SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROU AND JUSTIFICATION
I . RECOMMENDED ACTION:
Request the San Francisco Bay Conservation and Development Commission to
amend their San Francisco Bay Plan to delete the Acme Fill Company (Acme
landfill ) property and associated properties, located south of Waterfront
Road and east of the Walnut-Pacheco Creek channel , from the San Francisco
Bay Plan.
The proposed amendment would delete the current water-related industry
"priority use"designation of the property in BCDC's Bay Plan.
II. FINANCIAL IMPACT:
There are no direct financial obligations to the County which would result
from the action.
BCDC approval of the action could directly result in the extended use of
the same landfill facility for approximately two years, which should be
reflected in a continuation of moderate disposal costs for the 425,000 pop-
ulation served by the facility.
BCDC approval of the action could indirectly result in the unavailability
of the site for water-related industry with possible future losses in job
creation and government revenue generation. However, it is also possible
that the approval of the action could result in the earlier development of
the site for other uses, with attendant job and revenue increases.
III. REASON FOR THE RECOMMENDATION:
Deletion of the water-related industry designation from the BCDC Bay Plan
would, in effect, remove the Acme landfill facility from BCDC jurisdiction
over federal government actions. This would enable the District Engineer
of the U.S. Army Corps of Engineers to act on Acme Fill Corporation's re-
quest for a two-year extension of the federal permit. governing the use of
the main 97-acre fill area.

IV. BACKGROUND:
1. The proposed action is consistent with County efforts to obtain a
two-year extension of the existing major fill area at the Acme land-
fill (e.g. , the County's May 13, 1986, letter to the District Engi-
neer) . This course of action was supported by the 1985-1986 Grand
Jury as well as by a number of local governments in the County.
2. The proposed action is consistent with the reasons given by the Board
of Supervisors in the Board's March 18, 1986, actions supporting the
City of Martinez' request for a similar amendment to the BCDC Bay Plan
pertaining to an adjoining .property. Additionally, the proposed ac-
tion is consistent with a 1983 County staff request to BCDC to review
the BCDC Bay Plan as it relates to the County's northern shoreline.
3. BCDC staff has previously resisted considering Bay Plan amendments
which would reduce the areas classified for water-related industry
until regional studies were carried out. BCDC staff now expects to
present the results of a regional study to its commission later in
1986. Previous studies by the County Planning Department (1984) and
the applicant for the City of Martinez' project (1985) demonstrated
that there was virtually no demand for traditional water-related in-
dustry in this area.
4. The proposed amendment includes the IT Corporation Class I processing
facility, the Martinez Gun Club, and the Henry's Tree Service proper-
ties. because these are physically enclosed by the Acme Fill Corpora-
tion property and the Pacheco Creek channel ., Generally, the portion
of the Acme property lying south of the Vine Hill residential area
does not appear to be covered by the BCDC Bay Plan. A related amend-
ment proposed by the City of Martinez would include the remaining area
east of I-680 lying between Waterfront Road, the Acme landfill , and
Arthur Road.
