housing
Finance Agency for the Home Ownership
Home Improvement Program.
The Board having received a report and a recommendation from
the Director of Planning regarding the continued participation of the County
in the Home Ownership Home Improvement Program of the California Housing
Finance Agency;
IT IS BY THE BOARD ORDERED that the Chairwoman is authorized
to sign the LOCAL GOVERNMENT AGREEMENT with the California Housing Finance
Agency for the Home Ownership Home Improvement Program for the year 1981 ;
and that the Director of Planning or his designee is authorized to sign
necessary implementation documents pursuant to the LOCAL GOVERNMENT
AGREEMENT.

HOME OWNERSHIP AND HOME IMPROVEMENT LOAN PROGRAM (HOHI )
LOCAL GOVERNMENT AGREEMENT
This LOCAL GOVERNMENT AGREEMENT (the "Agreement") is entered
into by and between CONTRA. COSTA COUNTY
(hereinafter "LOCALITY") an t e Cali ornia Ho-6-s in� g Finance
Agency (hereinafter "CHFA") .
RECITALS
A. CHFA and LOCALITY wish to institute a program of finan-
cial assistance and provide related services to assist persons of
low and moderate income to obtain decent , safe and sanitary
housing through the Home Ownershipp and Home Improvement Program
in Neighborhood Preservation Area ("HOHI Program") . N
B. CHFA has received and reviewed an application submitted
by LOCALITY for designation of (an) area(s ), within the LOCALITY
described in Exhibit G as (a ) participating Neighborhood Preser-
vation Area(s) , and CHFA has agreed to designate such area( s )
f"1 ("Commitment Area( s)") .
Now, therefore, LOCALITY and CHFA agree as follows :
ARTICLE I - AUTHORIZATION
This Agreement is entered into pursuant to applicable provi -
sions of the Zenovich-Moscone-Chacon Housing and Home Finance ;.
Act , constituting Division 31 (commencing with Section 50000) of
the Health and Safety Code of the State of California (the
"Act") ; and the . regulations promulgated with respect to the
operation of the HOHI Program in those areas designated by
resolution of the CHFA pursuant to Chapter Six , Part 3 of the Act
as "Neighborhood Preservation Areas" , all agreements , contracts ,
commitments , manuals , instruction letters and other documents
pertaining to the HOHI Program, (collectively the "Rules and
Regulations. ")
ARTICLE II - APPLICABILITY
This Agreement shall apply to all types of Neighborhood
Preservation Areas. For LOCALITIES with designated Concentrated
Rehabilitation Area(s) ("CRA ' s") , Part II covering additional
obligations become part of this Agreement . In LOCALITIES which
have agreed to assist CHFA in providing a Rental Housing Program,
Part III shall become part of this Agreement . The programs to be
included by LOCALITY are checked below and the appropriate Parts F
incorporated herein by this reference.

ARTICLE III - DEFINITIONS
Definitions . Unless a differentmeaning clearly appears
from UT 6 context, all terms in this Agreement shall have the same
meaning as prescribed by the Act and Rules and . Regulations.
Additionally,
A. "Home Improvement Loan" means an advance of money
evidenced by-a-note to finance rehabilitation or general repairs
and improvements to eligible residential structures.
B. "HOHI Program" means CHFA' s Home Ownership and Home
ImprovementaFrogram in Neighborhood Preservation .Area(s) , as
governed by the Act , Rules and Regulations , and all agreements ,
contracts , commitments , manuals , instruction letters, and other
documents pertaining to the HOHI Program.
C. "Loan" means a Mortgage Loan, a Home Improvement Loan,
or other advance of money.
ARTICLE IV - CERTIFICATIONS .
LOCALITY' S acceptance and performance of the following obli.-
gations and responsibilities shall be conditions precedent to
CHFAIS obligation to provide the financing assistance under the
HOHI Program and as described in Exhibit A (Borrowers and
.Developers Eligibility Charts) . Localities shall certify as to
the items in A, B and .0 on Exhibit E which shall become a part of
this Agreement.
A. Citizen Participation. LOCALITY shall certify that it
has implemented and wil continue to implement a program of
Citizen Participation which will satisfy the requirements of
CHFA.

B. California Environmental Quality Act (CEQA) . LOCALITY
shall cern y . t at itas met applicable CMT regulations in
designating the Commitment Area(s) .
C. Affirmative Action. LOCALITY shall assist CHFA in
implementing a program oT—Affirmative Action for contractors and .
subcontractors involved in the rehabilitation or construction of
housing financed by CHFA Loans. `
1 . Where LOCALITY maintains a list of contractors who have
submitted to LOCALITY a LOCALITY approved Affirmative
Action Program which meets the requirements of CHFA,
such program may be used to satisfy this requirement.
2 . Where a contractor is selected other than from the
LOCALITY approved list , LOCALITY is required to assist
such contractors to design and implement an Affirmative r
Action Program required by CHFA. LOCALITY shall assure
CHFA that the requirements of Certificate #001 or #001a
( Individual Borrower ' s Equal Opportunity/Affirmative .
Action Certif. ica.te or Develo.per ' s/Rehabilitator ' s Equal
Opportunity/Affirmative Action Certificate) , which is
executed by the borrower and. contractor on each
rehabilitation/new construction Loan financed, are met..
(Certificate #001 and #001a are attached hereto and
incorporated herein by this reference) .
D. Relocation. LOCALITY shall be responsible for certi -
fying for—HSA—Loans in Mortgage Assistance Areas (Certificate
#002b, attached hereto) that with respect to each Loan for each
unit in a rental property not occupied by the borrower that
either :
1 . Renters will not be displaced as. a result of the Loan;
or
2 . LOCALITY will bear full responsibility for necessary
relocation advisory assistance and payments as
prescribed by law and CHFA regulations.
Nothing in this section precludes a LOCALITY from selecting
only those properties not requiring relocation for financial
assistance.
To satisfy the requirements of this section, LOCALITY may
accept documentation from a participating CHFA lender that no
displacement will occur .
E. Public Improvements and Services . LOCALITY agrees to
provide sucT supporting neigfiSor o3 public improvements and
services to support the HOHI Program as have been determined
appropriate by' CHFA in its resolution designating the area as a
Neighborhood Preservation Area.

ARTICLE V - FAIR SHARE ALLOCATION
A. Fair Share Allocation . LOCALITIES participating in the
HOIJI Program perio ically may be allocated a "fai-r share" of HOHT.
Program funds based on proportional need as identified in the
Statewide Housing Plan and subject to fund availability.
B. Allocation Assignment to. Lender . LOCALITY is hereby
authorizedLo assign i.ts aTFdcation to one or more "Eligible
Lenders." upon receipt of an application or applications from such
Lender .. To be an Eligi.ble Lender such .Lender must certify:
1 . That it is. an approved seller and servicer of thea
Federal National Mortgage Association ;. and
Z . That it will originate , process , close , and service all,
loans delivered.
In order to ' encourage maximum participation by Eligible
Lenders , the following "minimum lender formula" is to be adhered
to :

ARTICLE VI - TERM OF AGREEMENT

A. Term. This Agreement shall be in effect until ,
December "3I , 1981. unless ss soone r terminated pursuant to its
provisions.
B. Extension of Term. . LOCALITY shall" diligently proceed to "
adopt , imp ement,operate and enforce the programs set 'forth in
this Agreement . At the LOCALITY' S request , CHFA may agree to
renew this Agreement' ,for a term to be determined by CHFA.,

C. . Condition Subsequent . CHFA' s obligation to continue the
financing assistance programs shall cease, or be suspended for ,
such time during the term of this Agreement as may be determined
by CHFA, if : (1 ) LOCALITY has failed to comply with any of the
conditions' set forth in this Agreement ; ( 2 ) CHFA determines that
obligation of the LOCALITY are not being implemented ina timely
or reasonable . manner ; or ( 3) bonds are not issued in an, amount
sufficient , in the sole opinion of CHFA, to purchase loans in the
amount of .the commitment and at an interest rate w-hich CHFA
believes will allow it to make Loans at an interest rate suffi -
ciently low so as to make the HOHI Program feasible. P

ARTICLE VII - STATUS REPORTS
LOCALITY shall prepare and submit to CHFA annually, and more ,
frequently upon request of CHFA, progress and status reports on
the HOHI Program.
ARTICLE VIII - COMPLI.ANCE AND INSPECTION
Representatives of CHFA shall .have the right to periodically
meet with LOCALITY to inspect the Commitment Area( s) , and to
inspect the records of LOCALITY regarding .the HOHI Program.
In consideration of the foregoing, we hereby execute this
Agreement (which incorporates all the Exhibits . and Certifica-
tions) as of the date set forth below:

PART II CONCENTRATED REHABILITATION AREAS
Services and Improvements
LOCALITY' S adoption and implementation of the following
programs within the designated Concentrated Rehabilitation . P
Area(s) shall be conditions .precedent to CHFA' S obligation to
provide the financing assistance under the HOHI Program.
A. Housing Assistance Services . LOCALITY shall operate
programs That assistowana very mow income residents to afford
decent , safe and, sanitary housing, including improvements to the
housing neces-s.itated by the code enforcement effort required in
Section B below. These housing assistance programs are described
in Exhibits B- l. through B-4 of this Agreement .
B. Code Enforcement .. LOCALITY shall operate a program to
provide concentrated and continuing enforcement of rehabilita
tion. standards in the designated area. LOCALITY ' S description of
this code enforcement program is attached as Exhibit C.
C. Marketing . LOCALITY shall operate a program to
encourage—participation by local lenders and to inform the
LOCALITY. residents of the existence of financial assistance
available as a part of the HOHI Program. Description of ,
LOCALITY' S marketing program is attached as Exhibit C.
D. Capital Improvements . LOCALITY shall provide specific
capital improvements.--T ese improvements , the amount budgeted,
. and the timetable for starting and completing the work are shown
in Exhibit D of this Agreement.
E. Relocation. LOCALITY. shall operate a program to
ascertainand—resolve problems of displacement of tenants in
housing to be financed with CHFA loans. These procedures shall
be sufficient to enable the LOCALITY to certify
(Certificate N002b , attached hereto) with respect to each loan
for each unit in a rental property not occupied by the borrower
that either :

information additional to that required in Part I . The report
shall include descriptions of the progress and status of each of:
the programs approved . and implemented pursuant to this Part , i
including the date of adoption and implementation of each, funds
budgeted, and funds expended. The , reports should include
LOCALITY' s evaluation of CHFA' s financing assistance program.

LOCAL GOVERNMENT AGREEMENT
PART III - RENTAL HOUSING PROGRAM
LOCALITY ' S . intending to utilize the .financing assistance
described under the HOHI Program for rental housing shall adopt
and imp.lement a RENT LIMITATION MONITORING PROGRAM. This
program shall be described on and attached as Exhibit F. IIn
order to utilize the optional rental program , the appropriate
Local Housing Authority has executed this Local Government Agree
ment. For purposes of this Part , "Rental Housing" means a one ,
two, three or four-unit residential property in which at least
one . .residential unit mill. , not be occupied by the owner
(borrower) .
This program shall as a minimum include the following provi -
sions :
A. Establishment of Fair Market Rents . LOCALITY shall .
establish—for eacFi yenta property Tinanc—ecd—with CHFA assistance
(� a schedule .of base rents based on the . number of bedrooms per
unit . These rents are not to. exceed the Existing .Section 8 Fair
Market . Rents establish-ed Ty—�—for the local market area and
updated from time to time. Rent limitations are to be in effect
for the life of the loan. LOCALITY shall execute Rent Limitation
Agreement Certificate N002a , attached hereto , atthe time each
property is financed. " Procedures shall be 'established to insure f
units are maintained at rents not greater than established in the '
schedule and recertified annually. (See Certificate P006 ) . CHFA.
reserves the authority to adjust rents if necessary . to protect
the interests of CHFA.
B. Property Inspection. LOCALITY shall inspect both the
exterior and - interiorroo '—all rental properties financed. to
establish the number of bedrooms at the time of financing , and at
least annually thereafter , inspect and certify. to CHFA that the
property is in good repair . If, on the annual inspection , the
property is not in good. repair , CHFA shall be notified within
30 days .
C. Relocation. LOCALITY shall operate a program to
ascertain anT iesolve potential displacement of tenants in
housing to be financed with CHFA loans . These procedures shall
be. sufficient to enable the LOCALITY to . certify..
(Certificate N002b , attached .hereto) with respect to . each loan
for each unit in a rental property not occupied by the borrower
that either :

or
2. LOCALITY will bear full responsibility for necessary

law and CHFA regulations .

D. Priority for Section 8 Certificate-Holders . LOCALITY
shall assure in its program escription x ibit F) that f
adequate procedures have been adopted to insure cooperation with
the Local Housing Authority.
LOCALITY shall adopt procedures to notify the Local Housing
Authority of the rental properties financed by CHFA loans so that
Section 8 existing certificate-holders can be made aware of
rental units that will be available. Locality shall identify
vacant units at the time the property is initially financed and
at least at the time of annual inspections and recertifications .

E. Rent Limitation Complaints . LOCALITY shall adopt proce-
dures adequate toassi— st CAF in monitoring tenant complaints as
to potential violations of the rent limitations agreement,. These . �++
procedures shall include., as a minimum, initial notice to all
tenants in rental- property that their unit is under rent control
and written notice. to all occupants of all rental units at least
annually.

Procedures should be adequate to investigate either landlord
or tenant allegations and attempt resolution prior to involvement
of CHFA.
F . Equal Opportunity Occupancy. LOCALITY shall assist CHFA
in enforcing the provisions —Equal Opportunity Occupancy
(Certificate #002a, attached hereto) or other laws , rules or
regulations pertaining to the HOHI Program violations of which .
may come to its attention.
G. Status Reports . LOCALITIES operating a Rental Housing
Program s_haTT suBmit to CHFA annually a status report. The
report shall include descriptions of the progress and status of
each of the programs approved and implemented pursuant to this
Part , including date of adoption and implementation, funds
budgeted, and funds expended.. The reports should include
LOCALITY' S evaluation of CHFA' S financing assistance program.
LOCALITIES operating a Rental Housing Program pursuant to this
Part , at the time of annual recertification, shall also exert
their best efforts to ascertain the income of tenants in rent- !
controlled units .

Code Enforcement
The Community Development Block Grant funded housing rehabilitation program
Contra Costa County is operated on a voluntary code enforcement basis. Housing
Rehabilitation Specialists advise households of the , condition of the home, spec-
ifically delineate code deficiencies, in consultation with the homeowner develop
a listing of.desired general. property improvements, and develop a cost estimate
of completing the rehabilitation work. Further assistance is provided in obtaining
contracting services and providing inspection services as the work progresses.
In order to receive assistance tinder the .County Housing Rehabilitation Program
the family must qualify financially and must agree to correct all code violations.

•Code is utilized as the basis for determining code violations. In cases where
a family does not qualify for assistance, i.e. , is above the income limitations
adopted or is not a resident of the delineated target area, the family is referred
to .the CSA Financial Counselor who will assist them in securing funds to bring
their home up to code.
The County Housing Rehabilitation Program .also has an abatement officer who concen-
trates on abatements within the target area. Structures that are blighting influences
or are health and safety hazards are abated through legally mandated procedures .
Marketing'
Housing rehabilitation assistance is provided to financially eligible families who
reside in delineated target areas. Eight unincorporated communities and seven cities
contain target areas. The County and Cities, have entered into a joint services agree-
ment whereby County will administer and implement a housing rehabilitation program
within a designated area of that City. Residents of the area are notified of the
provisions. of the program by direct mail Community meetings are held to explain the .
program to residents and to gain participation in the program. On a continuing basis
the County Community Services Department has outreach workers in the target communities
who provide information, .counseling, and solicit participation in a paint program,
energy weatherization, and minor home repair.program. In addition, periodic articles
appear in local newspapers.

EXHIBIT F
In conjunction with the Contra Costa County Housing Authority the following
rent limitation procedures will be established and utilized:
I. The County Housing Authority shall establish fair market rents for the
market area. The fair market rents shall be incorporated into the Rent
Limitation Agreement (certificate 002a) executed by the borrower and the
County.
2. On an .annual basis.the Housing Authority shall certify that (1) the rents are
being maintained at levels specified in the Rent Limitation Agreement; and
(2) the property is in good repair.
3. The Housing Authority shall maintain. a list of CHFA assisted rental
properties. At the time of loan closing, the tenants of the units shall be
notified of the rental limitations imposed. Tenants shall be contacted on an
annual basis thereafter. Complaints will be investigated within 10 working
days of receipt of a complaint. Disputes will be mediated by the Housing
Authority and the Housing Alliance or Pacific Community. Services (HUD 1
certified counseling agencies) as appropriate.
4. The Housing Authority will, to the extent feasible, use Section 8 Moderate
Rehabilitation Certificates on units assited under this program. Where not
feasible,, the Housing Authority shall advise the investor/owner of the
priority in rental for Section 8 certificate holders as required, and work with
the investor owner to understand and implement this requirement.
5. The County reserves the right to limit program participation to properties
which will not involve temporary or permanent displacement.

The November 26, 1980 memorandum from the Director of.Planning provides
information about the HOHI program and indicates that in the first three years
of its operation the HOHI program has provided financing to 89 moderate income
County households. I.t is anticipated that 12 to 15 moderate income households
can be provided financing if County participation in the program is renewed.
In addition to provi.ding certification regarding environmental requirements,
citizen participation and affirmative action for participation in .this program,
the County also agrees to provide technical housing rehabilitation services..
These services are provided by the Building Inspection Department, Housing
Preservation Section. All such housing rehabilitation technical services will
be funded through Community Development Block Grant funds.
Renewal of the County participation in the HOHI program is a part of the
total County effort to address the identified needs of providing moderate
income housing. Recently your Board approved the County entering into an
agreement with. the City of Pittsburg for the sale of revenue bonds to finance
the purchase of new construction housing. The renewal of the HOHI program
provides for financing of purchase and rehabilitation and/or refinancing and
rehabi.li.tation of moderate. i.ncome houses. In order to continue the County's

finance the construction and permanent financing for new homes
(Attachment I outlines the provisions of the HOHI Program) . The
program may also provide financing to the owners of rental units who
agree to make the units available to low and moderate income house-
holds on a preferential basis.
In the first two years of its operation the HOHI Program has provided
financing to 89 households (approximately $6,000,000 in mortgage
money) .
The HOHI Program represents a cooperative effort between state and
local government and the private lending industry to conserve and
rehabilitate low and moderate income communities. CHFA utilizes the
proceeds from the sale of mortgage backed revenue bonds to acquire
mortgages originated by participating lenders. The interest rates
of the loans are contingent upon the rates paid to bondholders.
CHFA hopes to be able to purchase loans made at no more than 101%.
Bond sales are expected to be held within the next few months.
CHFA has allocated Contra Costa County $900,000 for the year beginning
January 1 , 1981 . In order to provide sufficient funds to operate a
viable program the number of lenders was limited to two. Mission
Bay Mortgage in Concord, and Statewide Mortgage in San Pablo have
been selected to originate loans with the County allocation.
In order to continue participating in this valuable program 1 recommend
that the Board authorize the Chairwoman to execute the attached Local —
Government Agreement. Further, I recommend that the Director of
Planning or my designate be authorized to execute required documents
which from time to time are necessary to insure efficient implementation
of the program.

In January, 1979 the Board authorized the participation of the County in the
California Housing Finance Agency (CHFA) Home Ownerhsip Home Improvement
(HOHI) Program. The HOHI Program provides first deed of trust mortgage financing
to moderate income households who want to purchase and rehabilitate a home,
refinance and rehabilitate their home, or purchase a new home (Attachment 1
outlines the provisions of the HOHI Program). Operating through three lenders in the
County the HOHI Program assisted, from January 1 to October 31, forty three
households (Attachment 2).
The HOHI Program represents a cooperative effort between state and local govern-
ment and the private lending industry to conserve and rehabilitate low and moderate
income communities. Upon designation of the County and other localities for
participation in the HOHI Program, CHFA markets revenue bonds and utilizes the
proceeds of the bond sale to acquire mortgage loans originated by participating
lenders. Because the loans are purchased by CHFA they can be originated at below
market interest rates (effective 11/1/79 the interest rate is 8Yz%).
In order to continue participating in this valuable program I recommend that the
Board authorize the Chairman to execute the attached Tandem Designation Agree-
ment.

TANDEM DESIGNATION
AGREEMENT
THIS AGREEMENT, is made this 1st day of January
19 80 , by and between the California housing Finance Agency
("AGENCY" ) , a political subdivision of the State of California, and
the County of Contra Costa , ("LOCALITY" ) ,
a local public entity.
RECITALS
A. AGENCY and LOCALITY wish to institute a program of finan-
cial assistance and provide related services necessary to assist
persons of low and moderate income to obtain decent, safe and sani-
tary housing in accordance with the provisions of Division 31 ,
Parts 3 and 4 of health and Safety Code of the State of California
(the "Code" ) .
B. AGENCY has received and reviewed an application submitted
by LOCALITY for designation of (an) area (s) within the jurisdication
of LOCALITY (described in Exhibit K ) as (a) participating concen-
trated rehabilitation area (s) within the meaning of Section 50062
of the Code and as a participating mortgage assistance area within
Section 50085 of the Code , and AGENCY has designated the areas in
Agency Board of Directors Resolution 78-104 as such pursuant to
Section 51302 and 51304 of the Code.
NOW, THEREFORE, the parties hereto agree as follows :
ARTICLE I
Subject to LOCALITY' s adoption, implementation and continuance
of the programs described in Article II hereof. , AGENCY agrees to
purchase Mortgage Loans and Home Improvement Loans for those
properties and borrowers described in Exhibit A. All such loans
shall be made by AGENCY approved qualified mortgage lenders as such
lenders are defined in Section 50094 of the Code.
A. Definitions.
1. "Home Improvement Loan" means an advance of money
evidenced by a note to finance rehabilitation or general
repairs and improvements to eligible residential structures .
2. "Loan" means a Mortgage Loan , or a Home Improvement
Loan, or other advance of money or a participation of such
loan or advances made pursuant to Parts 1 and 3 of Division 31
of the Code.
^ ONDEM DESIGNATION
3 . "Mortgage Loans" means a mortgage, deed of trust, or
other instrument which is secured by a lien on real property
together with a note evidencing a long-term advance of money
made for the financing or refinancing of residential real
property.
ARTICLE II
Services and Improvements
LOCALITY' s adoption and implementation of the following pro-
grams within the designated concentrated rehabilitation areas shall
be conditions precedent to AGENCY ' s obligation to provide the financ-
ing assistance described in Exhibit A.
A. Housing Assistance Services. LOCALITY shall adopt and/or
continue programs that assist low and very low income residents to
afford decent, safe and sanitary housing , including improvements to
the housing necessitated by the code enforcement effort required in
Section B below. These housing assistance programs are described
in Exhibit B of this Agreement.
B. Code Enforcement. LOCALITY shall adopt or continue a pro-
gram of housing code enforcement. LOCALITY ' s description of this
code enforcement program is attached as Exhibit C.
C. Relocation Services . LOCALITY shall adopt or continue
programs , which provide relocation advisory assistance and payments
as prescribed by law (including the Code) and AGENCY regulations.
LOCALITY shall provide certification (Exhibit D) to AGENCY
with respect to each Loan for a unit not occupied by the owner that
either :
(1) Relocation would not be caused by making the Loan; or
(2) LOCALITY will bear full responsibility for necessary
relocation advisory assistance and payments .
D. Affirmative Action. LOCALITY shall assist the AGENCY in
implementing a programme Affirmative Action for contractors and
subcontractors involved in the rehabilitation for construction of
housing financed by AGENCY Loans (Exhibit E) .
(1) If the LOCALITY maintains a list of approved contractors ,
each contractor on such list will have submitted to the LOCALITY,
and the LOCALITY will have approved , an Affirmative Action Pro-
gram. Such program shall be no less than that required in the
Code and AGENCY regulations .

(2) Where a contractor is selected other than from an
approved list , the LOCALITY is required only to make best
efforts to assist contractors operating within the area to
design and implement Affirmative Action Programs required
by AGENCY Loan documents .
E. Capital Improvements. LOCALITY shall provide specific
capital improvements. These improvements , the amount budgeted ,
and the timetable for starting and completing the work are shown
in Exhibit F of this Agreement.
F. Rent Limitation Complaints . LOCALITY shall adopt and/or
continue programs to review, verify and forward to AGENCY complaints
made by tenants in housing financed by the AGENCY that rent limita-
tion agreements made pursuant to AGENCY regulations have been
violated (Exhibit G)
G. Citizen Participation. LOCALITY shall adopt and/or con-
tinue a program to obtain participation of citizens within the area
in the implementation of a Neighborhood Preservation Program.
Certification by Locality is attached as Exhibit H.
H. Marketing. LOCALITY shall adopt and/or continue a program
to induce participation by local lenders and to inform the residents
of the existence of financial assistance available as a part of the
Neighborhood Preservation Program. Description of Locality ' s
marketing program is attached as Exhibit J.
ARTICLE III
Term
A. Term : This Agreement shall be in effect for one calendar
year - January 1; 1980 through December 31 , 1980 .
B. Extension of Term. LOCALITY shall diligently proceed to
adopt, implement and enforce the programs set forth in Article II
of this Agreement. If AGENCY finds the LOCALITY to be in substantial
compliance with the commitments contained in Article II , AGENCY, at
LOCALITY ' s request, may agree to renew this Agreement
for a term to be determined by AGENCY.
C. Condition Subsequent. AGENCY ' s obligation to continue the
financing assistance programs shall cease , or be suspended for such
time as may be determined by AGENCY, if: (1) LOCALITY has failed to
comply with any of the conditions set forth in this Agreement;
(2) AGENCY determines that the programs adopted by LOCALITY are not
being implemented on a reasonable time schedule; or (3) AGENCY becomes

unable to obtain funds by public or private sale of its underlying
notes or bonds at an interest rate which would allow AGENCY to
provide financial assistance at an interest rate sufficiently low
so as to make the financial assistance programs feasible.

Status Reports
LOCALITY shall prepare and submit to AGENCY for review pro-
gress and status reports on the rehabilitation assistance program.
Such reports should be submitted to AGENCY no later than fifteen (15)
days after the close of each quarter of LOCALITY' s fiscal year.
Reports submitted to AGENCY shall include at least the following
information on program activity by quarters : (1) Number of code
inspections made; (2) number of Loan or grant applications received
by LOCALITY; and (3) number of Loans or grants (and dollar amount)
paid out by LOCALITY. In addition, the report should include de-
scriptions of the progress and status of each of the programs
approved and implemented pursuant to Article II , including date
of adoption and implementation, funds budgeted, and funds expended
(both quarterly and cumulative since the proqrams ' adoption) . The
reports should include LOCALITY' s evaluation of AGENCY ' s financing
assistance program.
ARTICLE V
Inspections
Representatives of AGENCY shall periodically meet with LOCALITY
and inspect the mortgage assistance area.

The existing Community Development Block Grant funded housing rehabilitation program
in Contra Costa County is operated on a voluntary code enforcement basis. Housing
Rehabilitation Specialists advise households of the condition of the home, specifically
deliniate code, deficiencies, in consultation with the homeowner develop. a- listing of
desired general property improvements, and develop a cost estimate.of completing the
rehabilitation work. Further assistance is provided in obtaining contracting services and
providing inspection services as the work progresses.
In order to receive assistance under the County Housing Rehbilitation Program the family
must qualify.financially and must agree to correct all code violations noted by Building
Inspections Department personnel. The 1967 Housing Code is utilized as the basis for . .
determining code violations. In cases where a family does not qualify for assistance, i.e.,
is above the income limitations adopted or is not a resident of the deliniated target area,
the family is referred to the CSA Financial Counselor who will assist them in securing
funds to bring their home up to code.
The County Housing Rehabilitation Program .also has an abatement officer who concen-
trates on abatements within the target area. Structures that are blighting influences or
are health and safety hazards are abated through legally mandated procedures.

Housing rehabilitation assistance is provided to financially eligible families who reside in
deliniated target areas. Eight unincorporated communities and seven cities contain target
areas. The County and Cities have entered into a joint services agreement whereby the
County will administer and implement a housing rehabilitation program within a desig-
nated area of that City. ,Residents of the area are notified of the provisions of the
program by .direct mail. Community meetings are held to. explain the program to
residents and to gain participation in the program. On a continuing basis the County
Community Services Department has outreach workers in the target communities who
provide information, counseling, and solicit participation in a paint program, energy
weatherization, and minor home repair program. In addition, periodic articles appear in
local newspapers.
The availability of CHFA loans can be easily integrated into the current processes.
Determination of which program would be best suited to the applicant would be based on
income, type and extent of work to be completed, and the individual preferences of the
applicant. The CHFA loans could be targeted to the moderate income residents thereby
allowing the Community Development funded Housing Rehabilitation Program funds to be
targeted to those in the more limited income area. The CHFA loans, because the
maximum' amount for rehabilitation assistance is higher than the County program, could
be made available to those requiring extensive rehabilitation but lacking sufficient income
to carry the debt loan could have their interest rates written down to a more appropriate
level by being piggy-backed with the Community Development funds. In addition,. the
Mortgage Assistance Program will complement the rehabilitation efforts, and the public
improvement efforts being undertaken through the County Community Development
-Program.
The County Building Inspection Department is currently implementing the County Housing
Rehabilitation Program. The Building.Inspection Department has a full time staff of eight
professionals - one Program Director, one Administrative Analyst, five Housing Special-
ists and one Abatement Officer. Further, one additional Housing Specialist is budgeted
and will be hired in the near future. In addition, a Senior Planner in the County Planning
Department is responsible for providing tTh(� Building Inspection Department with overall
program policy guidance. The County has also entered into .an agreement with Great
Western Saving and Loan to assist in the administration and handling of rehabilitation
loans. The County also achieves an approximate 2-1 leveraging of private funds as part.of
the agreement with Great Western.

TANDEM DESIGNATION
AGREEMENT
THIS AGREEMENT, is made this 1st day of January
1979 , by and between the California Housing Finance Agency
("AGENCY" ) , a political subdivision of the State of California, and
Contra Costa County ("LOCALITY" ) ,
a local public entity.
RECITALS
A. AGENCY and LOCALITY wish to institute a program of finan-
cial assistance and provide related services necessary to assist
persons of low and moderate income to obtain decent, safe and sani-
tary housing in accordance with the provisions of Division 31,
Parts 3 and 5 of Health and Safety Code of the State of California
(the "Code") .
B. AGENCY has received and reviewed an application submitted
by LOCALITY for designation of (an) area (s) within the jurisdication
of LOCALITY (described in Exhibit K ) as (a) participating concen-
trated rehabilitation area (s) within the meaning of Section 50062
of the Code and as a participating mortgage assistance area within
Section 50085 of the Code, and AGENCY has designated the areas in
Agency Board of Directors Resolution 78-104as such pursuant to .
Section 51302 and 51304 of the Code.
NOW, THEREFORE, the parties hereto agree as follows:
ARTICLE I
Subject to LOCALITY' s adoption, implementation and continuance
of the programs described in Article II hereof, AGENCY agrees to
purchase Mortgage Loans and Home Improvement Loans for those
properties and borrowers described in Exhibit A. ' All such loans
shall be made by AGENCY approved qualified mortgage lenders as such
lenders are defined in Section 50094 of the Code.
A. Definitions.
1. "Home Improvement Loan" means an advance of money
evidenced by a note to finance rehabilitation or general
repairs and improvements to eligible residential structures.
2. "Loan" means a Mortgage Loan, or a Home Improvement
Loan, or other advance of money or ,a participation of such
loan or advances made pursuant to Parts 1 and 3 of Division 31
of the Code.

3. "Mortgage Loans" means a mortgage, deed of trust, or
other instrument which is secured by a lien on real property
together with a note evidencing a long-term advance of money
made for the financing or refinancing of residential real
property.
ARTICLE II
Services and Improvements
LOCALITY' s adoption and implementation of the following pro-
grams within the designated concentrated rehabilitation areas shall
be conditions precedent to AGENCY' s obligation to provide the financ-
ing assistance described in Exhibit A.
A. Housing Assistance Services. LOCALITY shall adopt and/or
continue programs that assist low and very low income residents to
afford decent, safe and sanitary housing, including improvements to
the housing necessitated by the code enforcement effort required in
Section B below. These housing assistance programs are described
in Exhibit B of this Agreement.
B. Code Enforcement. LOCALITY shall adopt or continue a pro-
gram of housing code enforcement. LOCALITY' s description of this
code enforcement program is attached as Exhibit C.
C. Relocation Services. LOCALITY shall adopt or .continue
programs, which provide relocation advisory assistance and payments
as prescribed by law (including the Code) and AGENCY regulations.
LOCALITY shall provide certification (Exhibit D) to AGENCY
with respect to each Loan for a unit not occupied by the owner that
either:
(1) Relocation would not be caused by making the Loan; or
(2) LOCALITY will bear full responsibility for necessary
relocation advisory assistance and payments.
D. Affirmative Action. LOCALITY shall assist the AGENCY in
implementing a program of Affirmative Action for contractors and
subcontractors involved in the rehabilitation for construction of
housing financed by AGENCY Loans (Exhibit E) .
(1) If the LOCALITY maintains a list of approved contractors,
each contractor on such list will have submitted to the LOCALITY,
and the LOCALITY will have approved, an Affirmative Action Pro-
gram. Such program shall be no less than that required in the
Code and AGENCY regulations.

(2) Where a contractor is selected other than from an
approved list, the LOCALITY is required only to make best
efforts to assist contractors operating within the area to
design and implement Affirmative Action Programs required
by AGENCY Loan documents.
E. Capital Improvements. LOCALITY shall provide specific_
capital improvements. These improvements, the amount budgeted,
and the timetable for starting and completing the work are shown
in Exhibit F of this Agreement.
F. -Rent Limitation Complaints. LOCALITY shall adopt and/or
continue programs to review, verify and forward to AGENCY complaints
made by tenants in housing financed by the AGENCY that rent limita-
tion agreements made pursuant to AGENCY regulations have been
violated (Exhibit G) .
G. Citizen Participation. LOCALITY shall adopt and/or con-
tinue a program to obtain participation of citizens within the area
in the implementation of a Neighborhood Preservation Program.
Certification by Locality is attached as Exhibit H.
H. Marketing. LOCALITY shall adopt and/or continue a program
to induce pa—rt pation by local lenders and to inform the residents
of the existence of financial assistance available as a part of the
Neighborhood Preservation Program. Description of Locality' s
marketing program is attached as Exhibit J.
ARTICLE III
Term
A. Term: This Agreement shall be in effect until one
calendar year - Jan. 1979 to Jan. 1980 • -
B. Extension of Term. LOCALITY shall diligently proceed to
adopt, implement and enforce the programs set forth in Article II
of this Agreement. If AGENCY finds the LOCALITY to be in substantial
compliance with the commitments contained in Article II , AGENCY, at
LOCALITY' s request, may agree to renew this Agreement
for a term to be determined by AGENCY.
C. Condition Subsequent. AGENCY' s obligation to continue the
financing assistance programs shall cease, or be suspended for such
time as may be determined by AGENCY, if: (1) LOCALITY has failed to
comply with any of the conditions set forth in this Agreement;
(2) AGENCY determines that the programs adopted by LOCALITY are not
being implemented on a reasonable time schedule; or (3) AGENCY becomes

unable to obtain funds by public or private sale of its underlying
notes or bonds at an interest rate which would allow AGENCY to
provide financial assistance at an interest rate sufficiently. low
so as to make the financial assistance programs feasible.
ARTICLE IV
Status Reports
LOCALITY shall prepare and submit to AGENCY for review pro-
gress and status reports on the rehabilitation assistance program.
Such reports should be submitted to AGENCY no later than fifteen (15)
days after the close of each quarter of LOCALITY' s fiscal year.
Reports submitted to AGENCY shall include at least the following
information on program activity by quarters : (1) Number of code
inspections made; (2) number of Loan or grant applications received
by LOCALITY; and (3) number of Loans or grants (and dollar amount)
paid out by LOCALITY. In addition, the report should include de-
scriptions of the progress and status of each of the programs
approved and implemented pursuant to Article II , including date
of adoption and implementation, funds budgeted, and funds expended
(both quarterly and cumulative since the programs ' adoption) . The
reports should include LOCALITY' s evaluation of AGENCY' s financing
assistance program.
ARTICLE .V
Inspections
Representatives of AGENCY shall periodically meet with LOCALITY
and inspect the mortgage assistanceJarea.
In consideration of the foregoing, and as our free act and
deed, we hereby execute and seal this Agreement as of the date

EXHIBIT C
The existing Community Development Block Grant funded housing
rehabilitation program in Contra Costa County is operated on a
voluntary code enforcement basis. Upon deliniation of target
areas residents are notified by mail that zero or low interest
loans are available to finance the correction of code deficien-
cies and to conduct some general property improvements to arrest
deterioration. In addition, community meetings are held to
describe the provisions of the program, and to secure partici-
pants. On a continuing basis the County Community Services
Administration (formally Office of Economic Opportunity) provides
outreach housing services to residentsof the target communities.
In order to receive assistance under the County Housing Rehab-
ilitation Program the family must qualify financially and must
agree to correct all code violations noted by Building Inspec-
tions Department personnel . The 1967 Housing Code is utilized
as the basis for determining code violations. In cases where
a family does not qualify for assistance, i .e. , is above the
income limitations adopted or is not a resident of the deliniated
target area, the family is referred to the CSA Financial Counselor
who will assist them in securing funds to bring their home up to
code.
The County Housing Rehabilitation Program also has an abatement
officer who concentrates on abatements within the target area.
Structures that are blighting influences or are health and
safety hazards are abated through legally mandated procedures.

Housing rehabilitation assistance is provided to financially
eligible families who reside i-n deliniated target communities.
Six unincorporated communities are currently target communities -
North Richmond, Montalvin Manor, Rodeo, Mountain View, West
Pittsburg, and Oakley. In addition, the County and the City of
Pleasant Hill are about to enter into a joint services agreement
whereby the County will administer and implement a housing
rehabilitation program within a designated area of that City.
Residents of the area are notified of the provisions of the
program by direct mail . Community meetings are held to explain
the program to residents and to gain participation in the
program. On a continuing basis the County Community Services
Administration has outreach workers in the target communities
who provide information, counseling, and solicit participation
in a paint program, energy weatherization, and minor home re-
pair program. In addition, periodic articles appear in local
newspapers.
The availability of CHFA loans can be easily integrated into
the current processes. Determination of which program would
be best suited to the applicant would be based on income, type
and extent of work to be completed, and the individual pre-
ferences of the applicant. The CHFA loans could be targeted
to the moderate income residents thereby allowing the Community
Development funded Housing Rehabilitation Program funds to be
targeted to those in the more limited income area. The CHFA
loans, because the maximum amount for rehabilitation assistance
is higher than the County program, could be made available to
those requiring more extensive rehabilitation work. CHFA loans
to those requiring extensive rehabilitation but lacking sufficient
to carry the debt load could'.-have their interest , rates written
down to a more appropriate level by being piggy-backed with the
Community Development funds. In addition, the Mortgage Assistance
Program will complement the rehabilitation efforts, and the public
improvement efforts being undertaken through the County Community
Development Program.

On December 19, 1978 the Board referred to the Finance Committee a report and
explanatory materials from the Director of Planning relating to the partici-
pation of the County in the California Housing Finance Agency (CHFA) Home

The Committee, having heard a report from the Director of Planning on the
Program and County responsibilities thereunder, recommends that the County.

Program
Since the inception of the Community Development Block Grant Program
the County and the twelve cooperating cities have taken some initial steps to
address the housing needs of the low and moderate income population.
Through various housing programs over 100 families have been assisted in
improving their homes, over 1,000 families have received financial assistance
to secure affordable rental housing, almost 400 units of new subsidized elderly
rental housing have been or are about to be constructed, and about 50 families
have been provided assistance to purchase homes. The assistance already
provided, however, just begins to address the housing needs of the low and
moderate income population. Additional methods of providing for low and
moderate income housing needs must be evaluated and utilized when appro-
priate, so that the County can continue to address its housing responsibilities.
One program which the County can utilize is the California Housing
Finance Agency's (CHFA) Home Ownership and Home Improvement (HOHI)
program. The HOHI Program represents a cooperative effort between state
and local government and the private lending industry to preserve and rehabili-
tote declining neighborhoods. Upon designation of localities for participation
in the HOHI Program, CHFA markets bonds and utilizes the proceeds of the
bond sale to acquire home purchase and home improvement loans from private
lenders. Because the loans are purchased by CHFA they can be made at a
below market interest rate. A programmatic description of the HOHI Program
is provided as an appendix.
The HOHI Prograrn has been in existence since January, 1978. In the first
year of the program CHFA issued bonds totaling $125,000,000 to purchase
loans made in .24 localities. Over 2,000 loans were originated by lenders and
purchased by CHFA statewide. In preparing for the second year bond issue of
$130,000,000 for the HOHI Program CHFA invited applications from localities
throughout the state. An expression of interest to be included in the HOHI
Programs was submitted by the Planning Department to CHFA. On November
21, 1978 the CHFA Board of Directors approved the request for "tandem
designation" as a participating locality, subject to the execution of an
agreement. Tandem designation provides the most comprehensive financing
package available under this program. The designation is intended for
localities which have operational housing rehabilitation programs in concen-
trated areas. The County has six Concentrated Rehabilitation Areas (CRA's) -
North Richmond, West Pittsburg, Montalvin Manor, Rodeo, Mountain View, and
%%-- Oakley (maps attached). Under a tandem designation CHFA is encouraging a
concentration of loans in the CRA's. Mortgage assistance can also be provided
to qualifying families who reside outside of the CRA's but within the
unincorporated areas ,of the County. Loans originated can be utilized to 1)
purchase homes, 2) of
and rehabilitate homes, 3) and refinance and

rehabilitate homes. Assistance can be provided to investor-owners of 1-4 unit
residences only in CRA's. Assistance outside of CRA's is available only
for single family ownership.
I recommend that the County participate in this program, and that the
Board authorize the Chairman to execute the attached Tandem Designation
Agreement. Since this is a new prograrn to the County, I recommend that this
matter be referred to the Finance Committee, so that I may make a full
presentation of this proposal to the Committee and it can then make an
appropriate recommendation to the Board as a whole.
There is some urgency attached to this agreement. Even though our areas
were only designated on November 21, 1978, funds will be made available to
lenders in Contra Costa and Alameda Counties as of January I, 1979. Demand
is expected to exceed by nearly ten-fold the funds to be made available for
these two counties. In order that Contra Costa may get its full measure of the
funds available, the matter should be scheduled before the Committee and the
Board as soon as possible, hopefully in early or mid-January.

Home Ownership and Home Improvement (HOHI)
Program Description
Goals of Program
I. Assist in revitalizing deteriorating neighborhoods.
2. Assist low and moderate income families in obtaining financing for
home ownership.
3. Make horne financing and refinancing assistance available in areas
traditionally short of conventional mortgage money.
4. Stirnulate the production of new lower cost housing for modest income
households.
Role of Locality
I. Provide housing rehabilitation assistance through an ongoing program
in concentrated areas.
2. Assist in marketing and advertising the program to eligible families.
3. Refer potential households to lenders and provide home review assis-
tance to lenders to determine code deficiencies.
4. Execute a relocation certificate which indicates that relocation assis-
tance will be provided to any family displaced from a rental unit. If
relocation assistance is not provided CHFA will not purchase the loan
(under the HOHI Program to date over 2,000 loans have been arigina-
ted statewide; no loan has resulted in relocation and no relocation
assistance has had to be provided).
S. Monitor rent limitations imposed on rental units financed under the
program. The extent of involvement is limited to initial investigations
of complaints and referral to CHFA if further enforcement action is
necessary.
Role of Lenders
I. Originate loans.
2. Work with localities to act responsively with regard to the purposes of
the HOHI Program and the localities Neighborhood Preservation
objective.
3. Disseminate information on fhe program by worl<inq with the locality
and by working with local real estate and brokerage firms.
4. Originate a minimum of 30% of the loans in CRA's for new consiruc-
tion infill and rehabilitation. County staff has indicated that the 3096
should be considered by the lender to be only a minimum, and that
further concentration in CRA's is strongly encouraged.

Program Financing
1) CHFA markets tax exempt bonds and utilizes proceeds to purchase
loans made by participating lenders.
2) 1979 bond issue is $180,000,000.
3) Allocation Formula developed allocates 8.6% of the issue, or
$15,400,000 to Alameda - Contra Costa County.
HOHI Loans
1), Types of loans include:
a) mortgage loans to purchase a new or existing residence
b) mortgage loans to purchase and rehabilitate existing resi-
dences.
c) mortgage loans to refinance
2. Interest rate is expected to be about 7 3/4% with a minimum term of
25 years.
3) Downpayments for loans vary according to the type of insurance or
loan guarantee used and the income and occupancy status of the
borrower. For single family owner occupants the loan-to-value ratio
will generally be 90%, however loan-to-value ratios up to 95% can be
made when applicable standards of the lenders and mortgage insurers
are met.
4), Maximum sales price for single family homes are expected to be
$69,000.
5) Borrowers adjusted gross income must be equal to or less than the
Moderate Income, Limits of the Program for the appropriate family
size. The limits have not yet been set but, for example, the limits for a
