HomeMy WebLinkAboutMINUTES - 08121986 - 2.2 �• z THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August 12, 1986 , by the following vote: AYES: Supervisors Schroder, McPeak, Torlakson, Powers NOES: None ABSENT: Supervisor Fanden ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Final Environmental Impact Report and Site Acquisition of the West County Justice Center The Board considered the recommendation of the County Administrator and Director .of the Community Development Department to adopt a resolution approving the final Environmental Impact Report (EIR) and authorizing the Real Property Division staff of the Public Works Department to take the necessary actions to acquire the West County Justice Center -site referred to as Site A in the EIR. Charles Zahn, staff member of the Community Development Department, described the environmental review process . He advised that there are significant environmental effects noted in the EIR that are mitigatible. Mr. Zahn noted that noise during construction and violations of air quality resulting from cumulative increased traffic were significant impacts that would not be fully mitigated. He referred to the mitigation measures set forth in the EIR. Mr. Zahn concluded his presentation by noting that the Planning Commission, in its capacity. as the County hearing body for environ- mental impact reports, adopted resolution #42-1986 certifying the final EIR for the project . Chairman Powers then opened this matter for hearing. Lucretia Edwards, President, Contra Costa Shoreline Parks Commission, 237 Bishop Avenue, Richmond, expressed concern with the proximity of the proposed Justice Center to the Pt. Pinole Shoreline Park with the entry of the jail so close to the entrance of the park. David E. Pesonen, East Bay Regional Park District, 11500 Skyline Boulevard, Oakland 94705, referred to a resolution adopted by the Board of Directors of the Park District expressing reser- vations relative to the proposed mitigation measures. He advised that if Site A is chosen, he did not believe the proposed mitigation measures are sufficient. Mr. Pesonen proposed moving the entrance . of the Justice Center to a position north of the main entrance of the park. He also proposed developing a site specific plan for the whole area and requested assurances providing protections for the park, particularly along the Southern Pacific right-of-way. Supervisor Powers• recommended that Mr. Pesonen' s concerns be referred to the County Administrator with instructions to meet with representatives of the Park District and Sheriff' s Department on the issues and report to the Board in one week. He also recom- mended that the issue of the site specific plan be referred to the City of Richmond since this area is in the City' s jurisdiction. John Knox, attorney representing Pinole Point Properties, Inc . , 229 Bishop Avenue, Richmond, commented on his client' s plans for development of this industrial site and suggested that the County look for another site for the project. He questioned the validity of the data contained in the EIR. Mr. Knox inquired as to the County' s plans for future expansion of the Justice Center if located on Site A, and the impact this might have on his client' s future development plans. Mr. Knox questioned potential geotech- nical problems of all sites considered and the financial implica- 1 tions both to his client as well as the County. He recommended appointing Marshall Wais, President of Pinole Point Properties, to the West County Justice Center Citizens Advisory Committee. Mr. Knox urged the Board to not approve the EIR but to direct staff to look for another site for the West County jail . Kent Fickett, Mt. Diablo Audubon Society, 3960 N. Peardale, Lafayette, advised that he concurred with Mr. Knox' s comments on the project. With so many people using the park, Mr. Fickett requested implementation of conditions to mitigate impact of the jail on the park , providing protections to the park and surrounding area, and establishment. of a limit relative to future expansion of the Justice Center. In addition, Mr. Fickett proposed that the County purchase the Bruner site and donate it to the Park District. Jean Siri , West Contra Costa Conservation League, 1015 Leneve Place, E1 Cerrito, expressed opposition to the placement of the jail in the proximity of the Pt. Pinole Park, questioned the hearing noticing procedure on the project, and expressed preference for the "Atlas Road" site (Site B) . William Siri , Save San Francisco Bay Association (no address given) , advised of the Association' s opposition to construc- tion of the Justice Center on Site A. Art Schroeder, West County Gray Panthers, 706 Seaview Drive, E1 Cerrito, expressed disapproval of the jail so close to the entrance to the park . All persons desiring to speak having been heard, the Chairman declared the public hearing closed. Board members discussed the issues presented by the speakers and agreed to defer action pending a report from staff. Therefore, IT IS BY THE BOARD ORDERED that decision on the EIR and site acquisition of the proposed West County Justice Center is DEFERRED to August 19 , 1986 . IT IS FURTHER ORDERED that the County Administrator and Community Development Director are REQUESTED to report on concerns raised in public testimony relative to potential sites considered for the project including references to geotechnical and seismic problems at sites under consideration, the sufficiency of the EIR, the issue of the project' s impact on access to Pt. Pinole Shoreline Park, the intent of the County relative to future expansion of the new facility, and the appointment of Marshall Wais to the West County Justice Center Citizens Advisory Committee.
