HomeMy WebLinkAboutMINUTES - 08121986 - T.8 THE BOARD OF SUPERVISORS OF CONTRA COSTA 'COUNTY, CALIFORNIA T.8 Adopted this Order on August 12, 1986 , by the following vote: AYES: Supervisors Schroder, McPeak, Torlakson, Powers NOES: None ABSENT: Supervisor Fanden ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Hearing on appeal of Eduardo Cortes on decision of the San Ramon Valley Area Planning Commission on application of Seal Beach Business Center, Subdivision 6703, Development Plan 3009-86 in the Alamo/Roundhill area This being the time set for hearing on the appeal of Eduardo Cortes from the San Ramon Valley Area Planning Commission approval of the application of Seal Beach Business Center (applicant and owner) for final development plan 3009-86 for a 42 unit single family residential development and open space area and a tentative subdivision map (Subdivision 6703) in the Alamo/Roundhill area; and Supervisor Schroder commented that a letter from Mr. Cortes withdrawing his appeal had been received by the Clerk of the Board on August 11 , 1986 . He questioned whether there should be a hearing on this appeal or not. Harvey Bragdon, Director of Community Development , advised that subsequent to Mr. Cortes filing an appeal there were other letters submitted in support of the appeal. Supervisor Schroder commented that since someone else might have appealed if Mr. Cortes had not that the hearing should proceed. Harvey Bragdon described the property site, and noted that the project was consistent with the General Plan Amendment. The following persons appeared to testify: Eudardo Cortes, 10 Alamo Glen, Danville, commented that the reason for filing his appeal was that at the time of the appro- val by the San Ramon Valley Area Planning there were five items that he and the developer had not been able to resolve. Since filing the appeal, the concerns were met and resolved; The Chairman read a card from Dorothy James, 2431 Alamo Glen Drive, Danville, who did not wish to testify but objected to the Seal Beach Development. The Chairman also read a card from Madeline Putney, 2418 Alamo Glen Drive, Danville, who did not wish to testify, but wished to object to the Seal Beach Development . Don Mann, 19 Alamo Glen Court, Danville, expressed con- cerns including the sizes of the lots, the common property, the possibility of landslides, and the stub for the extension of Royal Oaks Drive; Arthur James, 2431 Alamo Glen Drive, Danville, expressed concerns including the stub and the density of the project; Michael Fiorenza, 15 Alamo Glen Court, Danville, expressed concern with the size of the lots; L . Solteau, 20 Alamo Glen Drive, Danville, expressed con- cerns including lot sizes and the steepness of the terrain. Lorraine Solteau, 20 Alamo Glen Trail , Danville, commented that she wished to file an appeal on other issues than the ones raised by Mr. Cortes. and wished to have more time to prepare. She also commented on the lot size and the stub road; James R. Steadman, 365 Lennon Lane, Suite 100 , Walnut Creek, Civil Engineer, representing Seal Beach Centers, Inc. , com- mented on the history of the project and the many hearings on the project. He also commented on the geologic studies and the open space, and advised that he was of the opinion that the project had been well conceived and planned and had the approval of the Alamo Improvement Association, the Roundhill Property Owners Association and the San Ramon Valley Area Planning Commission. Eduardo Cortes, 10 Alamo Glen, Danville, spoke again com- menting on the stub street and that his concerns had been met and he would rather go with a familiar project than to start over with a new one. The Chairman closed the public hearing. Supervisor Schroder recommended denying the appeal and approving the recommendation of the San Ramon Valley Area Planning Commission, requiring all of the conditions to be adhered to strictly and suggested that at a later date, the Board might give consideration to the abandonment of that stub street if and when it is determined it will not be required for the development of a pro- ject to the south. The Board considered the matter and IT IS BY THE BOARD ORDERED that the recommendation of Supervisor Schroder is APPROVED and that the appeal of Eduardo Cortes is DENIED and the decision and reasons of the San Ramon Valley Area Planning Commission in approving the application of Seal Beach Business Center, Subdivision 6703 and Development Plan 3009-86 with conditions are upheld. #hereby certify that this is a true and correct copy of an action taken and entered on the;Minutes of the Board of Supervisors on the shown.
