On the recommendation of the Director of Planning, IT IS BY THE
BOARD ORDERED that Supervisor W. N. Boggess, Chairman, is AUTHORIZED to
execute an agreement with the Bureau of the Census, effective September 1,
1975, under the terms of which the county will receive $15,000 for correction
and updating of county statistical records and reports (county's existing
Geographic Base Dual Independent Map Encoding (GBF/DIME) Program) .

JOINT STATISTICAL AGREEMENT
BETWEEN
THE BUREAU OF THE CENSUS
AND
THE COUNTY OF CONTRA COSTA
The Bureau of the Census, hereinafter referred to as the Bureau, and
the County of Contra Costa, hereinafter referred to as the Local
Agency, a county government organized and existing under the laws of
the State of California, agree to cooperate in a joint statistical
project, as authorized by Title 13, United States Code, Section 8(b),
the purpose and general terms of which are described as follows:
I. INTRODUCTION
A. The objectives of this project are:
1. To provide the Contra Costa County portion of the San
Francisco-Oakland, California, Standard Metropolitan
Statistical Area, hereinafter referred to as SMSA, a
correct and up-to-date Metropolitan Map Series,
hereinafter referred to as MDiS, which will meet
established Bureau specifications.
2. To update the Geographic Base (DIME) System, hereinafter
referred to as GBF/DIME-File, for the Contra Costa
County portion of the San Francisco-Oakland, California,
SMSA which will meet established Bureau specifications
by following the Bureau's Correction, Update, and
Extension program, hereinafter referred to as the CUE
program.
B. The Local Agency's interest in the project is to provide
itself and other users, both public and private, with a
correct and up-to-date NIMS and GBP/DIME-File through which
local information can be spatially organized and, thus, which
can be used effectively by local agencies of government for
decisionmaking, management, planning, and analysis.
C. The Bureau's interest is to acquire a correct and up-to-date
MMS and GBF/DIME-File in order to (among other uses) : (1)
assign accurate geographic classifications to the data
collected in the Decennial Censuses of Population and
Housing, the Economic Censuses, and other major Bureau.
surveys, and (2) provide accurate publication maps designed

to identify the statistical and political areas for which
summary statistical data are being published by the Bureau.
D. This work must be accomplished now so that:
1. Recommendations concerning tract and block schemes for
the 1980 Decennial Census of Population and Housing can
be forwarded to the Bureau by June 30, 1976; and
2. The MMS and GBF/DIME-File will be available and be
current by January 1977 for use in the 1977 Economic
Censuses.
It is understood that further work will be required of the
Local Agency on the GBF/DIME-File and MMS after completion of
this Agreement in order to meet a time frame of late 1978 for
submission to the Bureau of a file and maps for use in the
1980 Decennial Censuses of Population and Housing;
E. To achieve these objectives, each of the parties to this
Agreement will contribute to the planning, conduct, and
execution of the work required to achieve the objectives of
the program in accordance with this Agreement.
F. All applicable Bureau specifications to achieve these
objectives are contained in the appropriate Bureau GBF/DIME-
File and CUE system manuals listed below and are to be
followed by the participating Local Agency:

II. SCOPE OF AGREEMENT:
A. The Local Agency agrees that it will:
1. Provide from local sources, the geographic and address
reference materials needed for the update of the
GBF/DIME-File and MMS as described in detail in the
applicable Bureau manuals listed in Item I F;
2. Provide sufficient professional and clerical personnel
(including the supervisor) to carry out all required
clerical operations;
3. Provide sufficient personnel to draft the corrected and
updated information onto the reproducible MMS;
4. Ensure that the Association of Bay Area Governments,
hereinafter referred to as ABAG, provides sufficient
personnel and appropriate computer equipment to carry
out the required computer operations for the update.
This includes inserting into the GBF/DIME-File, after
each phase, any changes, additions, and deletions using
the FIXDIME II (2/C) corrector program, running a
minimum of two cycles of the edit programs (TOPOEDIT and
ADDEDIT-L) on the updated file, and inserting any
corrections resulting from review of the edit listings
into the file using FIXDIME II (2/C);
5. Provide adequate space, furniture, supplies, and
equipment as required in support of this work;
6. Follow the specifications and procedures provided in the
appropriate GBF/DIME-File and CUE procedural manuals
(listed in Item I E) covering the update phase, to:
a. Update the reproducible MMS to April 1, 1976;
b. Update the GBF/DIME-File to April 1, 1976 to
reflect the changes made to the MMS; and

C. Correct errors flagged and listed for review by two
cycles of the computer edits (TOPOEDIT and ADDEDIT-
L) run on the updated GBF/DIME-File;
7. Provide to the Bureau, upon completion of each phase a
computer tape of the entire GBF/DIME-File containing any
changes, additions, and deletions. This submission
should follow the specifications in the appropriate
procedural manual listed in Item I F;
8. Return to the Bureau upon completion of the update phase
the reproducible set of MMS originally provided by the
Bureau and now containing corrected and updated
information; and
9. Make such additional corrections, additions, or
deletions to the GBF/DIME-File or MMS as may be required
after review of the maps and file by the Census Bureau
following the acceptance criteria outlined in Item B 4
below.
B. The Bureau agrees that it will:
1. Assign professional and clerical personnel as needed to
carry out the Bureau's project responsibilities;
2. Provide all clerical procedures, transcription sheets,
map sheets, and other materials required by the Local
Agency to carry out the update of the MMS and GBF/DIME-
File as described in the appropriate procedural manuals
listed in Item I F;
3. Provide to ABAG the computer edit and correction
programs and the necessary documentation so that it may
carry out the computer operations locally. (These
;programs include, but are not necessarily limited to
!FIXDIME II (2/C), TOPOEDIT, ADDEDIT-L, CREATE, and
'FIXCORD);
4. Check the GBF/DIME-File and MMS to ensure that the
; corrections, additions, and deletions made to the file
and maps by the Local Agency are complete and consistent
, and meet Bureau requirements. (Requirements are those
standards of final data indicated in the procedural
manuals listed in Item I E). A check will also be made
each time a file is submitted on computer tape as to
whether the file being submitted meets Bureau format
specifications, can be used on Bureau computer
equipment, and is complete;

5. Insert the X-Y coordinate values (State plane, latitude-
longitude, and map set miles) into the GBF/DIME-File for
all node point additions and corrections identified by
the Local Agency;
6. Provide the Local Agency with a copy of the updated
GBF/DIME-File after the X-Y coordinates have been
inserted and a reproducible set of the updated MMS after
changes to the file and maps have been found complete
and acceptable; and
7. Transfer the sum of $15,000 to the Local Agency in the
amounts indicated below:
a. Payment of 40 percent ($6,000) of the total shall
be made when the update information is received by
the Bureau and determined to be complete and
acceptable for inclusion in the file in order to
run the first-cycle computer edits (TOPOEDIT and
ADDEDIT-L) on the updated file;
b. Payment of 30 percent ($4,500) shall be made when
the corrections to the first-cycle edits run on the
updated file are received by the Bureau and
determined to be complete and acceptable for
inclusion in the file in order to run the second-
cycle computer edits (TOPOEDIT and ADDEDIT-L) ; and
C. Payment of the balance of the funds ($4,500) shall
be made when:
(1) The corrections to the second-cycle computer
edits run on the updated file are received by
the Bureau and determined to be complete and
acceptable for inclusion in the file; and
(2) The updated reproducible MATS have been
received by the Bureau and determined to be
complete and acceptable.
C. It is agreed that the Bureau shall not be obligated for any
costs other than those indicated in Article II B. Item 7 and
the Bureau shall have the use of the GBF/DIME-File and the
MMS without cost or other restriction.
D. The term "data" as used herein includes written reports
(progress or interim) , a corrected and updated GBF/DIME-File,
a corrected and updated NIMS, and other outputs produced
locally and which are required to be delivered under this

Agreement. It does not include financial reports or other
information incidental to contract administration.
The data submitted to and accepted by the Government under
this Agreement shall be the property of the United States
Government and the Government shall have full rights to use
such data for any purposes in whatever manner deemed
desirable and appropriate. Such use shall be without any
additional payment to or approval by the Local Agency. The
Local Agency relinquishes any and all copyrights and/or
copyright rights and/or privileges to the data developed
under this Agreement and agrees not to apply for any
copyright. The Local Agency shall be free to use any of the
data obtained. Any of the GBF/DIME-File or MMS duplicated
and/or distributed shall be identified by such phrasing as
"These data are the result of a tax-supported program and as
such are not copyrightable." The data may be freely
reproduced with the customary crediting of the source. The
Local Agency shall not include in the data any copyrighted
matter, unless the Local Agency provides the Government with
the written permission of the copyright owner for the
Government to use such copyright matter.
E. Mr. Anthony A. Dehaesus, Director of Planning, is designated
as correspondence contact and principal supervisor at the
Local Agency and is responsible for the day-to-day operation
of the project.
F. This Agreement shall become effective on September 1, 1975,
and shall extend. through August 31, 1976. The Local Agency
shall furnish the Bureau the completed work no later than
August 31, 1976. This period may be extended by mutual
agreement. The Local Agency will give this project high
priority, and will furnish monthly progress reports during
the extent of the project.
G. The Chief of the Geography Division, Bureau of the Census, is
designated as the Bureau's representative for the purpose of
answering technical questions and evaluation of project
results.
H. The Local Agency warrants that no person or selling agency
has been employed or retained to solicit or secure this
Agreement upon an agreement or understanding for a
commission, percentage, brokerage, or contingent fee
excepting bona fide employees or bona fide established
commercial or selling agencies maintained by the Local Agency
for the purpose of securing business. For breach or
violation of this warranty the Bureau shall have the right to
annul this Agreement without liability or in its discretion

(e) The Local Agency will furnish all information and reports
required by Executive Order No. 11246 of September 24, 1965,
and by the rules, regulations, and orders of the Secretary of
Labor, or pursuant thereto, and will permit access to his
books, records, and accounts by the Local Agency and the
Secretary of Labor for purposes of investigation to ascertain
compliance with such rules, regulations and orders.
(f) In the event of the Local Agency's non-compliance with the
Equal Opportunity clause of this agreement or with any of the
said rules, regulations, or orders, this agreement may be
canceled, terminated, or suspended in whole or in part, and
the Local Agency may be declared ineligible for further
Government agreements in accordance with procedures
authorized in Executive Order No. 11246 of September 24,
1965, and such other sanctions may be imposed and remedies
invoked as provided in Executive Order No. 11246 of September
24, 1965, or by rule regulation, or order of the Secretary of
Laboi, or as otherwise provided by law.
(g) The Local Agency will include the provisions of paragraphs
(a) through (g) in every subcontract or purchase order unless
exempted by rules, regulations, or orders of the Secretary of
Labor issued pursuant to section 204 of Executive Order No.
11246 of September 24, 1965, so that such provisions will be
binding upon each subcontractor or vendor. The Local Agency
will take such action with respect to any subcontract or
purchase order as the Local Agency may direct as a means of
enforcing such provisions, including sanctions for
noncompliance: Provided, however, that in the event the
Local Agency becomes involved in, or is threatened with,
litigation with a subcontractor or vendor as a result of such
direction by the Local Agency, the Local Agency may request
the United States to enter into such litigation to protect
the interests of the United States.

During the performance of this agreement, the Local Agency agrees
as follows:
(a) The Local Agency will not discriminate against any employee
or applicant for employment because of race, creed, color, or
national origin. The Local Agency will take affirmative
action to ensure that applicants are employed, and that
employees are treated during employment, without regard to
their race, creed, color, or national origin. Such action
shall include, but not be limited to, the following:
Employment, upgrading, demotion, or transfer; recruitment or
recruitment advertising; layoff or termination; rates of pay
or other forms of compensation; and selection for training,
including apprenticeship. The Local Agency agrees to post in
conspicuous places, available to employees and applicants for
employment, notices to be provided by the Local Agency
Officer setting forth the provisions of this Equal
Opportunity clause.
(b) The Local Agency will, in all solicitations or advertisements
for employees placed by or on behalf of the Local Agency,
state that all qualified applicants will receive
consideration for employment without regard to race, creed,
color, or national origin.
(c) The Local Agency will send to each labor union or
representative of workers with which he has a collective
bargaining agreement or other contract or understanding, a
notice, to be provided by the agency officer, advising the
labor union or workers' representative of the Local Agency's
commitments under this Equal Opportunity clause, and shall
post copies of the notice in conspicuous places available to
employees and applicants for employment.
(d) The Local Agency will comply with all provisions of Executive
Order No. 11246 of September 24, 1965, and of the rules,
regulations, and relevant orders of the Secretary of Labor.

to deduct from the Agreement price or consideration, or
otherwise recover, the full amount of commission, percentage,
brokerage, or contingent fee.
I. The Local Agency agrees that they will conform with the Equal
Opportunity requirements as stated in the Federal Procurement
Regulations Part 1-12.803-2. (Copy attached)

other Federal agencies during normal business hours for a
period ending three years after completion of this agreement.
The Local Agency also certifies that the funds being paid to
them by the Bureau under this Agreement represent no more
than one-half of the total cost to prepare the products
itemized in this Agreement and that the other funds are not
funds from other Federal-programs.
11. Upon completion of the work required for a payment under this
Agreement, as specified in Item II B 7, an invoice should be
submitted to:

N. If any or all of the work specified under this Agreement to
be performed by the Local Agency will be performed by a third
party;, the work performed and the third party agreement shall
meet the specifications set forth in this Agreement and a

Amendment No. 1
JOINT STATISTICAL AGREEMENT
BETWEEN

It is agreed that the following changes be made to Joint Statistical
Agreement 76-34:
1. Change Item II. F. to read as follows:
F. This Agreement shall become effective on September 1, 19750
and shall extend through I-larch 31, 1977. The Local Agency
shall furnish the Bureau with the completed work specified in
this agreement no later than March 31, 1977. The Local
Agency agrees to provide this project a sufficiently high
priority in its total work program in order to complete the
indicated work on or before the specified completion date.
If the specified work under this Agreement is not or will not
be completed by the specified date above, the Local Agency is
required to provide justification in writing to the Bureau as
soon as the Local ,'Agency determines that the Agreement cannot
be fulfilled, but no later than 30 days prior to the
completion date specified above.
3. Add Items 11. J. 0 1:. , L. $ Id., and N. as follows:
J. Only CUE program procedures may be used to fulfill the
requirements of this Agreement. Tliese procedures are
described in the manuals listed in Item I E. No locally
developed procedures may be used under this Agreement.
K. Any. modification of the terms.or conditions of this Agreement
must lie in writing and by mutual consent. The Local Agency
will ;furnish monthly progress reports to the Bureau in the
form and mariner specified by the Bureau during the period of
this /agreement.
L. The Local Aency shall maintain financial records in
accordance with applicable Federal regulations, and shall

IT IS BY THE BOARD ORDERED that the chairman is AUTHORIZED to
execute Agreement Amendment for an extension of time for completion
of the Joint Statistical Agreement with the U.S. Bureau of the Census,
