(applicant) and Ray & Joann Hosking (owners) , Pleasant Hill/BART Station area This being the time for hearing on the recommendation of the County Planning Commission with respect to the application filed by Jerry Loving & Associates, Inc. and Ray & Joann Hosking (2643-RZ) to rezone approximately 2.78 acres of land in the Pleasant Hill BARTD Station area from Single Family Residential District (R-15) to Planned, Unit District (P-1 ) together with Development Plan No. 3049-85 requesting approval of 78 residential units; and Harvey Bragdon, Acting Director of Community Development, described the property site and advised that an environmental impact report was prepared for the project and was certified as being ade- quate by the County Planning Commission. The Chairman opened the public hearing and no one appeared in opposition. The--Chairman closed the public hearing. The Board considered the matter. IT IS ORDERED that rezoning application 2643-RZ is approved as recommended by the Planning Commission and that Development Plan 3049-85 is also approved subject to conditions imposed by the Planning Commission and the Board of Supervisors as set forth in Exhibit A attached hereto and by reference incorporated herein, and the Board hereby adopts the Planning Commission' s reasons, set forth in its Resolution Number 31-1986 as its determinations for this decision. IT IS FURTHER ORDERED that Ordinance No. 86-53 giving effect to the aforesaid rezoning is INTRODUCED, reading waived and July 22, 1986 is set for adoption of same. This approval is based on the Development Plan submitted with he application subject to further review and approval and subject to the following conditions: 2. Development shall be in general accordance with the following exhibits as modified by the conditions listed below and subject to the Final Development Pian review process. Exhibit #1 - Preliminary Site and Landscaping Development Plan. Exhibit #2 - Typical Unit Plans. Exhibit #3 - Details. Exhibit #4 & #5 - Project Elevations 3. This approval is limited to a maximum of 29 units per net acre but no more than 78 units. 4. Prior to the issuance of building permits, the applicant shall submit for final review and approval by the Zoning Administrator the following: A. Final landscaping and irrigation plans together with a cost estimate or copy of contract for landscaping improvements shall be submitted with the plan. Landscaping and irrigation shall be installed prior to occupancy. B. The recently adopted County Water Conservation Landscaping Program shall serve as th basis for the plan. C. Individual unit, building and project meter and utility connections shall be shown on the landscaping plan and appropriately screened. On-site field inspection of landscaping prior to occupancy will result in additional landscaping requirements if such meters etc. are not adequately addressed. D. The final landscape and irrigation plan shall show all trees to be removed/retained. A program for preservation and protection of trees to be retained shall be included. The plan shall be in accordance with the landscape strategies listed in the Environmental Impact Report. The plan shall include mitigation measures for tree preservation as called out in the EIR. This plan shall be submitted for final review by the Zoning Administrator and approved prior to any site work on issuance of a grading permit. E. Utility lines and trenches shall be relocated to avoid any disruption to the root system of the existing oak trees. LAMM A Page 2 F. A tree expert should be present during initial phase of site development to ensure proper grading near tree roots. G. Minimum 15 gallon trees and 5 gallon shrubs shall be required. H. Where possible landscaping within the parking area shall be similarly located on both sides of the driveway . within the driveway narrowed to 20 feet and shall incorporate canopy trees. I. Special attention shall be given to landscaping at the entry drive. J. The City of Walnut Creek shall be consulted on the street tree selection. 5. There may be one sign allowed for project identification purposes only permitted subject to the review and approval o the Zoning Administrator. The sign may be located within the landscaped setback of the front property line. 6. The applicant shall provide a minimum of 105 and a maximum of 164 parking spaces on-site. Seventy-eight covered parking spaces shall be individually assigned to units. A minimum of 10 guest spaces shall be provided and clearly marked and maintained for short term guest usage. The applicant shall investigate and report to the County Zoning Administrator buyer profiles of similar nearby projects to justify the need for parking in excess of 105 spaces. The applicant shall request of the County Public Works Department permission to install "no parking" or "no parking between 9-11" sign along the Oak Road frontages. 7. No recreational vehicles shall be parked on site. 8. The applicant shall work with staff to incorporate as appropriate additional sloped roof carport structures. 9. The applicant shall submit color samples for the review and approval of the Zoning Administrator prior to issuance of a building permit. 10. Widen the entry driveways to 25' . 11. The trash enclosures adjacent to the northerly property line shall be relocated to reduce noise impacts to the neighboring residences. 12. There shall be a suitably enclosed area provided for the purpose of locating recycling bins for paper, glass and cans. The enclosure shall not be less than 10' x 12' in area and at least 6' high. DENY A Page 3 13. The applicant shall comply with the Park Dedication Ordinance (currently $400.00/unit) . 14. Each residential unit shall have a house number clearly visable from the street 24-hours a day. 15. Prior to issuance of any grading or building permit, _a soil and foundation report mitigating any potential for earthquake-induced for earthquake-induced liquifaction shall be submitted for review and approval of the Planning Geologist. Allow 45 days for review. Building Department permit plans shall implement recommendations of the soil and foundation report. 16. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 meters of these materials shall be stopped until a professional archeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 17. Comply with drainage, road improvement, traffic and utility require- ments as follows: A. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance, unless exceptions are specifically granted. This includes the following: 1) If at the time building permits are applied for, Line D-2 of Drainage Area 44B and Line D of Drainage Area 44B north to the north side of Todd Lane have been constructed or bonded by Subdivision 6670: collect and convey storm water to those storm drains. 2) If at the time building permits are applied for, the por- tions of Line D-2 and Line D discussed above have not been installed or bonded by Subdivision 6670: install those sections of Line D-2 and Line D of the Drainage Area 44B Plan from the easterly property line of the site to the north side of Todd Lane. 3) Convey to the County, by Offer of Dedication, a drainage easement along a portion of the easterly property line for the installation of Line D-2. The exact location and width of this easement to be determined by the Flood Control district in coordination with the applicant and the owners of properties adjacent to the site. Page 4 4) Installing, within a dedicated drainage easement, any portion of the drainage system which conveys run-off from public streets. B. Unless exceptions are specifically granted, comply with the requirements of Division 1006 (Road Dedication and Setbacks) of the County Ordinance Code. This includes the following: 1) Construct a sidewalk (width measured from curb face) along the frontage of Oak Road that is consistent in width with other existing or approved projects but not less than 14-foot 6-inch in width. 2) Install street lights on Oak Road. The final number and location of the lights shall be determined by the County Traffic Engineer. 3) Relinquish abutter's rights of access along Oak Road with the exception of the two access ways as shown on the devel- opment plan submitted with the application for this project. C. Construct the on-site driveway system to current County private road standards with a minimum width of 20 feet. D. Install all new utility distribution services underground. E. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalk and driveways. F. Furnish proof to the Public Works Department, Engineering Servic- es Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. G. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Engineering Services Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signage and striping plans for review by the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Engineering Services Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Depart- ment. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post bonds required by the agreement to guarantee completion of the work. Prior to the issuance of building permits, deposit (with the County of Contra Costa) a fee of $2,300 per new residential unit designated toward drainage, road and transit improvements in the Pleasant Hill BART Station Specific Plan Area. This fee will be increased annually in accordance with the State Highway Construc- tion Cost Index. The cost of Oak Road frontage improvements and Drainage Area 44B drainage improvements and related plan review and inspection fees, and engineering costs may be credited toward this fee obligation. 18. The applicant is required to comply with the Pleasant Hill BART Area TSM Ordinance. The required TSM program shall be submitted prior to the issuance of any building or grading permits. No final inspection shall be conducted until the TSM Program is approved. 19. The applicant agrees to construct the perimeter fence of solid wood board construction with no gaps - 6' high above the highest finished grade adjacent to the fence.
