HomeMy WebLinkAboutMINUTES - 09101985 - T.9 T.9 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on September 10 , 1985 , by the following vote: AYES : Supervisors Powers, McPeak, Torlakson and Fanden NOES: None ABSENT : Supervisor Schroder ABSTAIN: None -------------------------------------------------------------------- SUBJECT: Appeal of Bethel Island Municipal ,Improvement District - from approval of DP 3045-84 and Preliminary Development Plan;.'1832-RZ, Nahama & Weagant Energy Company and Quad Consultants, applicants, and Delta Coves Partnership, Owners, Bethel Island area. The Board on August 13, 1985 continued to this day and time its hearing on the appeal of the Bethel Island Municipal Improvement District, Howard Holmes, President, from the County Planning Commission approval 'of the application of Nahama & Weagant Energy Company and QUAD Consultants, applicants, and Delta Coves Partnership, owner, for approval of Development Plan 3045-84 for an exploratory gas well ' and approval ' to change Preliminary Development Plari' 1832-RZ on property located on the south side of Gateway Road, east of Piper Road in the Bethel Island area. Harvey Bragdon, Assistant Director of Community Development, .described the details of the application. Mr. Bragdon suggested that in view of the Board' s action approving its Determination Item 2 .8 on today' s agenda directing staff to explore means to identify the causes of subsidence and to. locate revenue sources to accomplish the study, it might be possible that Mr. Holmes, on behalf of the Bethel Island Municipal -Improvement. District, might withdraw the appeal .- Mr. ppeal :Mr. Homes advised that in view of the progress made in calling attention to the subsidence problem and the steps taken to address it, the Board of Directors of Bethel Island Municipal Improvement District is willing to withdraw its appeal--on the appli- cation so the studies may proceed, and expressed appreciation for the Board' s time spent on the problem. Mr. Ty Stillman, representing Nahama & Weagant Energy Company, discussed his company' s findings with respect to sub- sidence in the Delta. Supervisor Powers recommended that with the action taken by the Board this day initiating study of subsidence in the Delta, and the appellant's subsequent withdrawal of the appeal; that the application be approved. IT IS BY THE BOARD ORDERED THAT Development 'Plan 3045-84 and a change in preliminary development plan 1832-RZ are APPROVED subject to the conditions of approval imposed by the Zoning Administrator, attached hereto as Exhibit A. Approval is for one gas well as generally shown on plans dated August 16, 1984. 2. All drilling rigs shall be fitted with the best available technology mufflers for all engines used. 3. All unnecessary drilling activity shall be limited to daylight hours. 4. All non-emergency deliveries shall be limited to daylight hours. 5. If any compressors or other internal combustion engines are utilized for continuing operations, all such engines shall be either enclosed in a structure with proper noise abatement equipment installed or be acoustically screened using noise attenuation barriers located between the engine emission outlet and any noise receptor (residence) located within 1,000 feet of any drilling rig operation. The standard to be met shall be 55 dBA maximum as measured at the exterior of the nearest residence. An acoustical analysis verifying compliance with this standard shall be submitted to the Planning Department within 30 days of well operation. 6. The applicant shall provide an acoustical analysis which documents how a sound barrier will be constructed around the drilling site to reduce exterior noise levels during the short term well drilling operation expected to be conducted over a 15 day (24 hours a day) period. This analysis shall clearly document requirements to obtain a noise reduction to a standard of 65 dBA CNEL maximum measured at the outside of the nearest residence. 7. All produced water shall be collected on site and periodically trucked to a properly licensed disposal facility. 8. All excavated containment basins shall be lined with a double layer of 20 mil plastic and routinely pumped during drilling. Any containment basin shall never be more than two-thirds full. 9. No drilling compounds, water produced from gas drilling or production, or other waste materials or refuse shall be disposed of or dumped on site. M F:plp9 adp _ 3/12/85 ~1 .
