Calderon (applicant & owner) , Pacheco area This being the time for hearing on the recommendation of the County Planning Commission with respect to an application filed by Juan A. Calderon (2675-RZ) to rezone .27 acres of land in the Pacheco area from Single Family Residential District (R-7) to Multiple Family Residential District (M-29) together with Development Plan No. 3024-86 requesting approval of a multiple family residential project; and Harvey Bragdon, Acting Director of Community Development, described the property site and advised that a Negative Declaration of Environmental Significance was posted for this project. Juan A. Calderon, 2277 Arcadia Court, Martinez, applicant and owner commented that he was in agreement with the conditions set forth by the Planning Commission. Mrs. B. Meyers, 113 1st Avenue South, Pacheco, expressed concern with the manner of noticing the neighborhood regarding the hearing on this project. She commented that she was not specifi- cally opposed to this project but was concerned with park dedication fees and development in general in the Pacheco area. The Chairman requested that Mr. Bragdon send a memo to Supervisor McPeak indicating Mrs. Meyers concerns and inform Mrs. Meyers of the amount of money in the park dedication fund for Pacheco. The Chairman closed the public hearing. The Board considered the matter. IT IS BY THE BOARD ORDERED that the rezoning application 2675-RZ is APPROVED as recom- mended by the Planning Commission and that Development Plan No. 3024-86 is also approved subject to revised conditions imposed by the Planning Commission and the Board of Supervisors as set forth in Exhibit A attached hereto and by reference incorporated herein, and the Board hereby adopts the Planning Commission' s reasons, set forth in its Resolution Number 28-1986 as its determinations for this decision. Development shall be as shown on plans submitted with the application dated received April 10, 1986. This approval is for three (3) residential units only. 2. The following shall be shown on plans for review and approval by the Zoning Administrator prior to issuance of a building permit. A. Revised plans shall be submitted for review and approval by the Zoning Administrator reducing the number of units from four to three. Required guest parking shall be on site and parking shall conform to the County parking ordinance. B. The proposed building shall be stepped as it related to the slope on the site with at least one vertical separation of 2 feet or more. C. Provide for a wall or solid fence parallel to the building at the unit entrance areas with supporting posts to a trellis or similar cover extending to the building to help mitigate traffic noise and provide transition to the entrance areas. D. Provide for screening of parking as viewed from the street and provide conforming backup distances. Carports shall be of wood structure or wood covered structure. E. A solid 6 foot high fence shall be constructed adjacent to existing residences along the south boundary to within 15 feet of the street right of ways. F. Refuse areas shall have suitable enclosures. 3. Prior to issuance of a building permit, evaluations and architectural design of the building and other structures, including carport, trash enclosures, etc. , shall be subject to final review and approval by the County Zoning Administrator. The roofs and exterior walls shall be free of such objects as air conditioning equipment, television aerials, etc. , or screened from view. All units shall have house numbers or unit identifi- cation visible at all times which may require illumination. 4. Comply with the landscape and irrigation requirements as follows: A. Prior to issuance of a building permit, a landscape and irrigation plan shall be submitted for review and approval by the County Zoning Administrator. Landscaping and irrigation shall be completed prior to occupancy. B. Significant landscaping shall be provided at the frontage and bound- aries of the site. All initial landscaping shall be of a size so that a mature appearance will be attained within approximately three years of planting. A 2. (Revised Conditions) 5. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 meters of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures. 6. Variances are approved as indicated on the submitted plans to have less than the required setback and sideyard and to have building height in excess of 20 feet within 50 feet of an R-7 district. They meet the requirements of Section 26-2.2006. 7. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drain- age) of the Subdivision Ordinance, unless exceptions are specifically granted. B. The applicant shall prove the adequacy of the downstream ditch system between "C" Street and Grayson Creek, particularly in the immediate vicinity of the subject property. C. Construct curb, 4-foot 6-inch sidewalk (width measured from curb face), necessary longitudinal and transverse drainage, and necessary pavement widening on "C" Street. The face of curb shall be located 9 feet from the widened right of way line. D. Construct curb, 4-foot 6-inch sidewalk (width measured from curb face) , necessary longitudinal and transverse drainage, and necessary pavement widening on the remainder of the Deodar Drive frontage. The face of curb shall be located 10 feet from the widened right of way line. E. Widen the existing Center Avenue sidewalk to a 6-foot 6-inch width. F. Restrict access along Center Avenue including the curb returns. G. Construct the on-site driveway system to current County private road standards with a minimum width of 16 feet. H. Install all new utility distribution services underground. I. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalks and driveways. J. Furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. 3. (Revised Conditions) K. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Engineering Services Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signage and striping plans for review by the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Engineering Services Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Department. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post bonds required by the agreement to guarantee completion of the work. L. Contribute $1,030 per dwelling unit to a Road Improvement Fee Trust (Fund No. 819200-0800) designated for road improvements to the area of the proposed West Concord Area of Benefit. The following statements are not conditions of .approval , however, the applicant should be aware of these comments prior to attempting to secure building permits. A. The Building Inspection Department: 1. A grading permit may be required for the earthwork necessary for this proposal . 2. Submit four (4) copies of plans showing the existing contours, the extent of the proposed grading, drainage improvements and general site development. 3. Plans accompanying the application for building permits shall show the existing contours, the extent of the proposed grading and drainage improvements, and be reviewed by the Grading Section prior to issu- ance. 4. Prior to issuance of building and/or grading permits for this proposal , a preliminary soil investigation report prepared by a licensed soil engineer will be required. It shall report on the ability of the site to support the improvements anticipated, and shall include recommended foundation designs to achieve maximum stability of the proposed structures. 5. A licensed soil engineer may be required to control grading operations and to report on the ability of the site to support the improvements anticipated. BT/aa Revised 6/10/86 UWE q
