6 The Board of Supervisors of Contra Costa County, California,
7 by vote- of two-thirds or more of its members , RESOLVES that :
8 Pursuant to Government Code Section 25350 . 5, and Streets and
9 Highway Code Section 943 , Contra Costa County intends to construct
10 a road reconstruction project , a public improvement , to repair San
11 Pablo Ave . , in the Crockett area , and , in connection therewith ,
12 acquire interests in certain real property.
13 The property to be acquired consists of three parcels and is
14 generally located in the Crockett area on San Pablo Ave . , approxi-
15 mately 1, 000 feet west of Merchant Street . The said property is
16 more particularly described in Appendix "A" , attached hereto and
17 incorporated herein by this reference .
18 On July 8, 1986 , this Board passed a resolution of intention
19 to adopt a resolution of necessity for the acquisition by eminent
20 domain of the property described in Appendix "A" (Resolution No.
21 86/391 ) and fixing July 29, 1986 , at 10:30 a .m. , in its Chambers
22 in the Administration Building, 651 Pine Street , Martinez,
23 California , as the time and place for the hearing thereon .
24 The hearing was held, at that time and place , and all
25 interested parties were given an opportunity to be heard and based
26 upon the evidence presented to it , this Board finds , determines
27 and hereby declares the following:
.28 1 . The public interest and necessity require the proposed

1 project : and
2 2. The proposed project is planned and located in the manner
. 3 which will be most compatible with the greatest public good and
4 the least private injury;
5 3 . The property described herein is necessary for the .pro-
6 posed project ; and
7 4. -The offer required by Section 7267.2 of the Government
8 Code was made to the owners of record.
9 The County Counsel of this County, and any special counsel
10 associated by him, is hereby AUTHORIZED and EMPOWERED:
11 To acquire in the Agency' s name, by condemnation , the titles ,
12 easements and rights of way hereinafter described in and to said
13 real property or interest (s ) therein, in accordance with the
14 provisions for eminent domain in the Code of Civil Procedure and
15 the Constitution of California;
16 To prepare and prosecute in the County' s name such proceedings
17 in the proper court as are necessary for 'such acquisition:
18 1 . Parcels 1, 3, and 4 as permanent slope easements
19 To deposit the probable amount of compensation , based on an
20 appraisal , and to apply to said court for an order permitting the
21 County to take immediate possession and use said real property for
22 said public uses and purposes .
23 PASSED and ADOPTED on July 29s 1986 , by the following
24 vote:
25 AYES : Supervisors Fanden, Schroder, McPeak, Torlakson and Powers
26 NOES : None
27 ABSENT: None

R/W Parcel 1 (Slope Easement)
A portion of those parcels of lana described in instruments to the Southern
Pacific Canpany recorded December 221 1922 in Book 429 of Deeds at page 216
and to the Southern Pacific Railroad Company recorded March 9, 1927 in Book
83 of Official Records at page 83, all records' of Contra Costa County,
California, described as follows:
Carmencing at the easterly terminus of the center line course south 78° 48'
east 1054.47 feet of the 80.00 feet in width strip of land as described in the
deed to the State of California recorded April 8, 1929 in Book 178 at page
155 of Official Records of Contra Costa County; thence from said point of
commencement north 110 12' 00" east 40.00 feet to the northerly right of way
line of San Pablo Avenue and the Point of Beginning of the following described
parcel of land; thence from said Point of Beginning north 780 48' west 38.78
feet to the westerly line of said Southern Pacific Railroad Company parcel (83
OR 83) ; thence along said westerly line, north 60 17' 45". east 11.36 feet to
the most southerly corner of said Southern Pacific Ccupany parcel (429 D 216)
from which a radial line of a curve concave to the northeast having a radius
of 170.00 feet bears north 300 24' 40" east; thence along the southwesterly
line of said parcel (429 D 215) northwesterly along the arc of said curve
through a central angle of 120 40' 20", a distance of 37.60 feet; thence north

A portion of the Rancho Canada del Hambre, Northern Part being a portion of
PARCEL FOUR as said parcel of land is described in deed to Wickland Oil
Terminals, a California Corporation, recorded October 21, 1991 in Book 10543
at page 185 of Official Records of Contra Costa County, California, described
as follows:
Beginning at the northeasterly corner of said PANEL FOUR (10543 OR 185) at
the southerly line of San Pablo Avenue formerly known as Highway 40, from
which a radial line of a curve concave to the north having a radius of 740.00
feet bears north 70 40' 07" east; thence from said point of beginning along
the northerly line of said PARCEL FOUR, westerly along the arc of said curve
with the radius of 740.00 feet through a central angle of 30 31' 53", a
distance of 45.61 feet; thence north 780 48' 00" west 50.00 feet; thence
leaving said northerly line, south 40.77 feet to a point on a line which is
parallel with and 40.00 southerly (right angle measure) frau the southerly
line of said San Pablo Avenue; thence along said parallel line south 780 48'
00" east 42.08 feet; thence along the arc of a tangent curve, concave to the
north having a radius of 780.00 feet through a central angle of 30 55' 36", a

Beginning at the northeasterly line of said 100.00 feet in width strip of land
(174 OR 203) at the westerly line of that parcel of land described in the
instrument to the Southern Pacific Railroad Cempany recorded March 9, 1927 in
Book 83 at page 83 of Official Records of Contra Costa County; thence from
said. Point of. Beginning along said westerly line (83 O.R. 83) south 60 17' 45"
west 11.36 feet to the northerly line of that 80.00 feet in width strip of
land described in deed to the State of California recorded April 8, 1929 in
Book 178 at page 155 of Official Records of said County; thence along said
northerly line, north 780 48' 00" west 128.22 feet; thence leaving said line,

the said northeasterly line of said 100.00 feet in width strip of land (174 OR
203) ; thence along said line south 46° 55' 00" east 64.53 feet; thence south-
