County and mitigate subsidence effects. SPECIFIC REQUEST(S) OR RECOMMEr�IDATION(S ) & BACKGROUND AND JUSTIFICATION j I. RECOMMENDED ACTION: r Direct staff to explore means to identify causes of subsidence in the county and possible j mitigating action, and prepare tentative regulations and explore sources of revenue to tiaccomplish the needed Dreparatory studies and needed mitigation. II. FINANCIAL IMPACT: Amount of staff time necessary to do this work is unknown at this time. III. BACKGROUND: Subsidence is occurring in the delta and is Suspected in other areas where oil, gas and water are being withdrawn. The subsidence may affect delta levees and could affect the operation of canals and underground pipes. Subsidence results from several causes; some cause's, principally withdrawal of fluids, are man-induced and manageable. The State is considering adding to a program to study subsidence regionally. Studies are underway in the northern Sacramento Valley. The state studies are too general to pinpoint Contra Costa County's problem areas, and the costs of a study by the County alone are prohibitive. Coordinated State-county resources would be cost-effective but no -county funds are allocated to the studies in the Countv's 1986 budget, nor are any revenues available for studies. Some possible methods to collect needed revenues include: (1) voter-approved taxation of oil and gas produced in the county; (?) a benefit assessment district; (3) fees charted for applications for entitlements to withdraw oil, gas, or water; (4) fees collected upon approvals to such entitlements and subject to payback (without interest) as more entitlements are approved; (i5) required annual renewal of land use permits for entitlements to withdraw, issued administratively; (6) and provisional application fees that would be credited/ against eventual ordinance-imposed fees or taxes. _ CONTINUED ON�ATTACHMENT; X YES SIGNATURE: RECOMMENDATION OF COUNTY ADMINISTRATOR RECOMMENDATION OF (BOARD CCIMMITTEE APPROVE OTHER / SIGNATURE S1: ACTION OF BOARD ON /U S APPROVED AS RECOMMENDED OTHER VOTE OF SUPERVISORS 1 HEREBY CERTIFY THAT THIS IS A TRUE UNANIMOUS (ABSENT AND CORRECT CCPY OF AN ACTION TAKEN AYES: NOES'. I li Two areas where fees or taxes may be desirable are: (1) north of Southern Pacific Railroad and east of the Citv limits of Antioch, and I (2) other parts of Townships 1 and 2 N, Ranges 2 and 3E from `Mount Diablo Base and -Meridian. This area would need to be adjusted in the future. Separate fee or tax schedules need to be considered for oil and gas wells and water wells, based in part on their numbers (many more water wells, thus lower fees) and the contribution each is found to make to the total amount of man-induced subsidence. Water r well fees of no more than $100 per application, and oil and gas fees in the thousands of dollars) (1 to 10) per application, or equivalent tax, are considered tentatively. The cost being considered for the States' 1985-86 budget with no county participation is $501,000, and includes the basic framework for Contra Costa County's participation. This includes: I (l) establishing a network of precision bench marks, (21) 1, or 2 at most, subsidence recorder stations with water level recorders in the county with a tie bench mark at each station, and (3) repeated relevelling by satellite to record total subsidence at each station. Contra Costa County needs 6 to 10 -ecorder stations, each consisting of a bench mark, 1 or 2 subsidence recorders, and a water level recorder. Each station is estimated to cost approximately S25,000 to $35,000: Firmer cost estimates ` may be available from the State vi thin a week. 'I Iii i 5c I I ii II' I i I 1 .00. a. None SUBJECT: Need to participate in State ) Resolution No. 85/549 subsidence studies and to locate ) potential sources of revenue ) i I WHEREAS, subsidence is known to be occurring in the delta part of Contra Costa County and may also affect other areas where oil, gas, and water are withdrawn, and WHEREAS, the effects of subsidence may damage levees, pipelines, and canalsthat cross subsiding areas, thei•ebv affecting the safety and welfare of residents of Contra Costa County; and WHEREAS, there are many causes of subsidence, and some may be man- induced and could be controlled if their causes were segregated; and WHEREAS, the Board of Supervisors of Contra Costa Ccunty recommended State and Federal studies to sem egate the causes of subsidence, by Board Order on March 12, 1985; and NHEREAS, the State proposes to extend studies of subsidence to Contra Costa', Coainty and the Countv would benefit by adding to the detail by cooperating with the State studies, and WHEREAS, the costs of subsidence studies are high and should be borne by any persons or agencies that may be inducing or contributing to subsidence when they can be identified; THEREFORE, IT IS BY THE BOARD ORDERED that staff begin studies to locate revenue sources and appropriate conditions of approval that should be imposed on entitlements to withdraw oil, gas, or water in subsidence-prone areas, mechanisms to survev subsidence that can be coordinated with State or Federal studies, and, if appropriate, establish. a fund in which to credit any revenue received and from which to pay back credits against such a fund.
