SUBJECT: SB 878 Expenditure Plan and Retail
Transactions and Use Tax Ordinance
Chairman Powers convened the hearing on the SB 878
Expenditure Plan and retail transactions and use tax ordinance and
resolution placing said ordinance on the November 4, 1986 ballot for
voter approval.
Barbara Neustadter, Deputy Director of Transportation,
Community Development Department, commented on the long hours spent
by all those who participated in the development of the Expenditure "
Plan. She advised that the Plan provides a split of 53% for roads
and 47% for transit, as well as providing for the establishment of a
nine member Transportation .Authority with representation from all
parts of the County. She noted that County Counsel had prepared a
retail transaction use tax ordinance and that the appropriate ballot
language to place the measure on the November ballot would be pre-
sented to the Board next week.
Chairman Powers opened the public hearing and invited
anyone wishing to speak to come forward.
Don Christian, representing the Contra Costa Taxpayers
Association, expressed his organization's support of the retail
transaction use tax ordinance, and urged that it be placed on the
ballot for voter approval in November.
Ted Nelson, 25 Emerson, Crockett, commented on the long-
standing transportation problems in Contra Costa County, and urged
the Board to support the Expenditure Plan and ordinance.
Bill Sullivan, 3301 Loreto Drive, San Ramon, expressed the
belief that an additional half cent sales tax would not provide a
solution to the transportation problems in the County, and urged the
Board to instead concentrate on moderating growth and utilizing the
resources already available in the County.
Paul Hughey, representing the Coalition of Labor and
Business (COLAB) advised that COLAB strongly supports the Expenditure
Plan and urged the Board to place the measure on the November ballot.
Phyllis Roff, 2893 San Carlos, Walnut Creek, noting that
there doesn' t appear to be any other source of funding to solve the
transportation problems, urged the Board to place the measure on the
ballot to give the public an opportunity to vote on the half cent
sales tax increase.
Supervisor Tom Torlakson stated that there no longer is
Federal and State funding available to solve the transportation
problems of the County. He noted that a gas tax would be a more
logical users type of tax but advised that recent efforts to exempt
a gasoline tax from the Gann limitation have failed. Supervisor
Torlakson commented on the County-wide General. Plan Review in
progress to deal with growth and planning issues, and noted that the
Expenditure Plan and half cent sales tax increase is one part of the
overall effort to solve transportation problems in Contra Costa

County. He moved that the SB 878 Expenditure Plan be approved and
that the issue of the ballot language for placement of the measure
on the November ballot be deferred one week.
Supervisor Robert Schroder seconded the motion, and noted
that the Expenditure Plan and use tax ordinance is the culmination
of a three year process of developing consensus within all the
jurisdictions in Contra Costa County. He commended all who par-
ticipated in the development of the Plan. He stated that the
Metropolitan Transportation Commission (MTC) had determined that the
Plan is in conformance with the regional transportation plan and
that the funding recommendations are realistic. Supervisor Schroder
stated that MTC unanimously approved the SB 878 Expenditure Plan.
Supervisor Sunne W. McPeak noted that the Expenditure Plan
and use tax ordinance is an important part of the overall comprehen-
sive efforts to provide a solution to the transportation problems in
the County, and expressed her strong support of the measure.
Supervisor Nancy Fanden noted that the time has come to do
something about the transportation problems of the County and
expressed her support of the Expenditure Plan and use tax ordinance.
Supervisor Tom Powers expressed his belief that the general
public supports the Expenditure Plan and feels that it is an
appropriate expenditure of public funds.
There being no further discussion, IT IS BY THE BOARD
ORDERED that the SB 878 Expenditure Plan is APPROVED.
IT IS FURTHER ORDERED that adoption of the retail transac-
tion and use tax ordinance and the resolution placing said ordinance
on the November 4, 1986 ballot for voter approval is DEFERRED to
August 59 1986 .
