RECOMMENDED ACTION
ADOPT five additional policy statements concerning control of the solid wastestream, solid
waste imports, local , host community mitigation, landfill classifications, and transfer
stations to the Solid Waste Management Policy statements approved by the Board on May 20,
1986 as recommended by the Solid Waste Commission.
FINANCIAL IMPACT
No direct costs to the County, however, if implemented, the policy statements could result
in a cost' increase tofgarbage service rate payers.
REASONS FOR RECOMMENDATION/BACKGROUND
On May 20, 1986, the Board of Supervisors approved a series of policy statements and
recommendations from the Solid Waste Commission concerning solid waste matters. In the same
action, the Board referred eight issues to the Solid Waste .Commission for further study and
recommendation. The above five policy statements address six of the eight issues referred
to the Commission. The remaining issues concern recycling, on which the Commission will
report after completion of the Recycling Planning Study in August or September. It is
appropriate to add the following five policy statements to those approved earlier by the
Board.
CONTROL OF THE WASTESTREAM
Public agencies should acquire the ability to direct their solid wastestream to transfer
stations, resource recovery facilities, and landfills through renegotiation of franchise
agreements. In the future, there may be a need to assign solid waste from communities to
various facilities in conformance with the Solid Waste Manaqement Plan. The Solid Waste

Management Plan must be approved by a majority of the cities containing a majority of the
incorporated population and the Board of Supervisors. Modifications to franchise agreements
should also state that the public agency will assign waste from their jurisdiction in
accordance with a duly approved County Solid Waste Management Plan. Public agencies should
work closely with the private sector in developing the County Solid Waste Management Plan.
SOLID WASTE IMPORTS FROM OTHER COUNTIES
All solid waste imports shall be consistent with the County Solid Waste Management Plan
(CSWMP). .This requires landfill operators to apply to the Board of Supervisors for a
Consistency Determination for any new proposed import. If the import is found not to be
consistent with the existing CSWMP, the CSWMP will have to be amended to include the
import. If an amendment to the CSWMP is required, the amendment shall be applied for by
the landfill operator. Renewal, or extension, of agreements for existing imports from
other counties will also be subject to the same review for new imports. This policy
applies only to "contracted waste" where the landfill operator has an agreement with either
a hauler or a governmental agency to accept waste for disposal at the landfill. Existing
agreements aretobe filed with the County Community Development Department.
In considering requests for importation rights requiring the approval of an amendment to
the CSWMP, local officials in Contra Costa County should consider the following:
1. The economic impact of accepting the imported waste in terms of loss of landfill
capacity which will lead to added expense to Contra Costa County residents in the
future.
2. Environmental impacts such as traffic, litter, etc.
3. The county of origin's need to export the waste, including landfill and other
disposal alternatives and other reasons why disposal in Contra Costa County is
necessary.
4. Mitigation proposed by the landfill operator and/or the exporting jurisdiction.
LOCAL HOST COMMUNITY MITIGATION
Local host community mitigation means mitigation measures beyond traditional mitigation
required by the California Environmental Quality Act (CEQA) . In order to compensate
communities for impacts not covered by the CEQA process, proponents of new, expanded, or
modified solid waste projects shall be required to meet with the impacted community to
discuss project impacts and mitigation.
LANDFILL CLASSIFICATION
All new landfills shall be capable of meeting all Class II standards. All new landfills
shall be required to install liners and blanket leachate control and recovery systems
meeting Class II standards regardless of whether Ciass II wastes are accepted. All other
Class II requirements shall be met if any Class II wastes are accepted. This requirement
could result in standards higher than the minimum standards in the State regulations but is
justified in order to provide a higher level of environmental protection.
TRANSFER STATIONS
The general public, using small vehicles, should be required to use transfer stations, if
available, rather than landfill. An enforcement mechanism, by landfill operators, should
be developed to implement this requirement. If some small public vehicles are allowed
access to the landfill (because a transfer station is not available) , a separate dumping
area should be provided away from the active working face of the landfill.
Recycling operations should be integrated into transfer station operations. Transfer
stations should provide dropoff recycling facilities, and attempt to recycle wastes from
the tipping floor of the transfer station, if possible. Separation of plant wastes for
chipping and/or composting is encouraged.
The following recommendations are developed for each geographical part of the County, West,
Central/South, and East.

For West County, a transfer station should be developed prior to, or coincident with,
closure of the West Contra Costa Sanitary Landfill. A West County transfer station will be
needed for any new "East County" landfill.
For Central/South County, a transfer station should be developed prior to, or coincident
with, the closure of Acme Fill. A Central/South County transfer station will be needed for
any new "East County" landfill. Franchised collectors and commercial haulers serving areas
on the fringes, near new landfills, can request an exemption from the requirement to use
the transfer station jf it is clearly shown that the exemption would not result in signifi-
cant traffic and environmental impacts and it is more cost-effective to haul directly to
the landfill. The general public from these fringe areas should still be required to use the
transfer station rather than the landfill.
For East County, a transfer station for the Pittsburg/Antioch area will likely be needed if
a landfill in the southeast part of the County is developed. If a landfill in Pittsburg/An-
tioch area is developed, the communities in the East County should decide for themselves
the necessity of a transfer station. Since these communities will be the impacted communi-
ties concerning traffic near the landfill, it is appropriate that their communities decide
if a transfer station is necessary and if they are willing to pay the extra cost for a
transfer station.

Board members expressed a desire to commend the Solid
Waste Commission for their efforts in developing the five additional
policy statements.

the Community Development Department is REQUESTED to draft for the
Chairman's signature a letter expressing the Board' s appreciation
to the Solid Waste Commission

Management Policy Statements
In its review of the additional policy statements developed
by the Solid Waste Management Commission, Board members determined
that further information is required on issues relative to host
mitigation measures, and control of the wastestream.
THEREFORE, IT IS BY THE BOARD ORDERED that:
1 . County Counsel and Community Development Department
staff are REQUESTED to review and report to the Board
what host mitigation measures are available and their
application to existing issues;
2. County Counsel and Community Development Department
staff are REQUESTED to report on mechanisms in place
providing for the control of the wastestream,
including options for various jurisdictions to
actively participate in this activity; and
3 . Director of the Community Development Department is
REQUESTED to review legislative activity relative to
the control of the wastestream and propose for Board
consideration new legislation in this area.
