THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on July 29, 1986 by the following vote:

RESOLUTION NO. 8 6/4 3 7
SUBJECT: Approval of a Substitute Subdivision Agreement and Security,
Subdivision 6475, Lafayette Area.
The following document was presented for Board approval this
date:
A substitute Subdivision Agreement with Lusk Homes-Lafayette,
a general partnership, subdivider, whereby said subdivider agrees to
complete all improvements as required in said Subdivision Agreement within
one year from the date of said agreement;
Said document was accompanied by the following:
Security to guarantee the road and drainage improvements as
required by Title 9 of the County Ordinance Code, as follows:
a. Cash deposit (Auditor's Deposit Permit No. 109497, dated
May 15, 1986) in the amount of $1,600, made by Haslemere of
Lafayette and assigned to Lusk Homes-Lafayette.
h. Additional security in the form of a corporate surety
bond dated July 10, t986, and issued by The American
Insurance Company (Bond No . SCR7098232) with Lusk
Homes-Lafayette as principal , in the amount of $161,400 for
faithful performance and $81,500 for labor and materials.
C. Substitute subdivision tax bond issued by The American
Insurance Company (Bond No. SMR7098233) in the amount of
$131,300 guaranteeing payment of the estimated taxes.
NOW THEREFORE BE IT RESOLVED that said substitute Subdivision
Agreement is APPROVED.
BE IT FURTHER RESOLVED that the Subdivision Agreement with
Haslemere of Lafayette, as approved by the Board on June 3, 1985, is
TERMINATED, the letter of credit issued by Great American First Savings
Bank is EXONERATED and the Public Works Director is AUTHORI7.ED to refund
same and the tax bond issued by Indemnity Company of California is
EXONERATED.
