SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
_ Recommendation:
Adopt a position of support for AB 49 by Assemblyman Elder.
Background
AB 49 would enact the Local Toxics Enforcement and Training Act of 1986.
The bill would establish within .the Office of Criminal Justice Planning
a program to provide grants to provide training programs in the
enforcement of hazardous materials laws for peace officers, local public
health and environmental health officers and local public prosecutors.
The grants would be designed to enhance local hazardous materials
enforcement efforts.
AB 49 would also require the Commission on Peace Officer Standards . and
Training (],OST) to provide courses to train local peace officers with
the detection of violations and apprehension of suspected violators of
state and local hazardous materials laws.
The bill also authorizes the Executive Director of the Office of
Criminal Justice Planning to award grants to the California District
Attorney' s Association and the California Association of Environmental
Health Administrators to provide specified courses in the enforcement of
state and local hazardous materials laws.
AB 49 also requires the Office of Criminal Justice Planning to award
nine one-year pilot project grants of up to $150,000 each to local
jurisdictions. These projects shall fund additional staff in the
District Attorney' s offices in developing hazardous materials
enforcement cases.
AB 49 appropriates $1,974,000 to carry out the provisions of the bill.
In that AB 49 has the potential to assist law enforcement agencies,
public prosecutors and health officials to enforce and successfully
prosecute violations of hazardous materials laws, it furthers
established policies of the Board of Supervisors and deserves the
Board' s support.
AB 49 has passed the Assembly and was scheduled to be heard in the
Senate Appropriations Committee on August 13 , 1986.
