HomeMy WebLinkAboutMINUTES - 09101985 - X.19 TO: BOARD OF SUPERVISORS FROM: Sunne Wright McPeak Contra Costa DATE: September 10 , 1985 County SUBJECT: Action Against Pacific Refining SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Direct County Counsel to file an amicus brief on behalf of the Contra Costa County Board of Supervisors in the law suit filed by the Bay Area Air Quality Management District (BAAQMD) against Pacific Refining seeking $54, 000 in penalties for violations of abatement orders and requesting injunctive relief. Further request the County Administrator to send a letter to the Bay Area Air Quality Management District Board of Directors in support of their actions on the Task Force established in June and the law suit. BACKGROUND: The Bay Area Air Quality Management District Board of Directors ._ on September 4, 1985 voted unanimously to sue Pacific Refining for penalties and injunctive relief. This law suit was coordin- ated with the Contra Costa County District Attorney through the Task Force established by the Bay Area Air Quality Management District in June which is currently completing an agreed upon work program to review the engineering integrity of the refinery and analyze potential health risks. Support of the law suit from other jurisdictions is being encour- aged to underscore the seriousness of the community leadership' s concern. Therefore, an amicus curiae brief from the Board of Supervisors itself would be appropriate.
