Legislation - AB 613 (Moore) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION Recommendation: Adopt a position in opposition to AB 613 by Assemblywoman Moore. Background: AB 613, as amended July 3, 1986 would require employers, including counties, to grant employees - both male and female - leaves of absence of up to four months for child-rearing purposes. During such a leave the employee could use any accrued vacation leave, other accrued time off and accrued sick leave. The bill in no way implies that a' child must be ill to entitle the employee to a leave of absence for child- rearing purposes. This concept would require Contra Costa County to pay sick leave in cases in which such payments are not currently made. By doing so AB 613 substantially increases the County' s costs. However, the only provision made to reimburse counties for these increased costs is through the State Mandates Claims Fund. Contra Costa County presently allows the use of sick leave only for cases of illness, injury or for medical care. Regardless of the possible merits of the bill as a whole, the inadequate reimbursement mechanism creates an inadequately funded, if not unfunded, state mandate and on at least that basis should be opposed by the Board of Supervisors. AB 613 has passed the Assembly and is scheduled to be heard in the Senate Appropriations Committee on August 13 , 1986.
