HomeMy WebLinkAboutMINUTES - 08121986 - 2.1 � l THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August 12, 1986 , by the following vote: AYES: Supervisors Schroder, McPeak, Torlakson, Powers NOES: None ABSENT: Supervisor Fanden ABSTAIN: None -------------------------------------------------------------------- SUBJECT: Permanent School Fees In response to Board request of July 22, 1986 the Board received a report dated July 31 , 1986 from Victor J. Westman, County Counsel, relating to the ability of Counties and cities to adopt regulations imposing fees to finance permanent school facilities. Mr. Westman commented on recent California Supreme Court decisions that authorized the use of developer fees for permanent school facil- ities. Mr. Westman advised that his office is in the process of developing a draft fee ordinance that would enable the County to adopt additional school facility fees when clearly related to the specific impacts of development. Supervisor Sunne McPeak commented on the responsibility of the State to finance school construction. She stated that there is a need to explore whether or not there will be any thrust in the legislature to deal significantly with school facility financing. Supervisor Robert Schroder noted that there have been a number of bond issues for school construction approved by the voters. He advised that he would be reluctant to move forward on any addi- tional school fees until the responsibility of the State for school facility financing is determined. Supervisor Tom Powers noted that there did not seem to be a desire on the Board' s part to move forward with a fee ordinance at this time, and suggested that the matter be referred to County Counsel to draft a fee ordinance for presentation to the Internal Operations Committee. Supervisor Schroder requested that staff review the allo- cation of bond funds, and the feasibility of a general obligation bond measure that the school districts might utilize to finance school construction. There being no further discussion, IT IS BY THE BOARD ORDERED that the report from County Counsel relating to permanent facility school fees is ACCEPTED. IT IS FURTHER ORDERED that the draft school fee ordinance to be drafted by County Counsel is REFERRED to the Internal Operations Committee (Supervisors Fanden and McPeak) for review. IT IS FURTHER ORDERED that the County Administrator is REQUESTED to pursue the issues of the State' s obligation to finance school construction and the feasibility of a general obligation bond measure. 1 hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown.
