SUBJECT: Carquinez Scenic Drive
The Board this date received a status report from Phil
Batchelor, County Administrator, on the use and operation of
Carquinez Scenic Drive from the Martinez city limits to the road
closure (attached hereto and by reference incorporated herein) .
Mr. Batchelor referred to the hazards connected with
keeping the road open, and recommended that the portion of the road
from the Martinez city limits to the slide area be closed to through
traffic. He recommended that the matter be referred to the Public
Works Department to work with the City of Martinez on putting up
appropriate signs and barriers.
Supervisor Nancy Fanden commented on the potential liability
exposure if the road is kept open. She noted that the County does
not have funds available to repair the road, and inquired about the
availability of FEMA money.
Michael Walford, Public Works Director, noted that FEMA
monies are available only to restore roads, and the majority of work
required on the Carquinez Scenice Drive would be landslide repair;
thus, only a small percentage of the cost would be covered by FEMA
money.
Supervisor Fanden expressed her concern about the addi-
tional liability involved with Ozol Fuel Depot employees using the
road in its current state, and commented on the need to determine an
alternate route into the Ozol facility.
Board members being in agreement, IT IS BY THE BOARD
ORDERED that the report from the County Administrator is ACCEPTED.
IT IS FURTHER ORDERED that the matter is REFERRED to the
Public Works Director to work with the City of Martinez on signs and
placement of barriers, and to provide an alternate access route for
the Ozol Fuel Depot employees.
IT IS FURTHER ORDERED that the County Administrator and
Public Works Director are REQUESTED to continue to pursue efforts to
obtain funding to repair the slide damage on Carquinez Scenic Drive.
IT IS FURTHER ORDERED that the Public Works Director is
REQUESTED to report to the Board on the allocation and utilization
of FEMA monies.

SUBJECT: Use and Operation of Carquinez Scenic Drive
From Martinez City Limits to Road Closure
SPECIFIC REQUEST(S) OR RECCMMENDATION(S) & BACISROUID AND JUSTIFICATION
RECOMMENDATION•
Accept this status report on the use and operation of Carquinez Scenic
Drive.
BACKGROUND:
Since a major landslide occurred in 1983, Carquinez Scenic Drive has
been closed approximately two miles west of Martinez, just past the Ozol
Fuel Depot turnoff. The Depot is owned by the United States Department of
Defense, and this road provides the only vehicular access to the Depot.
Because the road dead ends, it has become an isolated, infrequently
travelled one. Many empty and broken beer bottles, and large amounts of
garbage dumped along the two mile stretch of road are unsightly evidence of
extensive littering. In addition, road signs are continuously vandalized.
It does not appear that funds will be available for repair and
reopening of the road. This road is regularly maintained by the Public
Works Department. Road maintenance primarily involves sealing roadway
cracks, landslide repair and road signing. It is a difficult road to
maintain because of on-going landslides and vandalized signs. The
potential liability to the County for this road is no different than the
liability for any other County road. However, the County is incurring
liability for a road that, with the exception of access to the Ozol Fuel
Depot, does not appear to be serving any general public interest.
Because of the above problems, road closure at the Martinez city
limits is being considered. The Public Works "Department is presently
negotiating with the Department of Defense regarding possible closure and
vacation of this road, and the Department of Defense' s use and maintenance
of the road from that time. Such closure is opposed by the Martinez City
Council. They adopted a resolution opposing closure of the road and that
resolution is being sent to the Board of Supervisors.
It does not appear the slide areas on Carquinez Scenic Drive will ever
be repaired and the road reopened. The littering, road maintenance
problems and liablity exposure, coupled with the road not serving any
general public interest outweigh the benefit of keeping the two mile
stretch of road open. Therefore, closure of the road at the Martinez city
limits is being carefully explored. 1
