The Board of Directors of the Canyon Lakes Geologic
Hazard Abatement District RESOLVES that:
On June 4 , 1985 , the County Board of Supervisors.
adopted Resolution No. 85/289, approving the formation of, and
the Plan of Control for, a geologic hazard abatement district
(GRAD) for the Canyon Lakes area, and appointing the Board of
Supervisors as the initial Board of Directors for the GRAD. On
July 15, 1986, the Board of Directors of the GRAD adopted
Resolution No. 86/405 providing, among other things, for the
appointment of the General Manager of the GRAD.
The Plan of Control provides that it will be subject
to revisions and modifications, as new data or investigations
warrant.
The General Manager of the GRAD has submitted and
recommended to the Board that the proposed Amendment No. 1 to
the Plan of Control , which amendment is attached hereto as
Exhibit A, be approved by the Board in order to further clarify
the duties and obligations of the GHAD. The Board has reviewed
and considered said proposed amendment. ,
NOW, THEREFORE, THE BOARD OF DIRECTORS HEREBY
RESOLVES, FINDS, CERTIFIES AND ORDERS AS FOLLOWS:
1 . Amendment No. 1 to the Plan of Control for the
Canyon Lakes GHAD, which amendment is attached hereto as
Exhibit A, is hereby APPROVED in its entirety .
2 . The previously approved Plan of Control for the
Canyon Lakes GHAD, as hereby amended, shall continue in full
force and effect.

EXHIBIT A
CANYON LAKES GEOLOGIC HAZARD ABATEMENT DISTRICT
AMENDMENT NO. 1 TO PLAN OF CONTROL
July 29, 1986
WHEREAS, on June 41 1985, the Contra Costa County
Board of Supervisors adopted Resolution No. 85/289 , approving
the formation of, and the Plan of Control for, a Geologic
Hazard Abatement District ( "GRAD" ) for the Canyon Lakes area,
and appointing the Board of Supervisors as the initial Board of
Directors for the GHAD; and
WHEREAS, it is presently contemplated that the GHAD
will be funded primarily from assessments against property
within the GHAD; and
WHEREAS, the Plan of Control for the Canyon Lakes GHAD
provides that it will be subject to revisions and
modifications, as new data or investigations warrant; and
WHEREAS, the Canyon Lakes sewer alignment may pose
additional risks of geologic hazards such that specific duties
and obligations should be added to the Plan of Control to
protect property owners within the GHAD; and
WHEREAS, certain of the obligations outlined below are
the primary responsibility of other districts and service areas
which encompass the area within the GHAD.
NOW, THEREFORE, BE IT RESOLVED that the Plan of
Control for the Canyon Lakes GRAD is hereby amended to provide
that the GHAD shall perform the following duties:
(1 ) Inspection and maintenance of all sloughing
and landslides within the GHAD, repair of same as necessary for
prevention, mitigation, abatement or control of landslides or
soil erosion; installation of flow meters throughout the GHAD
and maintenance of flow records;
(2 ) Inspection and maintenance of all benched
areas within hillside slopes within the GHAD;
(3 ) Inspection and maintenance of currently
repaired slides within the GHAD (including the slide adjacent
to the Nazarene Church) ; installation and inspection of slope
indicators in any active slide area; repair of same as
necessary for prevention, mitigation, abatement . or control of
landslides and soil erosion;
(4 ) Inspection and maintenance of all cut and
fill areas within the GHAD; repair of same as necessary for
prevention, mitigation, abatement or control of landslides and
soil erosion;
(5) Inspection, maintenance, replacement and
repair as necessary, of horizontal drilled drains, surface
drains and subsurface drains within the GHAD;
(6) The inspections described in Sections 1
through 5 above shall be carried out on a regular basis with
more frequent inspections during wet weather . Special
inspections shall be made after major storms;

(7 ) Maintenance activities shall .include the
regular removal of accumulated debris in surface water
diversion ditches, collector drains and the removal of debris
from subdrains and horizontal drilled drains as necessary; and
(8 ) If any of the obligations outlined above is
an obligation of any other district or service area
encompassing the GHAD, the GHAD shall only be obligated to
monitor the activities of the specific district or service area
to ascertain whether the work is being performed adequately to
meet the requirements of this Plan of Control .
RESOLVED FURTHER, that the GHAD be funded each fiscal
year with a minimum of $85,000, provided that such minimum
funding shall not be required where the total funds remaining
on hand at the close of the prior fiscal year exceed $400,000.
RESOLVED FURTHER, that the previously approved GHAD
Plan of Control , as amended herein, shall continue in full
force and effect .
